HomeMy WebLinkAboutOrdinance 8911 Amended by Ordinance No. 15477 `- March 18, 2003 ORDINANCE NO. 9l / AN ORDINANCE PROVIDING FOR THE CREATION OF THE FORT WORTH COMMISSION ON THE STATUS OF WOMEN; PROVIDING FOR APPOINT- MENT AND QUALIFICATIONS OF MEMBERS; PROVIDING FOR PLACES AND TERMS OF APPOINTMENT FOR MEMBERS; PROVIDING A SEVERA- BILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . That there is hereby created the Fort Worth Commission on the Status_. of Women. SECTION 2 . The City Council shall appoint members to the Commission, which shall act in an advisory capacity to the City Council on matters of concern specifically referred to it for study by the City Council. The Committee shall be composed of nine (9) citizens, who shall be appointed to Places 1 through 9. The terms of members appointed to even numbered places shall expire October 1, 1984, and the terms of members appointed to odd numbered places shall expire October 1, 1985. Thereafter, members shall be appointed for two-year terms . No member shall serve more than three consecutive two-year terms. Members shall serve without compensation and shall be subject to removal by the City Council at any time. SECTION 3 . This ordinance shall repeal every prior ordinance and provi- sions of the Fort Worth City Code in conflict herewith but only insofar as any portion of such prior ordinance or provision shall be in conflict, and as to all other ordinances or provisions of the Fort Worth City Code not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. That this ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. Except where otherwise specifically provided by the Charter, the Mayor shall appoint the members of the Council committees, subject to the approval of the Council. Any committee so created shall cease to exist upon the accomplishment of the special purpose for which it was created or when abolished by a majority vote of the Council. Therefore, the City Attorney's office has ruled that no specific authority exists for the creation and operation of standing committees, which are established by the Mayor, with members appointed by the Mayor. In response to this situation, the Mayor's Committee on Aging voted to disband on 8/15/83. The City and the Area Agency on Aging are working out a non-finan- cial agreement on how the City is to receive input from the Area Agency on Aging on issues affecting the elderly. The Mayor's Committee mithe Status of Women, however, voted that their prefer- ence was for a requldi nine member commission to be established in the place of the present committee. We concur and propose that this new commission should act in an advisory capacity to the City Council on matters of concern which the City Council specifically re- fers to the commission for study and comment. Proposal It is proposed that the attached ordinance establishing Fort Worth Commission on the Status of Women be adopted. Legality This action is within the purview of the City Council and there are no known legal impediments.
