HomeMy WebLinkAboutContract 28766-A1 AMENDMENT NO. 1 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. 7A L (M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and RJN Group, Inc. , (Engineer) made and entered into City Secretary Contract No. 28766, (the Contract) which was authorized by the City Council by M&C 19586 on the 13th day of May, 2003; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LVIII (58) . WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I, of the Contract is amended to include the additional engineering services specified in M&C C-23440, adopted by the City Council on 14th day of April, 2009, and further amplified in a proposal letter dated February 17, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $62,115.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $361,954 .00. Standard City of Fort Worth Traffic Control plans will be used for Part 2 and Part 3. **MWBE Participation Detailed explanation of each task is as follows: Basic Services: 1. Monthly reports and meetings. There is extra cost to prepare the monthly status reports and attend the monthly consultants meetings until the projects are under construction. 2. Coordination with the Parks Department and modifications to the design of the sewer crossing at Overton Park. Several revisions were made as a result of a series of meetings with the Parks Department which were not anticipated originally. RJN also prepared a landscape design plan to disguise the aerial crossing based on markups provided by the Parks Department's architect. 3. Traffic Control Plans for three parts. At the city's request, one detailed Traffic Control Plans (TCP)was developed for Part 1. For Parts 2 and 3, standard City of Fort Worth TCP plans will be used instead. 4. Preparation of Right of Entry (ROE) letters. ROE letters will have to be revised based on current ownership. 5. Site visit to verify existing survey and design. Since the survey was completed over four years ago, it is necessary to verify field conditions and update the design accordingly. 6. Utility coordination. Additional plans were sent to utility companies for review and RJN has also coordinated with various utility companies to update the location and size of the effected utilities. 7. Update of specifications and bid items. In addition to updating the specifications and bid item list to the current City of Fort Worth standards, these projects are now also funded by Texas Water Development Board(TWDB) so requirements from TWDB need to be included in the bid documents. 8. Permits and easement revision. Permits will need to be re-applied and submitted and easements need to be revised to meet current City of Fort Worth easement format and standards. Also, cost to prepare new easement has increased due to inflation in the last 4 years. New easements will be billed at 5600/each. Special Services: 1. Sub-consultants management fee. Based on 10%of sub-consultant fees. 2. Mileage and printing. Mileage for additional field visits and monthly consultants meetings. Additional printing cost for additional plan and spec submittals. 3. Geotechnical service. At the city's request, soil boring is being done due to the depth of the sewer main in Unit 2. A Letter of Intent(LOI) from Mas-Tek is attached with this amendment. Authorize the transfer of$65,115.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$65,115.00 from available funds; and 3. Authorize the City Manager to execute Amendment No. 1 in the amount of$62,115.00 to City Secretary Contract No. 28766, an Engineering Agreement with RJN Group, Inc., for Sanitary Sewer Rehabilitation along Branch Road and Sarita Drive, thereby increasing the contract amount to $361,954.00. DISCUSSION: On May 13, 2003, (M&C C-19586) the City Council authorized the City Manager to execute an Engineering Agreement with RJN Group, Inc., in the amount of$299,839.00 for Sanitary Sewer Rehabilitation Contract LVIII (58). Amendment No. 1 will provide compensation for the following: Geotechnical services on the project; Updating the specifications and contract documents to meet current City standards; Preparation of right-of-way agreements; Easements and permits revision; and Additional survey on the project. M/WBE — RJN Group, Inc., is in compliance with the City's M/WBE Ordinance by committing to 22 percent M/WBE participation on this Amendment No. 1. In addition to the Amendment amount, $3,000.00 is required for project management. This project is located in COUNCIL DISTRICT 3, Mapsco 89G.
