(No M&C Needed) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and Dunaway Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 24870, (the Contract) which was authorized by the City Council by M&C 17399 on the 4th day of May, 1999; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Main 21 Drainage Area Rehabilitation and Sewer System Improvement (Group 7, Contract 2) Part 2 . WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated March 1, 2000, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $10,026.46. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $90, 055.52 . F 1101 J 3. All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect. Douglas Rademaker, Director, DOE and Mike Groomer, Assistant City Manager FROM: Tony Sholola, DOE -r S DATE: March 22, 2000 RE: DESIGN FEE AMENDMENT NO. 1 TO MAIN 21 DRAINAGE AREA SANITARY SEWER REHABILITATION AND IMPROVEMENTS (GROUP 7, CONTRACT 3), PART 2, DOE NO. 2487, SEWER PROJECT NO. PS46-070460410310 The proposed amendment will reimburse Dunaway Associates, Inc. for the additional de- sign, survey services they provided on the project as requested by the City. It has been determined that it is necessary to replace an additional 630 linear feet of se- verely deteriorated sewer lines located with the project area. The poor condition of the identified sewer lines was unknown at the time the original design contract was executed. The additional sewer lines will require the acquisition of two permanent easements, one temporary construction easement and eleven temporary rights-of-entry. Dunaway Associates, Inc., has requested reimbursement in the amount of$10,026.46 for the additional design services, thereby increasing the contract fee from $80,029.06 to $90,055.52. I believe this fee is fair and reasonable for additional design services. Please authorize the additional fee by your signatures on the attached contract amend- ment form.
