HomeMy WebLinkAboutOrdinance 16935-05-2006ORDINANCE NO 16935-OS-2006 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF CALHOUN STREET FROM LEUDA STREET TO CANNON STREET AND ADJACENT TO LOTS 2, 5, AND 6, BLOCK 40 AND BLOCK 47 IN TUCKERS ADDITION AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY TEXAS RECORDED IN VOLUME 63, PAGE 124 OF THE PLAT RECORDS OF TARRANT COUNTY TEXAS, CONTAINING APPROXIMATELY 10000 SQUARE FEET OR .2296 ACRES OF LAND PROVING FOR THE REVERSION OF FEE IN SAID LAND• THE RETAINMENT OF EXISTING UTILITY EASEMENTS REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That a portion of Calhoun Street, being 50 foot wide public right-of way lying between Cannon Street and Leuda Street, located adjacent to Block 47 Tuckers Addition and Lots 2, 5 and 6, Block 40 Tuckers Addition, and an addition to the City of Fort Worth, Tarrant County Texas recorded in volume 63 page 124 of the plat records of Tarrant County Texas, containing approximately 10 000 square feet, or .2296 acres of land more or less, and as more specifically described in Exhibit 1 `2" and `3 attached hereto and incorporated herein by reference, be ant the same is vacated and extinguished. SECTION 2. That all existing utility easements shall be retained by the Crty until such time all utilities located in that easement are relocated at the owner's expense. SECTION 3. The fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law SECTION 4. That all ordinances m conflict herewith are hereby repealed. SECTION 5. COUNCIL ACTION Approved on 5/9/2006 Ordinance No 16935-05-2006 DATE Tuesday May 09 2006 LOG NAME 06VA-05-028 REFERENCE NO PZ 2677 SUBJECT Adopt an Ordinance Vacating a Section of Calhoun Street from Cannon Street to Leuda Street Containing Approximately 10 000 Square Feet or 0 23 Acres Located Adjacent to Lots 2 5 and 6 Block 40 as Well as Block 47 Tuckers Addition as Recorded in Volume 63 Page 124 P R T C T RECOMMENDATION It is recommended that the City Council adopt an ordinance vacating a section of Calhoun Street from Cannon Street to Leuda Street containing approximately 10 000 square feet or 0 23 acres located adjacent to Lots 2 5 and 6 Block 40 as well as, Block 47 Tuckers Addition as recorded in Volume 63 Page 124 PR.TCT DISCUSSION Mori's Engineering Inc. has requested the above referenced vacation on behalf of Oak Timbers-Fort Worth South 'LP of Fort Worth The Engineering Department, Real Property Services Division states that the purchase fee of $100 00 has been waived per right-of-way dedication on the adjoining replat. Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on August 24 2005 The right-of-way being vacated is being retained as an easement for existing utilities.
