AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 39,
NORTH FORT WORTH ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND
CLOSED; AND PROVIDING FOR THE REVERSION OF THE FEE
TO SAID LAND.
WHEREAS, it appearing to the City Council of the City of Fort Worth
that the alley in Block 39, North Fort Worth Addition to the City of Fort
Worth, Tarrant County, Texas, has never been used by the public and that
it is to the best interest of the public that said alley be closed, aban-
doned and vacated as a public thoroughfare and the fee to the land in
said alley revert as provided by law; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That the alley in Block 39, forth Fort Worth Addition to the City
of Fort Worth, Tarrant County, Texas, be and the same is hereby vacated,
closed and permanently abandoned as an alley or public thoroughfare of
any kind or character whatever,
SECTION 2.
That the fee to the land in said alley above described is hereby re-
leased and will revert to the owner as provided by lax.
SECTION 3,
That all ordinances or parts of ordinances in conflict herewith are
hereby repealed,
SECTION 4,
That this ordinance shall take effect and be in full force and effect
from and after the date of its passage.

Dear Sir:
You will find attached a letter from Mr. Nelson Scurlock, Attorney
for the T. E. Mercer Distributing Company, requesting the closing
of a portion of the alley in Block 39, North Fort Worth Addition.
You will also find attached a plat showing the location of this
proposed closing and the other alleys that have been closed in
this vicinity.
We have checked this alley and have found that it has never been
opened for public use and there are no utility lines in the alley.
Renfro Street at the south end of the alley has been closed by
Ordinance No. 2304, which closes the alley at the south end of the
block.
This is an industrial section and in order to construct large
buildings, warehouses, it is necessary that the alleys be closed.
Mr. Scurlock is of the opinion that the alley in the north 1501
of this block has already been closed. However, our records do
not show this. The T. E. Mercer Distributing Company owns the
entire block.
Our recommendation is that the entire alley in Block 39, North
Fort Worth Addition be closed by Ordinance.

Dear Mr. Jones:
We represent T. E. Mercer Distributing Company, a partnership
composed of George E. Mercer, Wm. 0. Compton, Mrs. T. E. Mercer, a widow,
and Mrs. Irene Mercer Compton. This company is the owner of the following
described property in North Fort Worth:
Lots 19 2, 3, 10, 11, 12 & 13 in Block No. 39 of Forth
Fort Worth Addition, and the North 221 feet of Renfro
St. between Block D and Block 39 of North Fort Worth
Addition, all in the City of Fort Worth, Tarrant County,
Texas.
I am attaching a little plat which will clarify the situation.
Renfro St., shown on the plat, was closed by City Ordinance No.
2304. Also, on August 21st, 1946, the City of Fort Worth executed and
delivered to Walter Dearmin a quit claim deed to "Renfro St. from North
Main St. to North Commerce St. and being between Block D and Block 39 of
North Fort Worth Addition to the City of Fort Worth." The title of T. E.
Mercer Distributing Company comes from Walter Dearmin.
T. E. Mercer Distributing Company respectfully petitions the
City of Fort Worth to enter an order closing the alley between Lots 19 2,
and 3 on the one side and Lots 10, 11, 12 and 13 on the other side, all in
Block 39. In this connection I have been informed by my client and by Mr.
George W. Childs, of the Childs Construction Company now engaged in erect-
ing a building on this property, that the alley has already been officially
closed immediately North and immediately South of the property in question.
I have not seen the records to this effect but am reasonably sure it is true.
Of course, I do observe that with Renfro St. being officially closed there
is no entrance to the alley in Block 39 from the South.
As a matter of record I will add that T. E. Mercer Distributing
Company acquired the title to Lot 10 in Block 39 and the North half of
Renfro St. adjoining Block 39 by a special warranty deed executed by
Walter Dearmin dated January 24, 1947. This deed is recorded in Volume
1873, Page 233, Deed Records of Tarrant County, Texas. Also, the T. E.

Mercer Distributing Company acquired the title to Lots 1, 2, 3, 119 12,
& 13 in Block 39 by a varranty deed dated January 24, 1947 and recorded
In Volume 1873, Page 232, Deed Records of Tarrant County, Texas.
The favorable action of the City of Fort Worth xill be greatly
appreciated in connection xith this petition and request.

Dear Mr. Jones:
Please refer to my letter of January 31, 1950, wherein I requested,
on behalf of our client T. E. Mercer Distributing Company, that the alley
dividing certain property in Block 39 of North Fort Worth Addition to the
City of Fort Worth be closed. In my letter I stated that the alley immedi-
ately north of Lots 3 and 10 in Block 39 was already closed; and this was
the information furnished me. I am now informed by the officials of the
City that the alley has not been officially closed in any part of Block 39.
I therefore wish to amend my petition and request that the alley
be closed in the entire Block.
In this connection I wish to state that Lots 49 59 69 7, 89 and 9
in Block 39 are owned by the T. E. Mercer Teaming and Trucking Contractor,
which is also a partnership composed of George E. Mercer, Mrs. T. E. Mercer,
a widow, and Irene Compton. These are the same persons who, along with Wm.
0. Compton, compose the partnership of T. E. Mercer Distributing Company.
