THIS AMENDMENT IS MADE BY and between the State of Texas, acting by and through the Texas
Department of Transportation, hereinafter called the Department, and City of Fort Worth,hereinafter
called the Subgrantee, and becomes effective when fully executed by both parties.
WITNESSETH
The Department and the Subgrantee executed a grant agreement on October 1, 1999 to conduct a traffic
safety project generally described as Safe& Sober Selective Traffic Enforcement Program.
On the front page, 1 of 10,the grant agreement specifies that the grant completion date is September 30,
2 00 1, unless the grant is terminated or otherwise modified.
The Agreement established the maximum amount payable under the grant agreement as$255,161.00.
unless modified in writing through an amendment to the grant agreement,
Attachment A to the grant agreement includes the Approved Project Description for the project;
Attachment A, Item II Objective/Performance Goals are being amended to reflect corrections to the
baseline data used in setting defined goals; and,
NOW, THEREFORE, premises considered,the Department and the Subgrantee agree that the grant
agreement is amended as follows:

SAFE AND SOBER
SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (STEP)
City of Fort Worth

I. PROBLEM IDENTIFICATION
Crash data indicates that 50 persons were killed in traffic crashes in the City of Fort
Worth during the first eleven months of 1997. Further analyses of these crashes
indicate that 46% of these killed were not restrained. Speed is also a severe problem.
79.2% of drivers recently surveyed were exceeding the posted speed limit.
Additionally, there were 257 crashes involving alcohol and other drugs. The City of
Fort Worth is over-represented in speed and alcohol crashes.
II. OBJECTIVE/PERFORMANCE GOALS:
Objective:
To conduct a Safe and Sober STEP in the City of Fort Worth by September 30, 2001.
Performance Goals:
FY 2000:
A. To reduce the number of speed crashes by 5% from the baseline year (12
months: October 1, 1996 through September 30, 1997) number of 3,265 speed
crashes to 3,102 speed crashes by September 30, 2000.
B. To increase the percentage of vehicles in compliance with the speed limit by
I percentage points from the pre and post survey by September 30, 2000.
C. To increase the total number of speed citations by 22 % from the baseline year
(12 months October 1, 1996 through September 30, 1997) number of 46,591
speed citations to 56,841 speed citations by September 30, 2000.
D. To reduce the number of alcohol related crashes by 5% from the baseline year
(12 months: October 1. 1996 through September 30, 1997) number of 724
alcohol-related crashes to 688 alcohol-related crashes by September 30, 2000.
E. To increase DWI arrests by 5% from the baseline year (12 months: October 1,
1996 through September 30, 1997) number of 1,905 DWI arrests to 2,000 DWI
arrests by September 30, 2000.
F. To increase safety belt use among drivers and front seat passengers by
5 percentage points and child passenger restraint use by 5 percentage points
from pre and post surveys by September 30, 2000.

G. To increase the total number of occupant protection (OP) citations issued by
50% from a baseline period (12 months: October 1, 1996 through September
30, 1997) number of 7,822 OP citations to 11,733 OP citations by September
30, 2000.
FY 2001:
A. To reduce the number of speed crashes by 7% from the baseline year (12
months: October 1, 1996 through September 30, 1997) number of 3,265 speed
crashes to 3,036 speed crashes by September 30, 2000.
B. To increase the percentage of vehicles in compliance with the speed limit by
5 percentage points from the pre and post survey by September 30, 2000.
C. To increase the total number of speed citations by 27% from the baseline year
(12 months October 1, 1996 through September 30, 1997) number of 46,591
speed citations to 59,171 speed citations by September 30, 2000.
D. To reduce the number of alcohol related crashes by 7% from the baseline year
(12 months: October 1, 1996 through September 30, 1997) number of 724
alcohol-related crashes to 673 alcohol-related crashes by September 30, 2000.
E. To increase DWI arrests by §% from the baseline year (12 months: October 1.
1996 through September 30, 1997) number of 1,905 DWI arrests to 2,057 DWI
arrests by September 30, 2000.
F. To increase safety belt use among drivers and front seat passengers by
5 percentage points and child passenger restraint use by 5 percentage points
from pre and post surveys by September 30, 2000.
G. To increase the total number of occupant protection (OP) citations issued by
52% from a baseline period (12 months: October 1, 1996 through September
30, 1997) number of 7,822 OP citations to 11,889 OP citations by September
30, 2000.
Nothing in this agreement shall be interpreted as a requirement, formal or informal,
that a police officer issue a specified or predetermined number of citations in
pursuance of the Subgrantee's obligations hereunder.
III. PERFORMANCE INDICATORS:
The following performance indicators, when applicable, shall be included in each
Performance Report or Annex Report, and summarized in the Administrative
Evaluation:
A. Citations/arrests issued under STEP by number and type.
B. Subgrantee total arrests or citations (including STEP) for each of the following:
DWI
Speed Over Limit
Safety Belt

