SECOND AMENDMENT TO
CITY SECRETARY CONTRACT NO. 44430
THIS SECOND AMENDMENT to City Secretary Contract No. 44430 is entered into by
and between the City of Fort Worth ("City"), a home-rule municipality in the State of
Texas, acting through Fernando Costa, its duly authorized Assistant City Manager, and
Enercon Services, Inc. ("Contractor"), acting through John R. Corn, its duly authorized
Vice President.
WHEREAS, the City and Enercon Services, Inc. have entered into that certain
agreement identified as City Secretary Contract No. 44430 commencing on May 9,
2013 for environmental and engineering consulting services as authorized by Mayor
and Council Communication C-26209; and
WHEREAS, Mayor and Council Communication C-26209 provides for an initial contract
term of one year and provides for the extension of the term of the agreement for up to
two additional periods of one year each; and
WHEREAS, City Secretary Contract No. 44430 A-1 extended the contract term from
May 9, 2014 to May 8, 2015.
WHEREAS, the parties wish to extend the term of the initial contract for an additional
year (third of three) and sufficient funds have been appropriated; and

N WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain
the same as stated in City Secretary Contract No. 44430;

a NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
w and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged and confessed, the parties hereto agree as follows:

City Secretary Contract No. 44430 is extended to include the term beginning May 9,
2015 and ending May 8, 2016.

2. Compensation Not to Exceed Amount.-
Compensation
mount:Compensation shall not exceed four hundred thousand dollars ($400,000.00) for the
term of this amendment, billable according to the compensation schedule of City
Secretary Contract No. 44430 and subject to all other terms and conditions as stated in
City Secretary Contract No. 44430.
3. Miscellaneous:
All other definitions, terms, and conditions of City Secretary Contract No. 44430 shall
remain unchanged except as expressly set forth herein.
IN WITNESS THEREOF, the parties have executed this contract in triplicate in Fort
Worth, Texas, on the dates written below.

SUBJECT:
Authorize Execution of a Professional Services Contract with Enercon Services, Inc., in the Amount of
$400,000.00 for Environmental and Engineering Consulting Services (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of a professional services contract with
Enercon Services, Inc., for environmental and engineering consulting services not to exceed $400,000.00
for a period of one year with two one-year renewal options.

DISCUSSION:
This professional services contract provides resources to enhance Staff regarding State and Federal
environmental compliance including the Clean Air Act, Clean Water Act, hazardous waste issues, the
City's Petroleum Storage Tank Remediation Program and other environmental projects. Contract services
also provide specialized services when required to ensure projects meet stringent regulatory
requirements.
A Request for Qualifications (RFQ) was advertised on December 12, 2012. Responses were submitted
by eleven firms on January 17, 2013. Submittals from each of the 11 firms were reviewed and rated
based on the published weighted selection criteria. Enercon Services, Inc., was selected as the most
highly qualified provider, based on demonstrated competence and qualifications to perform the services in
accordance with Chapter 2254 of the Texas Government Code.
RENEWAL OPTIONS—This contract may be renewed for up to two successive one-year terms at the
City's option. Renewal may be effected by notice in writing by the City Manager, or his designee, to the
contractor within 30 days of the expiration of the prior term. This action does not require specific City
Council approval, provided that the City Council has appropriated sufficient funds to satisfy the City's
obligations during the renewal term.
M/WBE OFFICE: Enercon Services, Inc., is in compliance with the City's Business Diversity Ordinance by
committing to 15 percent MBE (African American) participation. The City's goal on this project is 15
percent.
This contract serves the entire city.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that funds will be available in the current operating
budget, as appropriated, of the Environmental Management Project Fund.
