HomeMy WebLinkAboutOrdinance 16769-01-2006Ordinance No 16769-01 2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $4 484 000 SUBJECT TO RECEIPT OF THE SECTION 115 DEMONSTRATION PROGRAM FUNDS FROM THE FEDERAL HIGHWAY ADMINISTRATION FOR THE PURPOSE OF FUNDING AGREEMENTS WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR PLANNING, DESIGN AND CONSTRUCTION IN THE FOLLOWING URBAN VILLAGE PROJECTS HEMPHILUBERRY SIX POINTS NEAR EAST SIDE, BERRY/RIVERSIDE, SOUTH MAIN RIDGLEA, BERRY STREET GUIDELINES BLUEBONNET CIRCLE, OAKLAND CORNERS POLYTECHNIC/WESLEYAN BERRY/STALCUP AND MERCADO) MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005- 2006 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $4 484 000 subject to receipt of the Section 115 Demonstration Program funds for the purpose of funding agreements with the Texas Department of Transportation for planning design and construction in the following urban village projects. Hemphill/Berry Six Points, Near East Side, Berry/Riverside South Main Ridglea, Berry Street Guidelines, Bluebonnet Circle, Oakland Corners; Polytechnic/Wesleyan, Berry/Stalcup and Mercado SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions; sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPRQVED AS TO FORM AND LEGALITY ~- `~~~- ssistant Cit Att ney ADOPTED AND EFFECTIVE. Allocate these federal transportation funds for planning design and construction in designated urban villages as specified in Attachment A, 3 Authorize the City Manager to execute funding agreements with the Texas Department of Transportation (TxDOT) for the specified urban village projects and to remit payment for applicable administrative fees 4 Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $4 484 000 00 and 5 Authorize the City Manager to nominate projects for the North Central Texas Council of Governments (NCTCOG) Sustainable Development Program as specified in Attachment B DISCUSSION In the FY 2004 and FY 2005 federal appropriations bills, the City of Fort Worth received earmarks totaling $4 484 000 00 ("Urban Village Funds") in transportation funds through the Federal Highway Administration s Section 115 Demonstration Program These funds are to be allocated for projects within designated urban villages In addition NCTCOG issued a call for projects on October 17 to public agencies in order to fund up to approximately $40 million in transportation improvements throughout the region ("Sustainable Development Funds") NCTCOG has set aside $12.6 million of these funds for the Western subregion which includes the City of Fort Worth for projects around transit stations for pedestrian-oriented infill projects in historic downtowns, and for infill projects in low-income high unemployment, and high vehicle emission areas On November 1 2005 the Central City Revitalization and Economic Development Committee (CCREDC) endorsed the release of a Request for Proposals (RFP) to allocate Urban Village Funds and to nominate projects for the NCTCOG Sustainable Development Funds. In accordance with the CCREDC endorsement, the City issued an RFP on November 2, 2005 Logname 22UV SD PROPOSA Page 1 of 2 On December 1 2005 the City received 31 proposals for urban village funding or sustainable development nomination An interdepartmental working group comprised of staff from Planning Transportation and Public Works, Economic and Community Development, Parks and Community Services, Engineering and the T reviewed, evaluated, and rated each of the proposals On December 23 2005 the City Plan Commission (CPC) reviewed the staff evaluations and recommended funding five urban villages for planning design and construction and funding another seven urban villages for planning only as specified in Attachment A. The CPC also recommended the nomination of seven projects for Sustainable Development funding as specified in Attachment B The City Council received a briefing on these recommendations on January 10 2006 Upon approval of this M&C staff will complete the following activities. Urban Village .Projects Work with community stakeholders to select consultants for planning and design. Work with TxDOT to execute appropriate funding agreements (Staff estimates that TxDOT's administrative fees for these funding agreements will represent approximately eight percent of project costs.) Request City Council authorization to execute planning and design contracts.
