HomeMy WebLinkAboutOrdinance 16630-10-2005 Repealed by Ordinance No. 20039-01-2012 January 10, 2012 M&C G-14946 ORDINANCE NO 16 6 30'1 D AN ORDINANCE CREATING THE MAYOR S ADVISORY COMMISSION ON HOMELESSNESS ESTABLISHING GUIDELINES FOR APPOINTMENTS TO THE COMMISSION AND PROVIDING FOR THE COMMISSION'S DUTIES AND RESPONSIBILITIES PROVIDING THAT THIS ORDINANCE IS CUMULATIVE PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS homelessness is a serious problem in the City of Fort Worth and Tarrant County growing by forty percent since 2000• and WHEREAS, homelessness has many impacts on the community such as persons camping in public rights of way overflowing emergency shelters negative effects on Central City economic development, public health concerns and quality of life crimes that victimize homeless persons and neighborhoods alike and WHEREAS, homeless persons are the City's most vulnerable residents, subject to mental illness, substance abuse, chronic unemployment, and limited opportunities for improving their situations and WHEREAS, the U S Interagency Council on Homelessness and the U.S Department of Housing and Urban Development are encouraging local communities to develop Ten-Year Plans to Address Chronic Homelessness ("Ten Year Plan ') to use federal grants most effectively and such grants pay for approximately 60% of homeless services in the City and Tarrant County- and WHEREAS a dedicated group of concerned citizens was appointed to a Planning & Advisory Committee on Homelessness by Mayor Mike Moncrief in April 2004 to develop recommendations for addressing homelessness through a Ten Year Plan and WHEREAS, the Committee presented its Final Report to the City Council on February 22 2005 which included a recommendation that a standing Mayor's Advisory Commission on Repealed by Ordinance No. 20039-01-2012 January 10, 2012 Homelessness be appointed with broad representation from all stakeholders and appropriate City staff support; and WHEREAS on May 17 2005 Resolution Number 3203-05-2005 the City Council authorized the creation of a standing Mayor's Advisory Commission on Homelessness and directed that its membership include representatives from all stakeholder groups, including homeless service providers, neighborhood organizations, businesses, the faith community experts on mental health, substance abuse and public health, the affordable housing industry the criminal justice system, and Tarrant County government; and WHEREAS, the City Council directed the City Manager to ensure that the issue of homelessness be included in the City's Comprehensive Plan and Legislative Agenda, to request that all City departments assess their activities with regard to developing and implementing the 1.0-Year Plan, to request that each department evaluate the costs of implementing the Committee s recommendations for consideration in the upcoming City budget; and WHEREAS, it is advisable to adopt an ordinance creating the Mayor's Advisory Commission on Homelessness and establishing guidelines for appointments to the Commission and providing for the Commission s duties and responsibilities, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. There is hereby created, as authorized by Resolution Number 3203-05-2005 approved by the City Council of the City of Fort Worth on May 17 2005 the Mayor's Advisory Commission on Homelessness 2 Repealed by Ordinance No. 20039-01-2012 January 10, 2012 SECTION 2. The purpose of the Commission shall be to provide recommendations to the City regarding policies, plans and methods for addressing homelessness, including, but not limited to the following- (1) Develop a Ten-Year Plan to End Chronic Homelessness for presentation to City Council in March 2006 and. (2) Methods to enhance the effectiveness and accountability for outcomes of service delivery for homeless persons including possible centralization of such services, and (3) Public safety for homeless persons and the neighborhoods where they reside and (4) Housing for homeless persons and (5) State and Federal legislative issues that affect local homelessness SECTION 3. The Commission shall consist of 19 members appointed by the Mayor and approved by the City Council. Commission members shall serve two-year terms except as provided below Appointments shall be as follows Places 1 3 5 7 9 11 13 15 17 and 19 Terms expire each October first in odd numbered years The first term of such members shall expire on October 1 2007 Places 2, 4 6 8 10 12, 14 16 and 18 Terms expire each October first in even-number years The first term of such members shall expire on October 1 2006 The composition of the Commission shall include representation from the following stakeholder groups business (at least 3 members) neighborhoods (at least 3 members) homeless service providers (at least 3 members) the housing industry the faith community representation with expertise in mental health and substance abuse issues representation with expertise in criminal justice, at least one homeless or formerly homeless person, and regional representation from Arlington and Tarrant County SECTION 4. The Commission shall meet monthly and no fewer than ten (10) times per calendar year 3 Repealed by Ordinance No. 20039-01-2012 January 10, 2012 SECTION 5 A quorum of the Commission shall consist of a majority of the members, excluding any vacancies The presence of a quorum of the Commission shall be required prior to a meeting being called to order Approval of all items before the Commission shall require a majority vote of those in attendance SECTION 6. The commission shall establish procedures, as necessary and appropriate, for the conduct of its business and for receiving of public comment on homelessness issues SECTION 7 The Commission shall report annually to the City Council on the nature and extent of homelessness in Fort Worth, and the impact of homelessness on city services The Commission shall include in its annual report the status of projects and goals established by the Commission and by City Council. SECTION 8. