AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE GRANTS FUND IN THE AMOUNT OF $77 643, SUBJECT TO RECEIPT OF
INTERLOCAL AGREEMENT FROM THE TEXAS COMMISSION ON ENVIRONMENTAL
QUALITY FOR THE PURPOSE OF FUNDING THE CITY'S PARTICIPATION IN `FREE
FAIR TRANSIT DAY" ON JULY 18, 2006, FOR A SEVERABILITY CLAUSE, MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 and
in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the
Grants Fund in the amount of $77 643 subject to receipt of the executed contract from the Texas
Commission on Environmental Quality for the purpose of funding the City's participation in 'Free Fair
Transit Day' on July 18, 2006.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption

Authorize Entering a Third Party Agreement with the Texas Commission on Environmental Quality
for Supplemental Environmental Project Funding and Adopt Appropriation Ordinance
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to enter into a third party agreement with the Texas Commission on
Environmental Quality (TCEQ) to receive voluntary Supplemental Environmental Project contributions for a
City environmental project with a not to exceed amount of $77 643 00' and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund by $77 643 00 subject to receipt of an executed agreement.
DISCUSSION
Under Texas Commission on Environmental Quality (TCEQ) regulations a party involved in an enforcement
action with the TCEQ may negotiate an agreement to perform or fund a Supplemental Environmental
Project in return for a reduction in the assessed administrative penalty The TCEQ defines a SEP as a
project that prevents pollution reduces the amount of pollution reaching the environment, or enhances the
quality of the environment. Although the City of Fort Worth is not currently a party to a SEP TCEQ
regulations allow the City to receive SEP monies to fund local environmental projects.
The money received under the terms this third party agreement will be used to fund a Free Fare Transit
Day" in North Texas The regions three transit agencies DART The T and the Denton County
Transportation Authority (DCTA) have committed to the event. The Trinity Railway Express (TRE) a
branch of the DART and The T will be included in the Free Fare Transit Day event.
The City of Fort Worth North Texas Clean Air Coalition (NTCAC) and the region s transit agencies will host
a Free Fare Transit Day" July 18 2006 The transit agencies and the NTCAC will provide project
coordination event promotion and media relations. The City of Fort Worth will act as the fiscal agent. The
money received through the SEP will be used to reimburse the transit agencies for fares and additional
security up to $74 643 and fund an education event item in the amount of $3 000 The transit agencies and
the NTCAC will provide invoices to the City of Fort Worth in order to receive reimbursement of their costs.
The Free Fare Transit Day will capture media attention and has the potential to increase the region s transit
ridership and reduce air emissions This regional effort is a first for North Texas and will allow North Texans
an opportunity to try transit FREE
