HomeMy WebLinkAboutResolution 4423-03-2015 i A Resolution NO. 4423-03-2015 A RESOLUTION INCREASING THE AMOUNT TO BE PAID TO i JACKSON WALKER, L.L.P., TO ASSIST THE CITY IN CERTAIN EMPLOYMENT TAX, LABOR AND EMPLOYMENT LAW, AND TAX ISSUES RELATED TO THE EMPLOYEES RETIREMENT FUND i WHEREAS, there are various legal matters concerning employment tax, labor and f employment law, and tax issues related to the Employees' Retirement Fund; and WHEREAS, because of the extraordinary importance of those legal issues, the law I firm of Jackson Walker, L.L.P. has been hired as outside counsel to provide legal assistance to the City for a fee not to exceed $20,000.00; and WHEREAS, the cost of legal services provided by the law firm of Jackson Walker ! is currently $18,413.25, and it is estimated that an additional amount of approximately $15,000 beyond the authorized cost of $20,000.00 will be needed due to the ongoing nature of the issues involving employment tax, labor and employment law, and tax issues involving the Employees Retirement Fund. DISCUSSION: There are legal issues concerning tax laws related to labor and employment and pension issues which i Staff needs direction from a tax attorney with expertise in these areas. On March 2, 2010, City Council approved a resolution authorizing the City Manager to retain James Griffin ,i of the law firm of Jackson Walker, L.L.P., as outside counsel to provide legal assistance to the City on the 7 above named issues. The resolution authorized an amount not to exceed $5,000.00 to be paid to Jackson Walker, L.L.P. for the legal services provided by Mr. Griffin. On December 14, 2010, City Council i approved a resolution increasing by$15,000.00 the amount to be paid to James Griffin of the law firm of I Jackson Walker, L.L.P. i Because of the ongoing nature of the tax issues related to involving labor, employment law and pension issues, it is recommended that the City Council increase the maximum amount to be paid to Jackson Walker, L.L.P., to an amount not to exceed $35,000.00. FISCAL INFORMATION /CERTIFICATION: The Fiscal Year 2015 budget included appropriations in the amount of$100,000.00 in the General Fund i for outside legal counsel. As of February 17, 2015, $789.00 had been expended. Upon approval of this recommendation, the Financial Management Services Director certifies that funds are available within the existing appropriation for this expense.
