Home My WebLink AboutContract 28006-A4 AMENDMENT NO. 4 STATE OF TERAS S CITY SECRETARY CONTRACT NO. -k4 (M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Dannenbaum Engineering Corporation, (Engineer) made and entered into City Secretary Contract No. 28006, (the Contract) which was authorized by the City Council by M&C C-19172 on the 30th day of July, 2002 and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design. WHEREAS, it has become necessary to execute Amendment No.4 to said Contract to include an inc eased scope of work and revig-a maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in M&C C-24794, adopted by the City Council on the 22°d day of March, 2011, and further amplified in a proposal letter dated December 2, 2010, a copy of which is both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $60,835.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $1,320,766.28. No. 3650 Dear Mr. Cooper: This letter is to provide Supplemental Agreement No. 4 for the realignment of Main 325 from Approximately Station 87+20 to Station 110+00 at the City's request in negotiations with affected landowners. This alignment reflects the relocation of the main to follow the alignment of Deer Creek as requested by the City. As you are aware, the realignments of Main 325 will require additional field survey, environmental, geotechnical and design effort. Based on discussions concerning the project realignment on August 10, 2010, and the follow up alignment exhibit, delivered by Dannenbaum's FTP site on August 12, 2010, 1 am supplying this Supplemental Agreement No. 4 which, when approved, will increase the design fee from $1,259,931.28 to $1,320,766.28, an increase of$60,835.00. DISCUSSION: On July 30, 2002, (M&C C-19172) the City Council authorized the City Manager to execute an Engineering Agreement with Dannenbaum Engineering Corporation in the amount of $721,899.76 to prepare plans and specifications for Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design. The agreement was subsequently revised by three amendments totaling $538,031.52 as follows: Amendment No. 1 in the amount of $111,800.52 (M&C C-19936, January 20, 2004) provided for additional engineering services required for the design of Sanitary Sewer Laterals 2389, 2484, 3694, 9920 and Main 238. Amendment No. 2 in the amount of $329,406.00 (M&C C-22535, November 27, 2007) provided for engineering services for the design of additional segments of sanitary sewer Main 325. Amendment No. 3 in the amount of $96,825.00 (M&C C-23578, June 9, 2009) provided for the redesign of the original approved alignment for the sewer main due to conflicts with recently installed and proposed gas mains, recently completed and continuing development and easement acquisition problems, modifications to the environmental information document and storm water pollution prevention plans. Amendment No. 4 will provide for the following: Engineering services for the redesign of a portion of Main 325 crossing properties owned by Huguley Hospital and Elton M. Hyder. The original alignment was across developable land on the north side of the said properties. The respective owners requested that the sewer main be moved to undevelopable floodway across the south end of these tracts. The revised alignment will require additional survey, geotechnical work, design, revisions to the environmental Information document and the preparation of new easement documents. The new alignment will result in lower easement acquisition costs. Dannenbaum Engineering Corporation proposes to provide the additional requested services for a lump sum fee of$60,835.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. The City's goal on this amendment is 51 percent. In addition to the contract amount, $2,500.00 is required for project management. The project is located in COUNCIL DISTRICTS 6 and 8.
