AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE COMMUNITY TREE PLANTING PROGRAM FUND IN THE AMOUNT OF $430,462.43, FROM AVAILABLE FUNDS, A PORTION OF WHICH IS SUBJECT TO RECEIPT OF A MONETARY DONATION OF $5,000.00 FROM KEEP AMERICA BEAUTIFUL AND UNITED PARCEL SERVICE, INC., AND ANOTHER PORTION OF WHICH IS SUBJECT TO RECEIPT OF A GRANT OF $57,265.25 FROM THE META ALICE KEITH BRATTEN FOUNDATION, FOR THE PURPOSE OF FUNDING THE COMMUNITY TREE PLANTING PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: I I SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Community Tree Planting Program Fund in the amount of $430,462.43, from available funds, a portion of which is subject to receipt of a monetary donation of $5,000.00 from Keep America Beautiful and United I Parcel Service, Inc., and another portion of which is subject to receipt of a grant from the Meta Alice Keith Bratten Foundation, for the purpose of funding the Community Tree Planting Program. SECTION 2. I That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. i SECTION 4. Authorize the use of Tree Removal Fee revenue in the amount of$368,297.18 to fund the Community I! Tree Planting Program; 2. Accept a grant from the Meta Alice Keith Bratten Foundation in the amount of$57,265.25; 3. Accept a donation from Keep America Beautiful and United Parcel Service, Inc., in the amount of $5,000.00; and i 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Community Tree Planting Program fund by an amount of$430,562.43, from available funds, for a total budget of$463,592.00, which includes $33,029.57 of previously accepted and appropriated funds. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the use of Tree Removal Fee (Tree Fund) revenue to fund the Parks and Community Services Department's Community Tree j Planting Program (Program) and to accept grants and donations received to augment the Program for Fiscal Year (FY) 2015. In addition to these funding sources, previously received grant funds from FY 2014 in the amount of$33,029.57 are also included in the total budget amount of$463,592.00. This Program enables the planting of over 1,600 trees annually on public property in partnership with k neighborhood associations, schools, businesses and organizations. The Program also leverages over I 3,800 volunteer hours from Citizen Foresters, Castleberry High School students and other volunteers in the planting and maintenance of trees to support the City of Fort Worth's urban forestry program. Previously, the Program was funded by a combination of Tree Fund revenues, Parks Gas Royalties and a five year commitment from Chesapeake Energy Corporation, of which the fifth and final year was FY 2013. In FY 2014, the Program was solely funded through the Tree Fund for the first time. Tree Fund revenue is comprised of tree removal mitigation fees collected through the tree ordinance administered by the Planning and Development Department and from tree removals on City property administered by the Parks and Community Services Department. I I On March 4, 2014, (M&C G-18139) the Program received a grant from the Meta Alice Keith Bratten Foundation to fund the salary and benefits of a greenhouse attendant, temporary maintenance staff and various equipment and supplies as part of the FY 2014 Program. The purpose of the grant was to water an additional 200 to 300 trees annually on park property to help mitigate the increased tree loss which has occurred over the last several years as the result of the drought. This initiative helps support the sustainability of the urban forest in the City of Fort Worth. Because the grant was received mid-year and a greenhouse attendant was not on staff for the entire Fiscal Year, the resulting saving in grant funds of $33,029.57 from salary and water costs will be used in the FY 2015 Program. On January 28, 2015, the Parks and Community Services Advisory Board endorsed the acceptance of a second year of grant funding from the Meta Alice Keith Bratten Foundation in the amount of$57,265.25 for continued support of the Program. Funding received by this grant will continue to support the salary i and benefits of the greenhouse attendant, temporary maintenance staff and off-set water costs. Additionally on May 28, 2014, the Park Board also endorsed the acceptance of a $5,000.00 donation from Keep America Beautiful (KAB) and United Parcel Service (UPS) for the purchase of trees. Tree Fund revenue in the amount of$368,297.18 is needed to fund the Program for FY 2015. I Funding for the Program provides for seven authorized positions consisting of two foresters and a five- person nursery production/tree planting crew including the grant supported greenhouse attendant along with related supplies, materials and services. The foresters included in this Program also manage the Citizen Forester Program, other volunteer programs that train volunteers for tree planting, data collection and ongoing care and maintenance of the City's tree farm. The Community Tree Planting Program benefits ALL COUNCIL DISTRICTS. i FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Community Tree Planting Program.
