HomeMy WebLinkAboutContract 28673-A3 d AMENDMENT NO. 3 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. 5&-7 - 3 (No M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Carter & Burgess, Inc. , (Engineer) made and entered into City Secretary Contract No. 28673, (the Contract) which was authorized by the City Council by M&C C-19564 on the 29th day of April, 2003; and WHEREAS, the Contract involves engineering services for the following project: East 7th Street Deep Tunnel Sanitary Sewer, Part 1. WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated August 19, 2009, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $14,000 .00 (Sewer WP 33) . 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $387,117 .50. City of Fort Worth Department of Engineering 1000 Throckmorton Street Fort Worth, Texas 76102 Reference: Amendment No. 3 to the Engineering Services Agreement East 7`h Street Deep Tunnel Sewer Fort Worth Project No. P275-708170108633 D.O.E. No. 4009 Carter & Burgess, Inc. Job No. 011913.010 Dear Mr. Cooper: The purpose of this letter is to summarize our request for Amendment No. 3 for the East 7`h Street Deep Tunnel Sewer project. We are requesting this amendment for compensation of additional scope activities and to adjust our costs due to the extension of the project completion. Carter & Burgess, Inc. (C&B) was awarded the East 7`h Street Deep Tunnel Sewer Alignment Study and Design on April 29, 2003. The original contract was awarded for $339,873.50. Amendment No. 1 was approved by the City on November 26, 2003, which increased the project budget by $14,670. This amendment was prepared to address the added cost associated with obtaining additional insurance requested by the City for the geotechnical investigation. This brought the total project budget to $354,543.50. Amendment No. 2 was prepared and approved by the City on September 12, 2007 to cover the additional work required to break the project into two phases and increased the project budget by $18,574.00, for a total budget of$373,117.50. As a result of dividing the project into two phases and as a result of the necessary temporary construction easements, there were 4 additional easements prepared by ANA Consultants. ANA Consultants provided these easements at $1,000 each for a total of $4,000. They have requested an amendment to cover these additional easements that have been provided for the project. During Phase 1 construction we have received two requests from you to modify the existing design plans to reflect changing field conditions that were found during construction, these changes will include additional survey for moving sanitary sewer connection to the 96-inch WF-2 sanitary sewer tunnel for a total of $1,500. Design of relocation of sanitary sewer connection to the 96-inch WF-2 sanitary sewer tunnel which includes relocation of storm drain above the sewer. Prepare changes to sheet 10 of 37 and 18 of 37 for a total of $6,000. Subsequent changes were requested to the Phase 2 plans. These changes occurred as a result of emergency repairs that the City of Fort Worth completed for the Tindall Storage Building. Original plans called for this line to be abandoned and reconnected. As a result of recent repairs, the City of Fort Worth has requested that the line remain in service and an additional lateral be installed to connect to the new 24-inch Deep Tunnel. This will require an additional easement at a cost of $1,000. Design of the new lateral will require additional services of $1,500. The total cost for all services for this amendment will be $14,000.
