ORDINANCE NO. AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 31, BETTS SUB- DIVISION OF JENNINGS SOUTH ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED.ADTD CLOSED; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. 'BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the twelve foot alley in Block 31, Betts Subdivision of Jennings 'South Addition to the City of Fort Worth, Tarrant County, Texas, is hereby vacated, closed and permanently abandoned as an alley or public thorough- 'fare of any kind or character whatever. SECTION 2. That the fee to the land in said alley above described is hereby =released and will revert to the owners as provided by law, save and except that an easement is reserved for all existing utilities; and it is spe- cifically understood and agreed that,should any permanent structure ever be erected over said alley, the owners of the property shall be required, at their own expense, either to reroute the sanitary sewer line in said al- ley or to replace it under any permanent building with cast iron pipe. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. The Boswell Dairies owns all of this block with the exception of Lot 20 which is owned by Mr. Walter C. Purvis and wife, Hazel Purvis. There is only. one residence in the block which is located on Lot -20- - "This alley is not used-by the public, but exclusively by the people"who have signed this petition.-_ There are no utility lines,in"the alley except a sanitary sewer. It is necessary that this sewer be kept in service in order to serve property south of this block.. Mr. Boswell states that the north part of this block, is occupied by their buildings which are used exclusively by the Boswell Dairies. The buildings are located on each side of the alley and. they have overhead ammonia and water pipes which are necessary to conduct their business. Mr. Boswell further states that they wish to put a fence across this alley in order to keep out prowlers. TATe have checked this request on the ground and see no particular reason why the alley should not be closed since it is used exclusively-by the signers of this petition. Our recommendation is that the alley be closed as requested and that an easement be retained for all existing utilities, and that should any per- manent structure ever be erected over the alley that the owners of the property be required to either reroute the sanitary sewer line or replace it under any permanent building with cast iron pipe9 at their own expense. Jones, City Manager Dear Sir: The following is submitted in reply to the above subject. 9 - PETITION REQUESTING CLOSING OF ALLEY IN BETTS SUBDIVISION OF BLOCK 31, . JENNINGS SOUTH ADDITION TO THE HONORABLE CITY COUNCIL OF THE CITY OF FORT WORTH: Petitioners, BOSTn1ELL DAIRIES, a Texas corporation, of Fort Worth, Texas, and WALTER C. PURVIS and wife, HAZEL PURVIS, residents of_ the City of Fort Worth, Texas, respectfully re- quest the City Council of the City of. Fort Worth to enact an ordinance closing the alley running in a northerly and souther- ly direction through Betts Subdivision of Block 31, Jennings South Addition to the City of Fort Worth, and lying between Lots 5 to 12 inclusive on the east and Lots 13 to 20 inclusive on the West. Your petitioners own all of the lots in said block abutting on said alley,—Boswell Dairies owning all of said lots except Lot 20 owned by petitioners Walter C. Purvis and wife, Hazel Purvis, and situated at the southwest- corner of said block. Attached hereto is a sketch showing Betts Sub- division of said Block- 31. There are no residences on any of the lots abutting on said alley except the one owned by petitioners- Purvis, the remaining portion of said area being owned by Boswell Dairies and being used in connection with its business. The alleyway shown on the map of said block as- 12 feet in. width is not now and has not for many years been used by the public generally, but exclusively_ by.. your peti- tioners principally by Boswell Dai-r`.i es;- and said alleyway serves no useful or beneficial purpose. None of the utilities are situated in or along said alley, except only__the_„sanitary sewer line owned by the City of Fort Worth, for which the said City can, of course, retain an easement in any ordinance closing said alley. The purposes for which petitioners are using and desire to use said alleyway are set forth below. In the northerly part of said Block 31 buildings of the plant of Boswell Dairies lie on both sides of said alley and in close proximity thereto, and the area embraced in said alley lying .between said buildingsis badly needed for general use by Boswell Dairies for many purposes incidental to the proper conduct of its business of processing and distributing milk and dairy products, including loading and unloading of its trucks, _.passag.e__of dolly trucks and hand trucks to and from the buildings of its plant, passage of employees to and from and. between said buildings and other areas in said block, and over- head of ammonia and water pipes necessary to the, con .0 ct of its business�m--�" _.... ......_..._.. The southerly portion of said block; except the part owned by petitioners Purvis, is . used for and is needed for parking and refrigerating and otherwise serving the trucks of P Boswell Dairies, and loading and unloading the same, and for overhead ammonia pipes and water pipes used in refrigerating and serving trucks, Boswell Dairies desires- to rearrange the area in the south part of said block for the parking, refrigerating and servicing of its trucks and to enclose said area within a fence and to provide for ingress and egress of trucks from the east,--which will prove convenient and allow for handling of a greater number of its trucks at one time. The erection of such a fence will furnish badly needed protection against theft from and tampering with the trucks and other equipment of Boswell Dairies by prowlers, which is now resulting in substantial inconvenience, loss and expense. In this connection, prowlers, in addition to stealing, have on occasion disconnected the refrigeration facilities from parked trucks, thereby causing spoilage and loss of dairy products in the trucks . Substantial and needed relief from this un- desirable condition will be afforded by enactment of the ordinance requested and will result in no detriment or in- convenience to the public, which no longer needs or uses said alleyway. Petitioners Purvis need and desire to use the South 37,8 feet of said alley as a place for parking their truck , and automobile,---which will be facilitated by closing of the alley as requested.