Child Restraint
C. Number of arrests/citations per enforcement hours worked (calculate using the
following point system: Speed = 1 point, OP = 1 point, and DWI = 18 points).
D. Speed Performance Indicators.
1. Number of Speed site enforcement hours worked.
2. Maintenance of non-STEP Speed citation activity.
3. Number of speed-related crashes.
4. Post survey to determine percent of vehicles exceeding posted speed limits
at STEP sites (only required to be reported in the Administrative
Evaluation).
E. DWI Performance Indicators.
1. Number of DWI site enforcement hours worked.
2. Maintenance of non-STEP DWI arrest activity.
3. Number of alcohol-related crashes.
4. Number of officers working DWI STEP trained in SFST.
5. Number of officers working DWI STEP.
F. Occupant Protection Performance Indicators.
1. Number of OP site enforcement hours worked.
2. Maintenance of non-STEP safety belt and child restraint activity.
3. Number of Occupant Protection Violator Courses (OPVC) conducted.
4. Number of OPVC attendees.
5. Number and results of occupant protection surveys conducted.
6. Percentage point change in observed safety belt and child restraint
usage between pre and post surveys (only required to be reported in the
Administrative Evaluation).
7. Number of officers working OP STEP trained in the Traffic Occupant
Protection Strategies (TOPS) course.
8. Number of officers working OP STEP.
G. Number of presentations conducted in support of this grant.
H. Number of persons attending presentations.
I. Number of media exposures (i.e., news releases and interviews).
J. Number of community events in which STEP officers participated (i.e., health or
safety fairs, booths).
K. Number of public information and education materials produced.
L. Number of public information and education materials distributed (by item).

IV. RESPONSIBILITIES OF THE SUBGRANTEE:
A. Carry out the objective/performance goals of this grant by implementing the
Action Plan in this attachment.
B. Prior to enforcement activity, develop an Operational Plan according to the
Department's site selection criteria, and submit for approval either as an
attachment to this grant or within 30 days of grant start. The Operational Plan
will include:
• SPEED sites: STEP Site; Site description (including approximate length in
miles and posted limits); Speed Survey Results; and Start and End of Shift.
(The subgrantee shall follow the Department's Operational Plan Approval
Criteria for STEP site selection and conducting speed surveys.)
• DWI sites: STEP Site; Site description (specific location or by area such as
quadrant, precinct or region); and Start and End of Shift.
• OP sites: STEP Site; Site description (specific location or entire jurisdiction
such as citywide or countywide); and Start and End of Shift (must be
daylight hours).
C. Implement the Operational Plan as approved. Any changes require prior
written Department approval. A grant amendment is not required unless the
Plan is incorporated in the grant agreement.
D. All newly developed public information and education (PI&E) materials must be
submitted to the Department for written approval prior to final production.
E. An Administrative Evaluation summarizing all activities and accomplishments
will be submitted on Department approved forms no later than 45 days after the
grant ending date.
F. Attend meetings according to the following:
1. The Subgrantee will arrange for meetings with the Department as
indicated in the Action Plan to present status of activities, discuss
problems and schedule for the following quarter's work.
2. The project coordinator or other qualified person will be available to
represent the Subgrantee at meetings requested by the Department.
G. For out-of-state travel expenses to be reimbursable, the Subgrantee must have
obtained the approval of the Department prior to the beginning of the trip.
Grant approval does not satisfy this requirement.
H. Maintain verification that wages or salaries for which reimbursement is
requested is for work exclusively related to this project.

1. In addition to Safe and Sober STEP enforcement activities, maintain the
agency's total non-STEP enforcement citations/arrests at no less than the level
attained prior to grant approval.
J. Ensure that the enforcement hours worked under the grant are for STEP
activities.
K. Ensure that each officer working on the STEP project will complete an officer's
daily report form. The form should include: name, date, badge/identification
number, type grant worked, grant site number, mileage if applicable (including
starting and ending mileage), hours worked, type citation/arrest, officer and
supervisor signatures.
L. Ensure that no officer above the rank of Lieutenant (or equivalent title) will be
reimbursed for enforcement duty.
M. Support grant enforcement efforts with public information and education (PI&E).
Enforcement salaries being claimed for PIKE activities must be included in the
budget.
N. Subgrantees with a Traffic Division will utilize traffic personnel for this grant
unless such personnel are unavailable for assignment.
O. Officers assigned to Speed sites should be trained in the use of radar or laser
speed measurement devices.
P. Officers assigned to OP sites should be trained in the Traffic Occupant
Protection Strategies (TOPS) course approved by the Texas Commission on
Law Enforcement Officer Standards and Education (TCLEOSE).
Q. Require that all officers assigned to work DWI enforcement are trained in the
NHTSA/IACP DWI Detection Standardized Field Sobriety Testing (SFST).
Provide a letter to the Department from the enforcement agency head, training
officer, or authorized individual stating that the officers working the grant are
trained. For a first year DWI grant, the officers can be trained or must be
scheduled to be SFST trained by the end of the grant year.
R. Prior to conducting Speed enforcement, the Subgrantee must select and
survey enforcement sites that comply with existing state mandated speed limits
in accordance with the Texas Transportation Code, Sections 545.352, 545.353,
and 545.356.
S. Conduct speed zone surveys to determine appropriate STEP sites. Surveys
may be conducted prior to the beginning of the grant. Those departments
choosing to conduct the speed zone surveys during the first month of the grant
must submit them with a completed Operational Plan within the first thirty (30)
days of the grant. If the Subgrantee selects the option of submitting the Plan
within the first 30 days, no enforcement activity, with the exception of the

