AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS l
IN THE GENERAL CAPITAL FUND IN THE AMOUNT OF $124,312.50, FROM
AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING A PURCHASE WITH INSITE
AMENITIES, L.P., TO REPLACE AND INSTALL THE ENVIRONMENT CONTROL l
SYSTEM OF THE BOTANIC GARDEN; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:

SECTION 1. j
That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
General Capital Fund in the amount of $124,312.50, from available funds, for the purpose of funding a
Purchase with InSite Amenities, L.P., to replace and install the Environment Control System of the Botanic
Garden.
SECTION 2. j
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.

SECTION 3. i
That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in c
i direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of pip
said prior ordinances and appropriations are hereby expressly repealed. I

for the Amount of$99,450.00, Transfer of Funds from Special Trust Fund to the General Capital Fund and
Adopt Appropriation Ordinances (COUNCIL DISTRICT 7)

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the I
Special Trust Fund in the amount of$246,973.25 from available funds.
2. Authorize a transfer in the amount of$124,312.50 from the Special Trust Fund to the General Capital
Fund.

3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
General Capital Fund in the amount of$124,312.50; and
4. Authorize a purchase with InSite Amenities, L.P. to update the Environmental Control System of the
Fort Worth Botanic Garden, using BuyBoard Contract No. 423-13 for the Parks and Community Services
Department for an amount of$99,450.00.
DISCUSSION: i
The Parks and Community Services Department will utilize this Purchase to replace the existing
environmental system and install a new system used to maintain appropriate temperatures and humidity in a
the conservatory located at the Fort Worth Botanic Garden (Botanic Garden). The existing system is the
original one that was installed when the 10,000 square foot conservatory was built in 1986. Therefore, it is
beyond its useful life and not functioning as intended.
The Parks and Community Services Department maintains a Special Trust Fund comprised of revenue
that has accumulated from the parking lease of a portion of the southwest section of the Botanic Garden
with Mid-Western Development & Realty Ltd. (M&C C-13746, City Secretary Contract
(CSC) No. 19597; Amended agreement M&C C-19909, CSC No 31541). The lease terminated on
February 28, 2013. In accordance with the lease authorization (M&C C-19909), lease revenues were
placed in a trust fund for future development of the Botanic Garden.
That Fund currently contains $246,973.25 which will be appropriated as a result of this Mayor and Council
Communication. Of this, $124,312.50 is being transferred to the General Capital Service Fund to cover

this $99,450.00 project and to defray prior Botanic Garden project overruns of$4,998.81. The remainder
of the Trust will be used for future capital projects.
PRICE ANALYSIS - This project, along with detailed specifications, was compared to other similar
projects and it was determined by the department that this vendor provided the best value to the City.

COOPERATIVE PURCHASE -The Purchasing Division will use Texas Association of School Boards
(TASB) Buy Board Contract No. 423-13 to acquire the parts and labor to complete this project. State Law
provides that a local government purchasing an item under a Cooperative Purchasing Agreement satisfies i
state law requiring that the local government seek competitive bids for purchase of the item. TASB
contracts have been competitively bid to increase and simplify the purchasing power of government
entities across the State of Texas.

M/WBE OFFICE -A waiver of the goal for MBE/SBE subcontracting requirements was requested by the
Purchasing Division and approved by the M/WBE Office, in accordance with the BDE Ordinance, because
the purchase of goods and services is from sources where subcontracting or supplier opportunities are i
negligible.
ADMINISTRATIVE INCREASE -An administrative increase or change order for this Agreement may be
made by the City Manager or his designee for an amount up to $24,862.50 and does not require specific
City Council approval as long as sufficient funds have been appropriated.
FISCAL INFORMATION /CERTIFICATION:

The Financial Management Services Director certifies that upon approval of the above recommendations,
adoption of the attached appropriation ordinances and completion of the transfer, funds will be available in i
the current capital budget, as appropriated, of the General Capital Project Fund. The Botanic Garden has
existing appropriations equal to $867,455.36 with a deficit remaining balance of$4,998.81. Upon
completion of the recommended actions, the appropriations will increase to $1,114,428.61 with a
remaining balance of$117,661.94.
