WHEREAS, the City of Fort Worth (CITY) and Teague Nall and Perkins,
Inc. , (ENGINEER) made and entered into City Secretary Contract No. 35525,
(the CONTRACT) which was authorized by M&C C-22177 on the 12th day of
June, 2007 in the amount of $ 361, 072 . 00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $76, 510 . 00 which was authorized by M&C # C-22809 on
May 20, 2008, Amendment Number 2 in the amount of $385, 654 . 00 which was
authorized by M&C # C-25347 on December 13, 2011; and
WHEREAS, the CONTRACT involves engineering services for the
following project :
Lebow Channel Roadway Crossing Replacement at Brennan Street, 28th
Street and Dewey Avenue (Project No. 00778) ; and
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated November 14, 2014, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $150, 908. 00. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under

Dear Mr. Shaffer:
Teague Nall and Perkins, Inc. is submitting this fee Amendment for the above referenced contract
based on additional services requested. The City has requested that TNP design the Brennan Ave.
crossing of Lebow Channel for ultimate conditions requiring 900 linear feet of additional channel
design. The following is a brief description and cost for the additional services to be provided on this
project:
I. Ultimate Channel Grading Design at Brennan Ave.
The scope of services necessary to accomplish the ultimate channel grading design at
Brennan Ave. is addressed below. Level of Effort shown on the table attached to this
Amendment Proposal is based on and limited to three submittals (60%,90%,100%) with one
set of City comments at 60% and 90%.
A. Design The following additional effort will be required:
1. 900 LF of additional channel plan, profile, and cross section design —two alternative
grading plans (maximum).
2. Design of gabion drop structure at upstream end.
3. Retaining wall design (up to 3 locations) to maintain 4:1 channel side slope.
4. Tree well design to preserve existing trees (up to 4 locations assumed).
5. Additional erosion control design due to extension of channel grading.
6. Design of widened driveway at Parks Dept. facility.
B. Survey
1. An additional approximately 5.2 acres of topographic and design survey will be
required to design the additional downstream grading, including the following:
i. Tie new 10' hike and bike trail constructed since the previous s urvey;
ii. Survey previously inaccessible private property north of Brennan Ave;
iii. Eight (8) channel cross sections for design level channel modeling;
iv. Topo required to design the widening of the Parks Dept. driveway; and
v. Tree survey and cataloging for trees 6-inches and larger within the
expanded project limits outside Lebow Channel existing top of banks and
trees 27-inches and larger anywhere within the expanded project limits.
C. Permitting/Coordination
The additional channel design will require additional time and effort in obtaining the

following permits:
1. Floodplain Development Permit
2. Urban Forestry Permit and Phase 1/Phase 2 Exhibits
3. Grading Permit
D. Park Conversion Application
A Park Conversion Application will be required due to the additional downstream grading
that will be located on existing PACS property. The following items will be required to
prepare, submit, and obtain the Park Conversion Application.
1. Prepare Park Conversion Application Documents after approval of Preliminary(60%)
design by Stormwater Group and direction by them to proceed with Application
process.
2. Meet with PACSD staff on-site to discuss proposed alignment—one meeting only.
3. Prepare a preliminary aerial plan and plat that includes all requirements listed in the
Park Conversion Application Instructions received from PACS staff on March 25,2014
—one submittal only.
4. Staking on park property identifying channel alignment, easement area, tree save
area(s), temporary work space, access routes, and staging area(s)—one time only.
5. Meet with PACSD staff on-site to inspect and receive approval of proposed layout—
one meeting only.
6. Prepare and subm it final aerial plan and plat—one subm ittal only.
7. Attend one (1) PACS Advisory Board meeting.
8. Provide support during the 30-day advertisement period for the park conversion City
Council Meeting.
9. Attend one (1) City Council Meeting.
Due to the multiple approvals required for the Park Conversion Application and high
probability of multiple iterations being required for the items listed above, the Park
Conversion Application task shall be setup as a special services item.Written authorization
from the City will be required to charge to the Special Services task.An estimated budget
has been established and included in this Amendment although the actual effort required is
unknown. This task will, therefore, be invoiced and paid as an hourly reimbursable item at
TNP's standard hourly rates. The budgeted amount will not be exceeded without City
approval and authorization.
E. LOMR
1. Additional mapping, modeling,and survey required for the LOMR due to the extension
of the downstream channel grading at Brennan Avenue.
F. Bid Phase/Construction Phase Services
1. An increase in effort will be required in both the bid and construction phases due to
the expanded scope of the project. A level of effort spreadsheet is attached to this
amendment giving a breakdown in additional effort.
2. Time has been added for a structural engineer to assist with any question,
clarification, or revision regarding the retaining walls and gabion drop structure
included in this amendment.
3. Time has been added for a landscape architect to assist with any question,
clarification or revision regarding the landscape and irrigation plans that are included
in this amendment.

