AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
WEST ANNIE STREET, SITUATED IN TUCKER'S ADDITION, AN
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS; AS RECORDED IN VOLUME 63, PAGE 124 OF THE PLAT
RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING
APPROXIMATELY 20,004 SQUARE FEET OR 0.459 ACRE OF LAND
MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN I
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,

SECTION 1.

That a portion of West Annie Street, a 50 foot public right-of-way, situated in the Peter f
T. Welch Survey, Abstract No. 1643, as shown on the plat for Tucker's Addition, an addition to
the City of Fort Worth, Tarrant County, Texas; as recorded in Volume 63, Page 124 of the Plat
Records of Tarrant County, Texas, and containing approximately 20,004 square feet or 0.459

acre of land more or less, and as more specifically described in Exhibit "A" attached hereto and

incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2. I�

That the easements to the land in the above-described vacated street right of way is f

hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.

All existing utility easements be shall be retained by the City until such time all utilities

located in that easement are relocated at the owner's expense.

PROPERTY DESCRIPTION
BEING a tract of land situated in the Peter T. Welch Survey, Abstract No, 1643, in the City of Fort Worth,
Tarrant County, Texas, being a portion West Annie Street (a 50' width public right—of—way) as shown on the
plat for Tuckers Addition, an addition to the City of Fort Worth, according to the plat recorded in Volume i
63, Page 124, Plat Records, Tarrant County, Texas, said tract of land being more particularly described by
metes and bounds as follows;
BEGINNING at a 5/8" iron rod with yellow cap stamped "DUNAWAY ASSOC. LP" (hereinafter called 5/8" YCIRF) I
found in the south right—of—way line of said West Annie Street, the northeast corner of remainder of Block

13 of said Tuckers Addition and in the west right—of—way line of South Main Street (a variable width i
right—of—way);

THENCE South 89'26'57" West, departing the west right—of—way line of said South Main Street, with the
south right—of—way line of said West Annie Street and the north line of Block 13 of said Tuckers Addition, a
passing distance of,200.00 feet to a point for the northeast comer of Lot 1, Block 13, Tucker Addition, an
addition to the City of Fort Worth, according to the plat recorded In Volume 388-83, Page 18, Plat Records,
Tarrant County, Texas and continuing with the north line of said Lot 1, Block 13, Tucker Addition for a total
distance of 400.00 feet to a 1/2" iron -rod with yellow cap stamped "Brittain & Crawford" found in the east
right—of—way line of Galveston Avenue (a 50' width public right—of—way), and the northwest comer of said

THENCE North 00'44'52" West, departing the south right—of—way line of sold West Annie Street, a distance

Adopt Ordinance Vacating a Portion of West Annie Street to be Replatted with the Adjoining Property
Owned by Fort Worth VHP, LLC, for a New Medical Office Building and Parking Garage (COUNCIL
DISTRICT 9) j
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of West Annie Street, to be replatted with the adjoining
property owned by Fort Worth VHP, LLC, for a new medical office building and parking garage; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy.
DISCUSSION:
Dunaway Associates, Inc., on behalf of Fort Worth VHP, LLC, has requested the vacation of this portion of
West Annie Street to be replatted with the adjoining property, for a new medical office building and parking
garage. The City Plan Commission recommended approval of this request at its meeting on October 22,
2014. An acceptable final plat (FS-014-199) has been received in accordance with the Subdivision !I
Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City does not own any fee interest in the right-of-way or own any property adjacent to the
right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the streets and alley.
