HomeMy WebLinkAboutContract 26013 06-26-00A70 :57 RCVD CITY SECRETARY MEMORANDUM OF UNDERSTANDING CITY OF FORT WORTH PARKS AND COMMUNITY SERVICES DEPARTMENT The Parks and Community Services (P&CSD), a department of the City of Fort Worth and Mr. Peter S. Brown, a Contractor managing the municipal tennis facility known as the McLeland Tennis Center, both hereby pledge to work cooperatively in providing tennis facilities for practice to the students and coaches of the Fort Worth Independent School District (FWISD) who utilize the McLeland Tennis Center. We understand that in order to more effectively utilize our resources in offering quality facilities, we agree to the following: GENERAL GUIDELINES 1. The P&CSD McLeland Tennis Center may be utilized by all FWISD high school tennis teams free of charge during the traditional school year (September/May), for regular weekday practice. Each player will be required to sign in at the pro shop each time the facility is used. 2. The tennis facilities may be used on Monday through Friday excluding holidays and only when accompanied by a coach. Only outdoor courts may be utilized, unless other arrangements are made with the Contractor. However, indoor rental fees will not be paid without prior approval of the P&CSD Director and/or designee and the FWISD Athletic Director. 3. School tennis team members, tennis coaches or other FWISD representatives will be expected to observe and adhere to the rules of conduct, dress, and tennis play prescribed by the facility operator. 4. This agreement shall commence on the date of execution and continue thereafter, unless either party gives written notice of termination. CONTRACTOR/CITY RESPONSIBILITIES 1. Contractor will be responsible for recording all FWISD play and submit monthly totals and monthly invoice statement for FWISD play to the City for payment. 1 iJ! �f'G�rUY'U4� U�LS�GU1� 2. City will reimburse Contractor for all play utilized by the FWISD within thirty (30) days of receipt of invoice. 3. Contractor will assist the City and FWISD in managing students and staff under the regulations outlined herein. COACHES' RESPONSIBILITIES 1. Each coach will arrange an orientation meeting with the tennis staff before the players are scheduled to play at the beginning of each school year. 2. Coaches will schedule court times, as available, with the tennis staff. Coaches must register players in the pro shop every time they practice. 3. Coaches are required to be at the tennis facility with the players each day of practice. Coaches will remain at the facility until all players have departed. Teams will be classified as a group and the assigned coach will represent them and be held accountable for their conduct. 4. Coaches are required to submit a team list to the P&CSD and the Contractor at the McLeland Tennis Center at the beginning of the school year at 1600 West Seminary Drive, Fort Worth, Texas 76115. 5. Coaches will instruct players in tennis rules, play and policies of the City of Fort Worth. 6. Coaches assigned to work with tennis teams must be full time employees of the FWISD. Any exceptions to this requirement must be approved by the FWISD Athletic Director and the Parks and Community Services Director or designee. 7. Coaches will be allowed complimentary play only with the team during practice. TEAM REGULATIONS 1. Players will not be allowed to play before the assigned coach arrives at the tennis facility. Each player must register in the Pro Shop. 2. Players are expected to use the proper tennis etiquette and playing courtesies at all times. 3. Players are required to wear clothing that is appropriate to the game of tennis. Collard shirts are required for all players on municipal tenr irmurtra UTU 4. Only players who practice with the school team will be allowed to represent the school in FWISD tournament play. 5. Players must adhere to all rules and discipline policies outlined in the FWISD Code of Student Conduct. Thus, any coach or Contractor's staff (working with the FWISD Coach) assigned to the tennis facility may supervise and/or discipline any team member. 6. Violations on the part of any team member will result in the entire team being penalized and playing privileges canceled or restricted at the McLeland Tennis Center if conditions justify such action. TOURNAMENT PLAY 1. All organized inter-district tournament play will require a signed tournament contract with all applicable fees paid prior to an event. 2. All tournaments must be scheduled through the McLeland Tennis Center Contractor and are subject to availability of the tennis courts. 3. Free play applies only to weekday practice and play before 5:00 p.m. Weekend and evening events will require all applicable fees. 4. DISCUSSION: Over the past several years, the Parks and Community Services Department (PACSD) has developed a cooperative relationship with the Fort Worth Independent School District (FWISD) by providing golf and tennis facilities for practice and play by the students and coaches of the FWISD. In return, the FWISD provides bus service for the department's youth sports program. The PACSD provides opportunities for practice and play, free of charge, at the five municipal golf courses and outside courts at the McLeland Tennis Center on weekday afternoons. The FWISD Athletic Department provides each team member with a numbered student identification card that identifies the student as a golf/tennis team member, which is recorded each time the student utilizes one of these City facilities. The team coach must be present for the team to play, and is responsible for the conduct of the students while at the facility. The McLeland Tennis Center is operated under contract, and the contractor is reimbursed by the department for all FWISD play at the center. Historically, this amounts to approximately $6,000 which is, in part, paid from revenues returned to the City by the contractor. Use of the golf courses by FWISD amounts to approximately $20,000 in waivers each year. Given the amounts of anticipated waivers, in accordance with state law, approval by the City Council is required. The City benefits from the in-kind bus service for the department's youth sports program from the FWISD (estimated worth of $90,000 per year) and through publicity generated by students that play at our facilities. McLeland Tennis Center is located in COUNCIL DISTRICT 9. The golf courses are located in COUNCIL DISTRICTS 2, 3, 4 and 8.
