HomeMy WebLinkAboutOrdinance 21709-03-2015 i i I I Ordinance No. 21709-03-2015 N I AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $152,792.04, SUBJECT TO RECEIPT OF A GRANT FROM THE TXU ENERGY RETAIL COMPANY, L.P., FOR THE PURPOSE OF FUNDING THE ENERGY AID PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. i BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. I That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $152,792.04, subject to receipt of a grant from the TXU Energy Retail ! Company, L.P., for the purpose of funding the Energy Aid Program. SECTION 2. i That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining j provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. ! Ratify the acceptance of additional funds in the amount of$152,792.04 from the TXU Energy Retail Company, L.P., for the TXU Energy Aid Program; 2. Authorize an amendment to City Secretary Contract No. 43572 with TXU Energy Retail Company, L.P., I increasing the funding amount by $152,792.04 for a total contract amount of$602,792.04; and i 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$152,792.04. DISCUSSION: TXU Energy Retail Company, L.P. (TXU Energy), developed the Energy Aid Program as a supplement to government and community aid programs designed to assist persons in financial distress to meet their energy-related costs. Since 2004, the City of Fort Worth Parks and Community Services Community Action Partners Program has received funds from TXU Energy to assist low-income TXU Energy j customers with their electric bills. On July 17, 2012, (M&C C-25742) the City Council authorized an Agreement with TXU Energy in an amount up to $450,000.00, which ended on December 31, 2014. During this period, the City received a total amount of$602,792.04 from TXU Energy. Staff requests approval to accept the additional funds of $152,792.04 and adopt an appropriation ordinance. This program serves ALL COUNCIL DISTRICTS. FISCAL INFORMATION /CERTIFICATION: i The Financial Management Services Director certifies that upon approval of the above recommendation, and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund. Although revenue of$602,792.04 existed in the fund, only $450,000.00 was appropriated. To date, the Grants Fund has existing expenses and commitments totaling $584,929.78 for-the TXU Energy Aid Program. Upon approval of the recommendation, remaining funds will be $17,862.26.
