HomeMy WebLinkAboutOrdinance 21666-03-2015 I I ORDINANCE NO. 21666-03-2015 i AN ORDINANCE VACATING AND EXTINGUISHING TURTLE CREEK { COURT SITUATED IN THE ALLEN BEARD SURVEY, ABSTRACT NO. 127 AND THE EDWARD WILBURN SURVEY, ABSTRACT NO. 1635, AS SHOWN ON THE PLAT FOR RIDGEWOOD ADDITION, AN ADDITION I TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS j RECORDED IN VOLUME 288-122, PAGE 76 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY 33,671 SQUARE FEET ACRE OR 0.772 ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. ' f That a Turtle Creek Court, a 50 foot wide right-of-way, situated in of the Allen Beard Survey, Abstract No. 127 and the Edward Wilburn Survey, Abstract No. 1635, as shown on the I plat for Ridgewood Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 388-122, Page 76 of the Plat Records of Tarrant County, containing ; i approximately 33,671 square feet or 0.772 acre of land more or less, and as more specifically s described in Exhibit"A" attached hereto and incorporated herein by reference be and the same is E vacated and extinguished. i SECTION 2. i i That the easement to the land in the above-described vacated street right of way is hereby I released and shall revert to the adjacent owner as provided by law. Adopt the attached ordinance vacating Turtle Creek Court as requested by the Turtle Creek Court Homeowners Association to be replatted as a private street, to allow the street to be gated to provide better security; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy. i r DISCUSSION: Dunaway Associates, Inc., on behalf of Turtle Creek Court Homeowners Association, has requested the vacation of Turtle Creek to be replatted as a private street, to allow the street to be gated to provide better security for the 12 residents that live along this street. The City Plan Commission recommended approval of this request at its meeting on November 21, 2014. An acceptable final plat (FS-14-184) has been received in accordance with the Subdivision Ordinance. I The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley. The applicants will be responsible for the cost of the installation of the gates.
