INTERLOCAL AGREEMENT BETWEEN THE CITY OF FORT WORTH AND THE
COUNTY OF TARRANT FOR THE CONSTRUCTION OF HERITAGE TRACE
PARKWAY FROM OLD DECATUR ROAD TO BUSINESS 287 AND RECONSTRUCT i

THE INTERSECTION WITH OLD DECATUR ROAD, LOCATED IN THE CITY OF I
FORT WORTH
This Agreement is entered into by and between the County of Tarrant, acting herein by I
and through its governing body, the Commissioners Court, hereinafter referred to as COUNTY,
!
and the City of Fort Worth, acting by and through Dale Fisseler, its duly authorized City
Manager, hereinafter referred to as CITY, both of Tarrant County, State of Texas, wifnesseth:
WHEREAS, this Agreement is made under the authority of Sections 791.001-791-029,
Texas Government Code; and
WHEREAS, each governing body, in performing governmental functions or in paying for
the performance of governmental functions hereunder, shall make that performance or those
payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the i
common interest of both parties, that the undertaking will benefit the public and that the division
of costs fairly compensates the performing party for the services or functions under this i
agreement; and
WHEREAS, each governing body agrees to share in the cost of the services described
below. 1
NOW THEREFORE, the COUNTY and CITY agree as follows:

COUNTY, at its sole cost and expense, agrees to furnish all labor and equipment

necessary for the construction of Heritage Trace Parkway from Old Decatur Road to Business
287 and reconstruct the intersection with Old Decatur Road, located in the in the City of Fort
Worth, hereinafter referred to as the Project.

CITY agrees to furnish all materials, including fencing, to construct Heritage Trace
Parkway from Old Decatur Road to Business 287 and reconstruct the intersection with Old t
Decatur road. CITY agrees, at its sole option, to either furnish all other necessary materials for
the Project, or pay for the same provided by COUNTY. However, CITY total contribution for
materials shall not exceed $40,000.00.

3.
CITY agrees to furnish all necessary rights of way within the City of Fort Worth.
COUNTY will furnish plan specifications and engineering drawings for the Project: �

COUNTY agrees to furnish all necessary flag persons for the Project.

Nothing in the performance of this Agreement shall impose any liability for claims against
COUNTY or CITY other than claims for which the Texas Tort Claims Act may impose liability.

Upon completion of the Project, CITY shall be responsible for maintenance of the Project
within the city limits.

The parties to this Agreement do not intend for any third party to obtain a right by virtue
of this Agreement. CITY agrees that COUNTY is relying upon CITY for notice to proceed with
this project, but COUNTY shall not be required to perform this Agreement within any time limit.

By entering into this Agreement, the parties do not intend to create any obligations
expressed or implied other than those set out herein; further, this Agreement shall not create
any rights in any party not a signatory hereto.

Nothing contained in this Agreement is intended by the parties to create a partnership or
joint venture between the parties and any implication to the contrary is hereby expressly
disavowed. It is understood and agreed that this Agreement does not create a joint enterprise, i
nor does it appoint any party as an agent of any other party, for any purpose whatsoever. i

This agreement becomes effective when signed by the last party whose signing makes
the agreement fully executed and remains in force and effect until the completion and
acceptance of the Project unless otherwise terminated.

Heritage Trace Parkway from Old Decatur Road to Business 287, Including Relocation of the
Current Intersection of Old Decatur Road with Business 287, with City Participation in the Amount
Not to Exceed $40,000.00

It is recommended that the City Council authorize the City Manager to execute an Interlocal Agreement with
Tarrant County for construction of a portion of Heritage Trace Parkway from Old Decatur Road to Business
287, including relocation of the current intersection of Old Decatur Road with Business 287, with City
participation in the amount not to exceed $40,000.00.

DISCUSSION:
The Fiscal Year 2007-2008 Contract Street Maintenance program includes funds for interlocal agreements.
Tarrant County is currently working with the Texas Department of Transportation (TxDOT) on three signal
installation projects along Business 287, north of the City of Saginaw. TxDOT's signal projects are expected
to let in September 2008 with actual construction following late this year. One of these locations is at the
intersection of Old Decatur Road and Business 287. The skewed nature of the current Old Decatur and
Business 287 intersection has contributed to several accidents including one fatality.As a result, TxDOT is
requiring relocation of this intersection prior to signal installation in order to provide a safer connection. The
location of the relocated intersection is at Business 287 and the future Heritage Trace Parkway as depicted
on the City of Fort Worth Master Thoroughfare Plan (MTP).

Since this location is within the City of Fort Worth and the project is being led by Tarrant County, an
Interlocal Agreement (ILA) is necessary for the construction of this realigned intersection. Under the ILA,
Tarrant County, at its sole cost and expense, agrees to furnish the labor and equipment necessary for the
construction of the portion of Heritage Trace Parkway from Old Decatur Road to Business 287, including
relocation of the current intersection of Old Decatur Road with Business 287, located in the City of Fort
Worth.
The City of Fort Worth agrees to furnish all necessary materials for the project, including fencing. However,
under the ILA the City of Fort Worth's total contribution for materials will not exceed $40,000.00, unless
amended. Upon completion, the City of Fort Worth shall be responsible for maintenance of the project i
within the City limits. f
This project is located in COUNCIL DISTRICT 7.