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986) as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 9 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences clauses and phrases of this ordinance are severable and, if any phrase, clause, sentence paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not 4 Repealed by Ordinance No. 20039-01-2012 January 10, 2012 affect any of the remaining phrases clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause sentence paragraph or section. SECTION 10. This ordinance shall take effect upon adoption. The motion carried unanimously nine(9) ayes to zero (0) nays. I Council Member Haskin asked that one of the first agenda items of this commission be to address issues with MedStar services. Ralph McCloud Mr Ralph McCloud, Chair of the Mayor's Advisory Commission on Homelessness, expressed appreciation to the Council for their confidence in the newly formed commission. He stated the commission was comprised of a wonderful collection of compassionate members. He assured the Council that the commission would work diligently to resolve the homeless issue in Fort Worth. G-14947 There was presented Mayor and Council Communication No G-14947 from Amend NEZ Tax the City Manager recommending that the City Council adopt amendments to Abatement Policy the Neighborhood Empowerment Zone (NEZ) Tax Abatement Policy and Basic and Basic Incentives, adopt amendments to the NEZ Administrative Procedures, adopt Incentives, amendments to the NEZ Policy Statement; and authorize the City Manager to Administrative implement NEZ policy amendments. Council Member Davis made a motion, Procedures and seconded by Council Member Wheatfall, that the recommendation be adopted. G-14948 There was presented Mayor and Council Communication No G 14948 from Initiate Rezoning the City Manager recommending that the City Council authorize the City of Properties in Manager to initiate rezoning of certain properties within and adjacent to the South Lake Worth South Lake Worth neighborhood in accordance with the 2005 Comprehensive Neighborhood Plan. Council Member Burdette made a motion, seconded by Council Member Davis, that the recommendation be adopted. The motion carried unanimously nine(9) ayes to zero (0) nays. Approve appointments to the Commission as provided on the attached listing of nominations. DISCUSSION Homelessness in Fort Worth and Tarrant County has tripled since 1995 To obtain input and recommendations on this issue the Mayor appointed a citizen advisory group in May 2004 which was made up of 47 broad-based stakeholder representatives from business, neighborhood social service faith community and governmental entities This group met from May 2004 to January 2005 and presented a series of recommendations to the Council in May including the following The City should take a leadership role in addressing homelessness A standing Mayor's Advisory Commission on Homelessness should be appointed with broad representation from all stakeholders and appropriate City staff support. The issue of homelessness should be included in the City's Comprehensive Plan and in the City's legislative agenda for federal state and local lobbying efforts and additional resources should be dedicated to address homelessness including City tax dollars A centralized one-stop resource facility for the homeless should be established The City should simultaneously address multiple issues to ensure cohesion by stakeholders and focus on long-term cost-effective solutions including scattered site affordable and service-enriched housing increased public safety resources in homeless-impacted areas and improved accountability for achievement of outcomes across the homeless service system On receiving the Mayor's Committee final report in May 2005 City Council approved a resolution to create a permanent Mayor's Advisory Commission on Homelessness An ordinance creating the Commission and appointments to the Commission are attached The Advisory Commission on Homelessness will help the City better coordinate and plan how best to respond to the growing number of homeless residents. The role of the Commission will be to prepare a Ten-Year Plan to End Chronic Homelessness for presentation to Council in March 2006 and to report annually to the City Council on progress in achieving the milestones established by the Ten-Year Plan The Commission will also make such additional recommendations as are necessary to further the goal of reducing and ending homelessness in our community The Commission will coordinate its efforts with Logname 05HOMELESSORD Page 1 of 2 Tarrant County Arlington Repealed withythe ederalgoover nment agencies na 1710 de grants which fund 60% of all local homeless services Nominations for appointment to the permanent Advisory Commission were sought from members of the initial Mayor's Committee and from neighborhood and business leaders The Mayor's Committee strongly urged that this newly formed commission include a balance of representation from neighborhoods business and homeless service providers as well as persons with expertise on mental health housing and other key issues relevant to homelessness The attached list of recommended appointments accomplishes that goal City staff support for the Commission will be provided by a Homeless Coordinator and administrative support position located in the Housing Department. The City Council approved funding for these positions in the 2005-2006 City Budget.
