AN ORDINANCE VACATING AND EXTINGUISHING AN EXCESS
PORTION OF OLD UNIVERSITY DRIVE SITUATED IN THE ADAM
VOGT SURVEY, ABSTRACT NO. 1585 IN THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS; AS RECORDED IN THE PLAT RECORDS
OF TARRANT COUNTY, TEXAS AND CONTAINING
APPROXIMATELY 5,104 SQUARE FEET ACRE OR 0. 117 ACRE OF
LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN
SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL
EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That an excess portion of Old University Drive, a variable width right-of-way, situated in
the Adam Vogt Survey, Abstract No. 1585 of the City of Fort Worth, Tarrant County, Texas; as
shown on the plats for River Plaza Complex Addition, an addition to the City of Fort Worth,
Tarrant County, Texas, as recorded in Cabinet A, Slide 12815 and Cabinet A, Slide 2564 of the
Plat Records of Tarrant County, Texas containing approximately 5,104 square feet or 0.772 acre
of land more or less, and as more specifically described in Exhibits "A" and `B" attached hereto
and incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a tract of land situated in the Adam Vogt Survey,Abstract No.1585 and being part of Old University Drive
and being more particularly described as follows:
BEGINNING at a 5/8" iron rod with a "KHA" cap set in the southeasterly right-of-way line of Old University Drive
(varaible width ROW)for the northerly most northwest comer of Lot 3R, Block 1, River Plaza Complex, an addition
to the City of Fort Worth accorded In to the plat thereof recorded in Cabinet A, Slide 12815 of the Plat Records of
Tarrant County, Texas and the westerly most comer of Lot 3-A-4112, Block 1, River Plaza Complex an addition to
the City of Fort Worth accorded in to-the plat thereof recorded in Cabinet A, Slide 2564 of the Plat Records of
Tarrant County,Texas;
THENCE with said southeasterly right-of-way line,the following courses and distances to wit:
South 16'18'07"West,a distance of 16.50 feet to a 5/8"iron rod with a"KHA"cap set for comer;
South 14°43'07'West,a distance of 50.00 feet to a 5/8"iron rod with a"KHA"cap set for comer;

Adopt Ordinance Vacating a Portion of Excess Right-of-Way for Old University Drive to be Replatted with
the Adjoining Property Owned by Weston Graves to Provide Space for Additional Landscaping and a
Monument Sign (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of excess right-of-way for Old University Drive, to be
replatted with the adjoining property owned by Weston Graves, to provide space for additional
landscaping and a monument sign; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy.
DISCUSSION:
Kimley-Horn and Associates, Inc., on behalf of Weston Graves, has requested the vacation of this portion
of excess right-of-way along Old University Drive, to be replatted with the adjoining property, to provide
space for additional landscaping and a monument sign. The City Plan Commission recommended
approval of this request at its meeting on December 20, 2013. An acceptable final plat (FS-14-140) has
been received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City does not own any fee interest in the right-of-way or own any property adjacent to the
right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the streets and alley.
This project is located in COUNCIL DISTRICT 9, Mapsco 76N.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that approval of these recommendations will have
no material effect on City funds.
