AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF j
SOUTH MAIN STREET SITUATED IN THE PETER T. WELCH SURVEY,
ABSTRACT NO. 1643 IN THE CITY OF FORT WORTH, TARRANT
COUNTY, TEXAS; AS RECORDED IN VOLUME 63, PAGE 124 OF THE t
PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING
APPROXIMATELY 436 SQUARE FEET ACRE OR 0.010 ACRE OF LAND
MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING i
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES, IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.

TEXAS:
SECTION 1.

That a portion of South Main street, a variable width right-of-way, situated in the Peter T.

Welch Survey, Abstract No. 1643 of the City of Fort Worth, Tarrant County, Texas; as shown on

the plat for Tucker's Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as
recorded in Volume 63, Page 124 of the Plat Records of Tarrant County, Texas containing
i
approximately 436 square feet or 0.010 acre of land more or less, and as more specifically j
described in Exhibit "A" attached hereto and incorporated herein by reference be and the same is
vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby I

released and shall revert to the adjacent owner as provided by law. p

SECTION 3.

All existing utility easement be shall be retained by the City until such time all utilities

located in that easement are relocated at the owner's expense. j
SECTION 4. {

That all ordinances or parts of ordinances in conflict herewith are hereby repealed.

That this ordinance shall take effect upon adoption.

PROPERTY DESCRIPTION
I
BEING a tract of land situated in the Peter T. Welch Survey, Abstract'No, 1643, in the City of Fort Worth,
Tarrant County, Texas, being a portion South Main Street (a variable width public right—of—way) as shown on
the plat for Tucker's Addition, an addition to the City of Fort Worth, according to the plat recorded in
Volume 63, Page 124, Plat Records, Tarrant County, Texas, said tract of land being more particularly
described by metes and bounds as follows:
BEGINNING at an "X" cut in concrete found for the northeast corner of Lot 1A, Block 19—R, Tucker Addition,
an addition to the City of Fort Worth, according to the plat recorded in Volume 388-178, Page 80, Plat
Records, Tarrant County, Texas, in the east line of Lot 1, Block 19—R, Tucker Addition, an addition to the
City of Fort Worth, according to the plat recorded in Volume 388-83, Page 18, Plat Records, Tarrant County,
Texas, and in the west right—of—way line of said South Main Street;
THENCE North 00.33'03" West, with the east line of said Lot 1, Block 19—R, Tucker Addition, with the west
right—of—way line of said South Main Street, a distance of 225.00 feet to a 5/8" iron rod with yellow cap
stamped 'DUNAWAY ASSOC. LP" found In the south right—of—way line of Pennsylvania Avenue (a 80' width
Public Right—of—way), and the northeast corner of said Lot 1, Block 19—R, Tucker Addition;

THENCE North 89'26'57" East, departing the west right—of—way line of said South Main Street, a distance of
1.98 feet to a point;

Adopt Ordinance Vacating a Portion of South Main Street to be Replatted with the Adjoining Property
Owned by TSC South Main, LLC, to Provide for the Encroachment of a Historic Building into the Existing
Right-of-Way (COUNCIL DISTRICT 9)

RECOMMENDATION:
It is recommended that the City Council:
I
1. Adopt the attached ordinance vacating a portion of excess right-of-way for South Main Street, to be
replatted with the adjoining property owned by TSC South Main, LLC, to provide for the encroachment of a
historic building into the existing right-of-way; and
i
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy.

DISCUSSION:
Dunaway Associates, Inc., on behalf of TSC South Main, LLC, has requested the vacation of this portion
of excess right-of-way along South Main Street to be replatted with the adjoining property to prevent a
historic building from encroaching into the existing right-of-way. The City Plan Commission recommended
approval of this request at its meeting on September 24, 2014 finding there would not be an impact to the
traffic or pedestrian flow along South Main Street. An acceptable final plat (FS-14-173) has been received
in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City does not own any fee interest in the right-of-way or own any property adjacent to the
right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's Policy regarding street and alley vacation transactions approved by the City Council on i
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the streets and alley.
This project is located in COUNCIL DISTRICT 9, Mapsco 77E.

no material effect on City funds.
