HomeMy WebLinkAboutOrdinance 21658-03-2015 ORDINANCE NO. 21658-03-2015 AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF DAKOTA STREET, HARROLD STREET, WEST 6TH STREET AND WEST 5' STREET, SITUATED IN THE WILLIAM BUSSELL SURVEY, ABSTRACT NO. 151 OF THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN THE PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY RESPECTIVELY 17,610; 1,391; 29,781, 591 and 579 SQUARE FEET ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of the variable width right-of-way of Dakota Street, lying between the Fort Worth and Western Railroad ROW and Harrold Street, situated in the William Bussell Survey, Abstract No. 151 of the City of Fort Worth, Tarrant County, Texas; as dedicated by the Evans- Pearson Westwood Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 310, Page 18 and Volume 388-124, Page 11 of the Plat Records of Tarrant County, Texas, and containing approximately 0.404 acre or 17,610 square feet of land more or less, and as more specifically described in Exhibit "A" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That a portion of the variable width right-of-way of Harrold Street, formerly known as Second Street, situated in the William Bussell Survey, Abstract No. 151 of the City of Fort Worth, Tarrant County, Texas; as shown on the plat of K.M. Van Zandt's Addition, an addition Dakota,Harrold West 5`h and 6`h ROW Vacation(VA-14-025,029,031) Ordinance No.21658-03-2015 Pagel of 3 to the City of Fort Worth, Tarrant County, Texas, recorded in Volume 106, Page 103 of the Plat Records of Tarrant County, Texas, and containing approximately 0.032 acres or 1,391 square feet of land more or less, and as more specifically described in Exhibit `B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 3. That a portion of the sixty (60) foot right-of-way of West 6th, formerly known as Oakland Street, situated in the William Bussell Survey, Abstract No. 151 of the City of Fort Worth, Tarrant County, Texas, as shown on the plat of K.M. Van Zandt's Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 106, Page 103 of the Plat Records of Tarrant County, Texas, lying between the south Harrold Street and Stayton Street, and containing approximately 0.684 acre or 29,781 square feet of land more or less, and as more specifically described in Exhibit "C" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 4. That a portion of the variable width right-of-way of West 5th Street, situated in the William Bussell Survey, Abstract No. 151 of the City of Fort Worth, Tarrant County, Texas; as shown on the plat of Lot 1-R, Block 5-R of K.M. Van Zandt's Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 388-124, Page 7 of the Plat Records of Tarrant County, Texas, and the plat of Lot 1, Block 4-R of Evans-Pearson Westwood Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 388-124, Page 11 and containing approximately respectively 0.014 acres or 591 square feet and 0.013 acre or 579 square feet of land more or less, and as more specifically described in Exhibit Dakota,Harrold West 5'11 and 6`h ROW Vacation(VA-14-025,029,031) Ordinance No.21658-03-2015 Page 2 of 3 "D" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 5. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 6. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 7. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 8. That this ordinance shall take effect upon adoption. Adopt the attached ordinance vacating portions of Dakota Street, Harrold Street, West 5th Street and West 6th Street to be replatted with the adjoining property for the Left Bank mixed-use development in the West Seventh Urban Village for Centergy West 7th, LP; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy. DISCUSSION: Bury-DFW, Inc., on behalf of Centergy West 7th, LP, has requested the vacation of these portions of Dakota Street, Harrold Street, West 5th Street and West 6th Street to be replatted with the adjoining property for the Left Bank mixed-use development in the West Seventh Urban Village. The City Plan Commission recommended approval of this request at its meeting on October 22, 2014. Acceptable final plats (FS-014-205 and FS-14-207) have been received, in accordance with the Subdivision Ordinance. There are two Mayor and Council Communications (M&Cs) for the Left Bank development to follow the different plat boundaries in which the development phasing is occurring. The west side of Harrold Street is poised for redevelopment sooner than the area to the east of Harrold Street. Since the applicants are final, platting this property in phases and breaking up the vacations into separate M&Cs gives the applicants flexibility to final plat this property at different times without the need to incorporate all of the vacated rights-of-way at one time. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley. This project is located in COUNCIL DISTRICT 9, Mapsco 62X, 62Y, 76B and 76C.
