HomeMy WebLinkAboutOrdinance 21665-03-2015 4 f i I ORDINANCE NO. 21665-03-2015 I j AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF WEST ANNIE STREET, SITUATED IN TUCKER'S ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN VOLUME 63, PAGE 124 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY 20,004 SQUARE FEET OR 0.459 ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN I CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, i TEXAS: i SECTION 1. I1 That a portion of West Annie Street, a 50 foot public right-of-way, situated in the Peter f T. Welch Survey, Abstract No. 1643, as shown on the plat for Tucker's Addition, an addition to the City of Fort Worth, Tarrant County, Texas; as recorded in Volume 63, Page 124 of the Plat Records of Tarrant County, Texas, and containing approximately 20,004 square feet or 0.459 i acre of land more or less, and as more specifically described in Exhibit "A" attached hereto and I incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. I� f i That the easements to the land in the above-described vacated street right of way is f i hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. 1i All existing utility easements be shall be retained by the City until such time all utilities k located in that easement are relocated at the owner's expense. Approved.on 3/3/2015 .=Ordinance N6'2166&--03- 0116" DATE: Tuesday, March 03, 2015 REFERENCE NO.: **PZ-3079 LOG NAME: 060065030 VA-14-035 SUBJECT: Adopt Ordinance Vacating a Portion of West Annie Street to be Replatted with the Adjoining Property Owned by Fort Worth VHP, LLC, for a New Medical Office Building and Parking Garage (COUNCIL DISTRICT 9) j RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance vacating a portion of West Annie Street, to be replatted with the adjoining property owned by Fort Worth VHP, LLC, for a new medical office building and parking garage; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy. DISCUSSION: Dunaway Associates, Inc., on behalf of Fort Worth VHP, LLC, has requested the vacation of this portion of West Annie Street to be replatted with the adjoining property, for a new medical office building and parking garage. The City Plan Commission recommended approval of this request at its meeting on October 22, 2014. An acceptable final plat (FS-014-199) has been received in accordance with the Subdivision !I Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley. i This project is located in COUNCIL DISTRICT 9, Mapsco 77E.
