HomeMy WebLinkAboutOrdinance 16926-05-2006ORDINANCE NO 16926-OS-2006 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NUMBER 13896, CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH (1986), TO AMEND SECTION 5.403, `MODEL HOME" OF ARTICLE 4, `TEMPORARY USES" OF CHAPTER 5, `SUPPLEMENTAL USES" TO PERMIT FIVE MODEL HOMES PER BUILDER, TO AMEND ARTICLE 5 `RESIDENTIAL DESIGN STANDARDS" OF CHAPTER 6 `DEVELOPMENT STANDARDS" TO ADD A NEW SECTION FOR ENTRY FEATURES, AMEND ARTICLE 6 `RESIDENTIAL DISTRICT USE TABLE" OF CHAPTER 4 `DISTRICT REGULATIONS" TO ADD A NEW CATEGORY UNDER ACCESSORY USES FOR PERMITTED ENTRY FEATURES, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING A PENALTY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, rt is the desire of the Crty Council to protect the future viability of residential property and neighborhoods through proper design and development standards, and, WHEREAS, the long term viability of a neighborhood is dependent upon adequate development standards, and, WHEREAS, the Crty Council created a special commission made up of developers, neighborhood associations, citizens, architects and non-profit interests to evaluate amendments to the Zomng Ordinance to support long term sustamabihty and benefit of residential neighborhoods to the Crty and, WHEREAS, this committee made recommendations regarding single family development standards, architectural features and improved neighborhood identrty• and WHEREAS, it is advisable to amend the Zomng Ordinance to incorporate those recommendations morder to protect the future viability of residential property NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, AS FOLLOWS SECTION 1. Section 5 403 `Model Home" of Chapter 5 `Supplemental Use Standards" Article 4 "Temporary Uses" of Ordinance No 13896, the Zoning Ordinance of the City of Fort Worth, ~s amended to allow five model homes per builder to read as follows. 5.403 Model Homes. 1 No more than five model homes per builder per platted subdivision are perrrutted. SECTION 2. Chapter 6, `Development Standards" of Article 5 `Residential Design Standards" of Ordinance No 13896, the Zoning Ordinance of the Crty of Fort Worth, is hereby amended to add a new section for entry features to read as follows. 6.508 Entry Features Entry features maybe located at the entry to a subdivision subject to the following: 1 Entry feature must be located on a collector or wider street; 2. Entry feature is limited to twenty-five (25) feet with a minimum side and rear setback of five (5) feet. No front setback along the street nght-of way is required, 3 Entry signs must be free standing or attached to a wall or entry feature; and 4 Signage is lumted to sixty (60) square feet and a maximum height of six (6) feet with a maxunum illumination of 25 lumens. SECTION 3 Chapter 4 Article 6, of Ordinance No 13896, the Zoning Ordinance of the Crty of Fort Worth, Section 4 603 `Residential District Use Table, is hereby amended to add 2 `Entry Features" as a use under Accessory Uses, Accessory" to add a `P" and an asterisk to indicate perrmtted uses for the column headings A 2.SA through `R2" districts for `Entry Features" and add a reference in the `Supplemental Standards" column to Section 6 508 for `Entry Features" under Accessory Uses. SECTION 4. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. 3 SECTION 6. Any person, firm, or corporation, who violates, disobeys, orruts, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordmance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 7 All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Orduiances No 3011 13896 and any other ordinances affecting zoning which have accrued at the tune of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and crunuial, whether pending ui court or not, under such orduiances, same shall not be affected by this ordmance but maybe prosecuted until final disposition by the courts. SECTION 8. The City Secretary of the City of Fort Worth, Texas, ~s hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Sectzon 52.013 Texas Local Government Code. SECTION 9 All other provisions of the Zoning Ordinance of the City of Fort Worth not herein amended shall remain in full force and effect. 4 SECTION 10.