surveys, may take place prior to receiving written Department approval of the
Operational Plan.
T. Ensure that salaries for employees reimbursed under this grant will in no way
supplant (i.e., replace state or local expenditures with the use of federal grant
funds) Subgrantee wages for activities which are already supported by local or
state funds.
U. Subgrantee may work additional STEP enforcement hours on holidays or
special events not covered under the Operational Plan. However, additional
hours must be reported in the Project Performance Report that covers the time
period for which the additional hours were worked.
V. If an officer makes a STEP-related arrest during the shift, but does not
complete the arrest before the shift is scheduled to end, the officer can
continue working under the grant to complete that arrest.
W. The Subgrantee should have a safety belt use policy. If the Subgrantee
does not have a safety belt use policy in place, a policy should be
implemented during the grant year.
V. RESPONSIBILITIES OF THE DEPARTMENT:
A. Monitor the Subgrantee's compliance with performance obligations and fiscal
requirements of this grant.
B. Provide program management, technical assistance, and attend meetings as
appropriate.
C. Reimburse the Subgrantee for all eligible costs as defined in Attachment B,
Approved Project Budget. Requests for Reimbursement will be processed up
to the maximum amount payable as indicated on the cover page of this
agreement.
D. Perform an administrative review of the project at the close of the grant period
to include a review of adherence to budget, Action Plan and attainment of
objective/performance goals.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to accept a contract with the Texas Department of Transportation
(TxDOT) to continue to operate the Safe & Sober Selective Traffic Enforcement Program (STEP)
from October 1, 1999 through September 30, 2001, on an overtime basis in the amount of$449,664
(State $255,161/City $194,503); and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Special Trust Fund awarded assets by$194,503 from available funds; and
3. Authorize the transfer of $194,503 from the Special Trust Fund awarded assets to the Grants Fund
for the City's cash match; and
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund by $449,664 from available funds; and
5. Authorize the City Manager to waive the indirect cost in the amount of $76,762 since indirect costs
are not allowed by TxDOT.
DISCUSSION:
TxDOT has agreed to provide funds for the Safe & Sober STEP for the next two years.
Speeding continues to be a major contributor to traffic crashes resulting in injuries and fatalities, not
only on State highways, but on all types of roadways within cities and towns as well. Law enforcement
entities now have the opportunity to focus their enforcement efforts on those streets and roadways that
have a high number of speed-related crashes and/or experience high rates of noncompliance with the
posted speed limits. In addition, Department of Public Safety crash data also indicates that drunk
drivers are a major contributor to traffic crashes and fatalities in Texas. One of the best defenses
against a drunk or speeding driver is a properly worn safety belt. Working on an overtime basis,
officers will attempt to decrease total crashes on targeted STEP sites, reduce speeds in excess of the
posted speed limit, arrest intoxicated drivers, and increase safety belt and safety seat usage rates. All
equipment for this program will be provided from existing resources, and the State will reimburse the
City for overtime pay and mileage expenses.
The funding period for this program will begin October 1, 1999 (or when all signatures are obtained on
the contracts) and end September 30, 2001.

The total contract cost of the Safe & Sober STEP is $449,664. TxDOT will provide funds in the amount
of $255,161, and the City will provide $194,503. The terms of the State contract do not allow for
reimbursement of the 11.46% retirement fringe benefit for the overtime personnel base salaries, and
was not included in the contract total.
It is understood that funding for Fiscal Year 2001 is subject to available funds for that fiscal year, and
will not be appropriated until 2001.
For Fiscal Year 2000 (October 1, 1999-September 30, 2000) the budget is based on a 75/25% basis
as follows:

TxDOT does not provide for any form of indirect costs; therefore, it will be necessary to waive these
charges in the amount of $76,762 ($38,381 for each year) for the STEP. Indirect costs are calculated
by multiplying the sum of personnel and retirement by 19.06%.
