AN ORDINANCE INCREASING APPROPRIATIONS IN THE ENVIRONMENTAL
MANAGEMENT OPERATING FUND IN THE AMOUNT OF $72 069 45 AND
DECREASING THE UNRESERVED UNDESIGNATED FUND BALANCE BY
THE SAME AMOUNT FOR THE PURPOSE OF TRANSFERRING SAID
FUNDS TO THE ENVIRONMENTAL MANAGEMENT PROJECT FUND FOR
REPAIR SERVICES LOADING DOCK IMPROVEMENTS AND SAFEGUARDS
AT THE BRENNAN SERVICE CENTER BY THE STOVALL CORPORATION
FOR THE EQUIPMENT SERVICES DEPARTMENT PROVIDING FOR A
SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-
2006 in the Budget of the City Manager there shall also be increased appropriations in the
Environmental Management Operating Fund in the amount of $72,069 45 and decreasing the
unreserved, undesignated fund balance by the same amount, for the purpose of transferring said
funds to the Environmental Management Project Fund for repair services, loading dock
improvements and safeguards at the Brennan Service Center by the Stovall Corporation for the
Equipment Services Division.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 16582 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect upon adoption

Adopt Appropriation Ordinances Approve Transfer of Funds and Authorize Change Order No 1 to
a Purchase Order with Stovall Corporation to Increase the Maximum Fee for Repair Services and
Safeguards at the Brennan Service Center for the Equipment Services Department
RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached supplemental appropriation ordinance increasing appropriations in the
Environmental Management Operating Fund (R103) by $72,069 45 and decreasing the unreserved
undesignated fund balance by the same amount;
2. Approve the transfer of $72 069 45 in undesignated funds in the Environmental Management Operating
Fund to the Environmental Management Project Fund (R101)
3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Environmental Management Project Fund by $72,069 45 and
4 Approve a change order in the amount of $97 924 39 to purchase order TYPA-06-00034231 to pay
Stovall Corporation for repair services loading dock improvements and safeguards at the Brennan Service
Center for the Equipment Services Department.
DISCUSSION
On August 12 2005 the Environmental Management Department (EMD) was contacted by the Equipment
Services Department concerning a fuel release from a 126 000-gallon Aboveground Storage Tank (AST) at
the Brennan Service Center
EMD responded and confirmed a fuel release had occurred The fuel supply line leading from the AST
underneath a secondary containment berm to the onsite fuel station was determined to be leaking due to
soil corrosion Transportation/Public Works Equipment Services, and Environmental Management staff
worked together to assess the release extent. Based on site observations the release of fuel occurred over
a period of time and resulted in an estimated 2 000 gallons of fuel released into the soil
The City has an annual agreement with Stovall Corporation TYPA-06-00034231 authorized by the City
Council on April 15 2003 (M&C P 9784) to provide fuel system repair and maintenance Staff contacted
Stovall Corporation (Stovall) to make necessary repairs to the fuel supply lines and pumping unit, install
electronic control valves modify loading rack to meet current standards, and restore the fuel site
infrastructure to safe operating standards The cost for these services total $97 924 39
Eagle Construction and Environmental Services Inc provided soil remediation and disposal relative to the
fuel release approved by the City Council on January 31 2006 (M&C P 10309)

Section 252 022(a)(2) of the Texas Local Government Code exempts from competitive bidding
procurements made 'necessary to preserve or protect the public health or safety" of the City's citizens
The Brennan Service Center is located in COUNCIL DISTRICT 2
FISCAL INFORMATION/CERTIFICATION
The Finance Director certifies that upon approval of the above recommendations, and adoption of the
attached appropriation ordinance funds will be available in the current capital and operating budgets, as
appropriated of the Environmental Management Project and Equipment Service Funds
