HomeMy WebLinkAboutContract 28006-A3 AMENDMENT NO. 3 STATE OF TEXAS S CITY SECRETARY CONTRACT NO -A3 (MSC Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Dannenbaum Engineering Corp. , (Engineer) made and entered into City Secretary Contract No. 28006, (the Contract) which was authorized by the City Council by MSC C-19172 on the 30th day of July, 2002 and subsequently revised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design. WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in MSC C-23578, adopted by the City Council on the 9th day of June, 2009, and corrected by MSC C-23574 (September 1, 2009) and further amplified in a proposal letter dated February 23, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $96,825.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $1,259,931.28. No. 3650 Dear Mr. Cooper: This letter is to provide the revised Supplemental Agreement No. 3 for the design of Main 325. The original submittal was dated October 20, 2008 and revised via a submittal on January 14, 2009. As you are aware, the realignments of Main 325 will require additional field survey, environmental and design effort. Based on discussions during our meeting on February 5, 2009, I have revised the computation of additional engineering fee to reduce the amount by approximately 20% and reduced the surveying amount by 25%. Approval of Supplemental Agreement No. 3 will increase the design fee from $1,163,106.28 to $1,259,931.28, an increase of$96,825.00. Please inform us of the City's approval of the contract changes. Compensation A. The ENGINEER shall be compensated total lump sum fees as summarized in Exhibit `B-3' and as follows: Payment of the total lunp sum fees shall be considered full compensation for the services described in Attachment `A' and Exhibit"A-2"for labor materials,supplies and equipment necessary to complete the project. B. Partial payments shall be rnade monthly,as stipulated on Exhibit B-1,upon receipt of an invoice from the ENGINEER. Each invoice is to be verified as to its accuracy and compliance with the terms of this contract by an officer of the ENGINEER. Payment according to statements will be subject to certification by the designated representative of the Water Department that such work has been performed. DISCUSSION: On June 9, 2009, (M&C C-23578) the City Council authorized the City Manager to execute Amendment No. 3 in the amount of$96,825.00 to City Secretary Contract No. 28006 with Dannenbaum Engineering Corporation, thereby increasing the contract amount to $1,163,106.26. Subsequent to City Council approval of M&C C-23578, it was determined that staff had inadvertently listed the contract amount to date as $1,163,106.26 instead of$1,259,931.28. This M&C will correct M&C C- 23578 as requested herein. DISCUSSION: On July 30, 2002, (M&C C-19172) the City Council authorized the City Manager to execute an Engineering Agreement with Dannenbaum Engineering Corporation in the amount of $721,899.76 to prepare plans and specification for Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design. The agreement was subsequently revised by two amendments totaling $441,206.52 as follows: . Amendment No. 1 in the amount of $111,800.52 (M&C C-19936, January 20, 2004) provided for additional engineering services required for the design of Sanitary Sewer Laterals 2389, 2484, 3694, 9920 and Main 238. . Amendment No. 2 in the amount of $329,406.00 (M&C C-22535, November 17, 2007) provided for engineering services for the design of additional segments of sanitary sewer Main 325. Amendment No. 3 will provide for the following: . Engineering services for redesign of the original approved alignment for the sewer main due to conflicts with recently installed and proposed gas mains, recently completed and continuing development and easement acquisition problems. The original alignment would have resulted in an unmaintainable sewer main as a result of the identified conflicts. . Modifications to the environmental information document. . Storm water pollution prevention plans. Dannenbaum Engineering Corporation proposes to provide the additional requested services for a lump sum fee of$96,825.00. Dannenbaum Engineering Corporation is in compliance with the City's M/WBE Ordinance by committing to an additional 50 percent M/WBE participation on this Amendment No. 3. In addition to the contract amount, $45,000.00 is required for staff time to administer and manage the contract, land acquisition cost and utility coordination. The project is located in COUNCIL DISTRICTS 6 and 8.
