ORDINANCE NO. 21692-03-2015

AN ORDINANCE DECLARING ELECTED TO OFFICE THE
UNOPPOSED CANDIDATES FOR THE OFFICE OF MAYOR AND FOR
THE OFFICE OF CITY COUNCIL MEMBER FOR CITY COUNCIL
DISTRICT NOS. 3, 6, AND 9; PROVIDING THAT THE ELECTIONS j
ORDERED FOR MAY 9, 2015, FOR SAID OFFICES SHALL NOT BE
HELD; PROVIDING FOR THE POSTING OF COPIES OF THIS
ORDINANCE; PROVIDING FOR THE ISSUANCE OF CERTIFICATES
OF ELECTION; PROVIDING A SEVERABILITY CLAUSE; AND I
PROVIDING FOR AN EFFECTIVE DATE. I
WHEREAS, on February 10, 2015, the Fort Worth City Council adopted City Ordinance

No. 21638-02-2015, calling for and ordering an election to be held on May 9, 2015 for the P
purpose of electing a Mayor at large and eight (8) City Council Members; and f
WHEREAS, the deadline of February 27, 2015 for filing an application for a place on
the ballot for the May 9, 2015 elections has expired; and
WHEREAS, the deadline of February 27, 2015 for filing a declaration of write-in
I
candidacy for said elections has expired and no person filed a declaration of write-in candidacy;
,
and
I
WHEREAS, the deadline of March 4, 2015 for filing a certificate of withdrawal from
f
candidacy has expired; and
I
WHEREAS, pursuant to Section 2.052 of the Texas Election Code, the City Council has
i
received from the City Secretary a "Certification of Unopposed Candidacy" (attached) certifying
i
that following the expiration of said deadlines, only one (1) person is a candidate for the offices I
of Mayor and Council Member for District Nos. 3, 6, and 9.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
i
CITY OF FORT WORTH, TEXAS, THAT:
SECTION 1.

Pursuant to Sections 2.051 and 2.053 of the Texas Election Code:
a. Betsy Price, being an unopposed candidate for election to the office of Mayor,
is hereby declared elected to that office;

b. W.B. "Zim" Zimmerman, being an unopposed candidate for election to the
office of City Council Member for District No. 3, is hereby declared elected to
that office;
c. Jungus Jordan, being an unopposed candidate for election to the office of City
Council Member for District No. 6, is hereby declared elected to that office;

d. Ann Zadeh, being an unopposed candidate for election to the office of City ;
Council Member for District No. 9, is hereby declared elected to that office.

SECTION 2.
The elections ordered for May 9, 2015 for the office of Mayor and for the offices of City
i
Council Member for City Council District Nos. 3, 6, and 9 shall not be held.

SECTION 3.

A copy of this ordinance shall be posted on May 9, 2015, Election Day, at each of the
polling places which would have been used in the elections for the offices of Mayor and City i

Council Member for City Council District Nos. 3, 6 and 9.

SECTION 4.

Pursuant to Section 2.053 of the Texas Election Code, certificates of election shall be issued
I
to Betsy Price, W.B. "Zim" Zimmerman, Jungus Jordan and Ann Zadeh in the same manner and
at the same time as provided for a candidate elected at the election.

SECTION 5.

It is hereby declared to be the intent of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and if any section, paragraph,
sentence, clause, or phrase of this ordinance shall be declared void, ineffective or
i
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such

voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining sections, e
paragraphs, sentences, clauses, or phrases of this ordinance, since the same would have been
enacted by the City Council without the incorporation herein of any such void, ineffective or
unconstitutional section, paragraph, sentence, clause, or phrase.

SECTION 6.

This ordinance shall take effect and be in full force and effect from and after the date of '
I
its passage, and it is so ordained. i
PASSED AND ADOPTED this 17th day of March, 2015, at a regularly scheduled
meeting of the City Council of the City of Fort Worth, Texas.