II. Landscape and Irrigation Construction Plans
The City requests that TNP design landscape and irrigation components for the Brennan Ave.
crossing. The scope of services necessary to accomplish this change is addressed below. Fee
assumes tree mitigation will be performed on-site.
G. Design The following additional effort will be required:
1. Project Management — Submittal Review Meetings (up to 4 meetings), and
Coordination Meetings (up to 4 meetings).
2. Landscape Design —design of tree/landscaping improvements to help mitigate loss of
existing trees due to proposed channel grading.
3. Irrigation Design — design of a permanent irrigation system for proposed
tree/landscaping mitigation areas.
4. Create landscape and irrigation details and technical specifications.
III. Credits
H. Credits A credit will be applied to Amendment 3 for work that is currently included in the
Contract that has not and will not be performed per the City's direction and that the City will
release TN P from any obligation from performing.
1. Survey — originally $36,000 was allocated in the survey work phase of the original
00778 contract for anticipated easement and property acquisition along Lebow
Channel at a rate of$1,000 per property. Currently$18,835.00 remains in the Survey
work phase originally intended for this purpose. The City has instructed TNP that this
work will not be performed and to apply a credit to this Amendment in return for
releasing TNP from any obligation to perform this work in the future.
2. LOMR—originally $20,600 was allocated to the LOMR's at the Dewey and Brennan
crossings, $10,300 for each crossing. The LOMR for Dewey will be included in the
proposed overall channel LOMR that will be included in City Project No. 00084. As
part of this amendment$10,300, funds originally intended for the Dewey crossing,will
be credited back as part of this Amendment.
Fee Proposal for Contract Amendment No. 3: $ 150,908.00
TNP proposes an additional fixed fee of$150,908.00 to accomplish the scope of services described
above. This fee shall be full compensation for work required of TNP and three sub-consultants.

(Additional survey south of Brennan Avenue)
Dear Mr. Luce:
Gorrondona & Associates, Inc. (G&AI) is pleased to submit this proposal for
professional land surveying services for the above referenced project. The
following itemized surveying services are to be provided by Gorrondona & Assoc.
Inc..
I. DESIGN SURVEY
1.) Extend existing horizontal and vertical control for the project. Temporary
benchmarks shall be set for construction.
2.) Tie all improvements X, Y & Z (water valves, water vaults, storm drains,
manholes, driveways, curbs, sidewalks, all trees 6" and larger outside top
of bank of channel, trees 27° and larger between the top bank of channel,
signs, buildings, power poles, etc.) within the define project limits, as
shown on an map provided by engineer. Provide flowline elevations of all
sanitary sewer, storm drainage inlets and manholes within the project
limits. Cross-sections and spot elevations shall be taken to ensure the
defined project area will produce 1-foot contours. Eight (8) channel cross-
sections shall be taken as defined in engineers map.
3.) Prepare a final design/topographic drawing in an AutoCAD 2013 file
format showing all features located in the field, property lines & right-of-
way lines, ownership information, one-foot interval contours and a land
XML file. Deliverables shall also include a copy of the field notes, an ASCII
coordinate file of all points located in the field and a hard copy of the
coordinates.

II. PARK CONVERSION PLAT EXHIBIT
1.) Prepare a metes and bounds description with exhibit on letter size for up
to one (1) proposed Park Conversion document showing existing
easements, construction staging areas, and tree save areas, to the City of
Fort Worth's standards. The Park Conversion document will be on a per
document basis for a fee of$7,500.00.
III. CHANNEL STAKING
1.) Provide construction staking for the proposed channel, tree save areas
and construction staging areas. The construction staking will be for a lump
sum fee of$8,700.00.
Gorrondona & Associates, Inc. can provide the above professional land
surveying services for an hourly not exceed fee of $19,750.00 for item I, a lump
sum fee of $7,500.00 for item II, and a lump sum fee of $8,700.00 for item III.

Authorize Execution of Amendment No. 3 to City Secretary Contract No. 35525, an Engineering Agreement
with Teague Nall and Perkins, Inc., in the Amount of$150,908.00 for Additional Engineering Services for
the Lebow Channel Roadway Crossing Replacement at Brennan Avenue, NE 28th Street and Dewey
Street Project, Thereby Revising the Total Contract Amount to $974,144.00 (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 3 to City Secretary
Contract No. 35525, an Engineering Agreement with Teague Nall and Perkins, Inc., in the Amount of
$150,908.00 for additional engineering services for the Lebow Channel Roadway Crossing Replacement
at Brennan Avenue, NE 28th Street and Dewey Street project, thereby revising the total contract amount
to $974,144.00.
DISCUSSION:
The Amendment recommended by this Mayor and Council Communication (M&C) is for engineering
services for additional design of approximately 900 linear feet of channel improvements downstream of
the current project limits for the Brennan Avenue bridge and for a Parks and Community Services park
conversion related to these improvements. The original plan was to defer channel improvements
downstream of the bridge to a future phase of the overall Lebow Channel improvement program. During
design, however, it was determined that the channel improvements would be best accomplished as a part
of the bridge project so it is necessary to amend the current Design Agreement to include the additional
construction scope.
The Lebow Channel program is a large, multi-phase program that will address flood risk to over 280
homes/structures and 17 roads. Due to the size and cost of the overall program (approximately $30
million), the program was developed to be designed and constructed in phases over multiple decades.
Teague Nall and Perkins, Inc. (TNP), was selected to design the project based on a Request for
Qualifications (RFQ) process. The City Council originally authorized the City Manager to execute an
Agreement with TNP (M&C C-22177) for the design of three major roadway crossings (bridges) as one
combined design and construction package. Due to the requirements associate with two federal grants
and associated state funding (totaling $1,983,543.71) received for this project, the Design Agreement was
amended to separate the bridges into three separate construction packages.
TNP proposes to perform the engineering services described for a lump sum fee of$150,908.00. Staff
considers the fee to be fair and reasonable for the scope of services proposed.

M/WBE Office - Teague Nall and Perkins, Inc., is in compliance with the City's M/WBE Ordinance by
committing to an additional 28 percent M/WBE participation for this Amendment No. 3. The City's goal on
this amendment is 10 percent.
Funding for this amendment is being provided from Stormwater Capital Projects Bond Fund.
This project is located in COUNCIL DISTRICT 2, Mapsco 62H.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Stormwater Capital Projects Bond Fund. Project Fund Appropration to
date is $2,016,303.12 and Remaining Available Balance to date is $179,787.13. Upon execution of
Amendment No. 3, remaining funds in the Lebow Channel Roadway Crossing Project will be $28,879.13.
