HomeMy WebLinkAboutOrdinance 21651-02-2015 I I 6 f ORDINANCE NO.21651-02-2015 i AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH, TEXAS, (1986), AS AMENDED, BY CREATING DIVISION 7, I "DEPARTMENT OF NEIGHBORHOOD SERVICES", ARTICLE IV, "DEPARTMENTS" OF CHAPTER 2, "ADMINISTRATION"; PROVIDING FOR THE ESTABLISHMENT AND SUPERVISION OF THE NEIGHBORHOOD SERVICES DEPARTMENT; PROVIDING FOR THE APPOINTMENT OF EMPLOYEES OF THE NEIGHBORHOOD SERVICES DEPARTMENT; PROVIDING FOR THE DUTIES OF THE NEIGHBORHOOD SERVICES DEPARTMENT; AMENDING SECTION 1 2.5-5, "ADMINISTRATION", OF DIVISION 1, "GENERAL PROVISIONS", j OF ARTICLE I, "EMPLOYEES RETIREMENT FUND", OF CHAPTER 2.5, "RETIREMENT" OF THE CITY CODE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. 4 WHEREAS, Chapter VIII, Section 1 of the City Charter authorizes the City Council to establish by ordinance such departments, divisions, and offices as it deems necessary for the operation for the City's business (in addition to those departments required by the City Charter); and WHEREAS, Chapter VIII, Section 1 of the City Charter authorizes the City Council to discontinue any department or office established by ordinance and to prescribe, combine, consolidate, distribute, or abolish the functions and duties of departments, divisions, or offices; and WHEREAS, the Department of Housing and Economic Development was created in Ordinance No. 18320-09-2008, adopted by City Council on September 30, 2008, as codified in 1 Section 2-166(b) of the Code of the City of Fort Worth, Texas (1986), as amended("City Code"); WHEREAS, the City Manager has recommended, and the City Council desires, that the Department of Housing and Economic Development be divided into two departments, the Department of Neighborhood Services, and the Department of Economic Development; and this ordinance creates the Department of Neighborhood Services. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: I SECTION 1. Division 7, "Reserved", of Article IV, "Departments", of Chapter 2, "Administration" of the City Code is hereby amended to read as follows: i Ordinance No.21651)-02-2015 Page 1 of 4 t i I I L DIVISION 7—DEPARTMENT OF NEIGHBORHOOD SERVICES Sec. 2-171. -Establishment and supervision of department. A Neighborhood Services Department ("Department") is hereby established. The Department shall be supervised by a Director ("Director"), who will be subject to appointment and removal by the City Manager. The Director's salary shall be set by the City Manager in accordance with the City's compensation plan. Sec. 2-172. -Department employees. The Director shall have the authority to appoint, employ and remove assistants, employees and other personnel as the Director deems necessary for the efficient administration of the Department's affairs and the execution of the Department's duties and obligations. The Director shall prescribe the duties of and compensation to such assistants, employees and other personnel in accordance with the City's compensation plan. Sec. 2-173. -Department duties. (a) The Department shall provide for the administration of programs and the expenditure of funds for housing and neighborhood revitalization with both public funds, public and private grants, and private donations. (b) The Department shall coordinate the implementation of neighborhood and community development projects endorsed by the City Council. (c) The Department shall oversee projects designed to increase investment in the central city areas of Fort Worth and other targeted areas. (d) The Department shall use incentives as allowed by law to encourage new investment and business expansion in targeted areas of the City of Fort Worth as designated from time to time by the City Council. (e) The Department shall manage City of Fort Worth special corporate entities created for the furthering of economic development and affordable housing activities. (f) The Department shall conduct and participate in activities that promote job opportunities for citizens of the City of Fort Worth in targeted areas as designated from time to time by the City Council. I Section 2.5-5, "Administration", of Division 1, "General Provisions", of Article I, "Employees Retirement Fund", of Chapter 2.5, "Retirement" of the City Code is hereby amended to replace add the " and the Neighborhood Services Department" immediately following the reference to the "Economic Development Department". SECTION 3. This ordinance shall be cumulative of all provisions of ordinances of the City Code except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such City Code, in which event conflicting provisions of such ordinances and such City Code are hereby repealed. i SECTION 4. r It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,paragraph or section. SECTION 5. i All other provisions of the City Code shall remain in full force and effect, save and except as amended by this ordinance. I DISCUSSION: i The attached ordinance amends Article IV, Chapter 2 of the City Code by dissolving the Housing and Economic Development Department and dividing it into two separate departments. This Ordinance creates the Neighborhood Services Department. A similar M&C, with Ordinance for the creation of the Economic Development Department is also being considered by Council. This action is consistent with the City Manager's work plan for the remainder of Fiscal Year 2015, and these departments will be formed with existing resources and without additional positions or appropriations. The Neighborhood Services Department, among other duties set forth in the attached ordinance, will provide for the administration of programs and the expenditure of funds for housing and neighborhood revitalization with both public funds, public and private grants, and private donations; oversee projects designed to increase investment in the central city areas and other targeted areas; manage City of Fort Worth special corporate entities created for the furthering of economic development and affordable housing activities; and coordinate the implementation of neighborhood and community development projects endorsed by the City Council. I FISCAL INFORMATION/CERTIFICATION: The Financial Management Services Director certifies that approval of the above recommendation will have no material effect on the Fiscal Year 2015 budget and all expenditures until October 1, 2015 will be made through appropriated funds in existing departmental budgets. While no current year impact is anticipated from this action, upon approval the Neighborhood Services Department will be included in the Fiscal Year 2016 budget of the City Manager.
