COUNTY OF TARRANT
INTERLOCAL AGREEMENT
This Agreement is made and entered into this //tx' day of
2000, by and between the County of Tarrant, acting herein by and through its governing
body, the Commissioners Court, hereinafter referred to as COUNTY, and the City of Fort
Worth, acting herein by and through Mike Groomer, its duly authorized Assistant City
Manager, hereinafter referred to as CITY, both of Tarrant County, State of Texas,
witnesseth:
WHEREAS, this Agreement is made under the authority of Sections 791.001-
791.029, Texas Government Code; and
WHEREAS, each governing body, in performing governmental functions or in
paying for the performance of governmental functions hereunder, shall make that
performance or those payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the subject of this Agreement is
necessary for the benefit of the public and each has the legal authority to perform and to
provide the governmental function or service which is the subject matter of this
Agreement; and
WHEREAS, each governing body finds that the performance of this Agreement is
in the common interest of both parties and that the division of costs fairly compensates
the performing party for the services or functions under this Agreement; and
WHEREAS, each governing body agrees to share in the cost of the services
described below.
NOW THEREFORE, the COUNTY and CITY agree as follows:
1.
The COUNTY agrees to provide the labor and equipment necessary to: (a)
overlay Trinity Blvd. from Loop 820 to Precinct Line Road for a distance of
approximately 8500 feet in length. The overlay will consist of 2" of Type D surface; (b)
reconstruction of Old Denton Road from Golden Triangle to Summerfield Blvd. for a

distance of approximately 17,000 linear feet. The work will include: 6" of base
stabilization and an application of 3"of Type D surface.
2.
The CITY agrees, at its sole option, to either deliver to COUNTY all of the
materials necessary and required for the reconstruction of the roads, as described in
paragraph 1 of this agreement, or to pay for the actual cost of the materials as incurred by
the COUNTY. The value of the materials for the overlay of Trinity Blvd. shall not
exceed $139,800. The value of the materials for the reconstruction of Old Denton Road
shall not exceed $235,200.
3.
The CITY also agrees to pay for the cost of providing traffic control estimated at
$3,000 for Trinity Blvd. and $14,000 for Old Denton Road. The CITY also agrees to the
closing of the road for through traffic for the duration of the project or as deemed
necessary by the COUNTY.
4.
The CITY agrees to provide the water necessary for these projects and to waive
the cost of the deposit for the hydrant meter.
5.
The CITY agrees if a Storm Water Pollution Prevention Plan is required, that the
CITY will be responsible for the design/development, implementation, and maintenance
of the plan and for the costs associated with doing so.
6.
The CITY agrees to notify the COUNTY within thirty days of the completion of
this project of any complaint the CITY has with the project.
7.
Nothing in the performance of this Agreement shall impose any liability for
claims against the COUNTY other than claims for which liability may be imposed by the
Texas Tort Claims Act.
8.
Nothing in the performance of this Agreement shall impose any liability for
claims against the CITY other than claims for which liability may be imposed by the
Texas Tort Claims Act.

9.
The parties to the Agreement do not intend for any third party to obtain a right by virtue
of this Agreement.
10.
By entering into this Agreement, the parties do not intend to create any
obligations express or implied other than those set out herein; further, this Agreement
shall not create any rights in any party not a signatory hereto.
11.
This Agreement shall terminate on completion of the subject matter of this
contract or on the conclusion of the COUNTY'S fiscal year, unless renewed for a period
of one year in written notice signed by both parties.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute an Interlocal Agreement
with Tarrant County for the overlay of Trinity Boulevard from Loop 820 to Precinct Line Road, and the
reconstruction of Old Denton Road from Golden Triangle to Summerfield Boulevard at a total cost to the
City not to exceed $392,000.
DISCUSSION:
At the request of City staff, Tarrant County has agreed to enter into an Interlocal Agreement to overlay
Trinity Boulevard from Loop 820 to Precinct Line Road, and to reconstruct Old Denton Road from
Golden Triangle to Summerfield Boulevard. Under this agreement, Tarrant County will provide all the
necessary labor and equipment to perform this work. The City agrees, at its sole option, either to
deliver to Tarrant County all of the materials required for the overlay and reconstruction of these roads,
or to pay for the actual cost of the materials as incurred by Tarrant County.
The value of the materials for the overlay of Trinity Boulevard shall not exceed $139,800. The value of
the materials for the reconstruction of Old Denton Road shall not exceed $235,200. The City also
agrees to pay for the cost of providing traffic control at an estimated cost of $17,000 for this Interlocal
Agreement; to close the road for through traffic for the duration of the project, or as deemed necessary
by Tarrant County; to provide the water necessary for these projects; and to prepare a Storm Water
Pollution Prevention Plan, if required.
This project is located in COUNCIL DISTRICT 4, Mapsco 66B and 21 L, 35L.
