HomeMy WebLinkAboutContract 28790-A8 AMENDMENT NO. 8 STATE OF TEXAS S CITY SECRETARY CONTRACT NO.QS-12 -/ (M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Lockwood, Andrews 6 Newnam, Inc. , (Engineer) made and entered into City Secretary Contract No. 28790, (the Contract) which was authorized by the City Council by M&C C-19575 on the 13th day of May, 2003 and subsequently revised by seven amendments; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract La"VII (67) . WHEREAS, it has become necessary to execute Amendment No. 8 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in M&C C-23685, adopted by the City Council on the 4th day of August, 2009 and further amplified in a proposal letter dated February 11, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $50, 437 .00. 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $509, 677.00. Authorize the transfer of$55,937.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$55,937.00 from the available funds; and 3. Authorize the City Manager to execute Amendment No. 8 in the amount of$50,937.00 to City Secretary Contract No. 28790 with Lockwood, Andrews& Newnam, Inc., for Sanitary Sewer Rehabilitation Contract LXVII (67). DISCUSSION: On May 13, 2003, (M&C C-19575) the City Council authorized the City Manager to execute an engineering agreement with Lockwood, Andrews& Newnam, Inc., in the amount of$260,706.00 for sanitary sewer rehabilitation contract LXVII (67) (Project 00473). The contract was subsequently revised by seven amendments totaling $197,494.00 that are further described as follows: Amendment No. 1 in the amount of$22,350.00 administratively approved by the City Manager on July 15, 2004, provided survey and engineering design services for the replacement of additional sanitary sewer mains as requested by the City; Amendment No. 2 in the amount of$20,410.00 administratively approved by the City Manager on September 1, 2004, provided for the rerouting of sewer main M-132 located on private property into public right-of-way; Amendment No. 3 in the amount of$14,900.00 administratively approved by the City Manager on September 20, 2004, allowed for the preparation of an alignment study that provided several alternate routes for a sewer main to covey wastewater from the redevelopment of the Montgomery Ward property and the surrounding area; Amendment No. 4 approved by Mayor and Council Communication (M&C) C-20452 on December 21, 2004, in the amount of$80,170.00 provided for survey and design of selected route in Amendment No. 3 and rerouting a segment sewer main in conflict with the proposed Trinity River Vision improvements; Amendment No. 5 in the amount of $11,640.00 administratively approved by the City Manager on April 6, 2005, provided for survey and design of additional water line improvements beyond the scope of the original contract; ttp://apps.cfwnet.org/council_packet/mc—review.asp?ID--i 1856&councildate=8/4/2009 8/5/2009 IVIM%, Yage 2 or Amendment No. 6 approved by M&C C-21149 on November 15, 2005, in the amount of$23,744.00 provided for engineering design and survey for the replacement of severely deteriorated sewer main M-132 located within the project limits; and Amendment No: 7 in the amount of $24,280.00 administratively approved by the City Manager on September 8, 2006, provided for the replacement of sewer lateral, L-3246, the preparation of a traffic control plan and the separation of plans and specifications into three separate construction documents. Amendment No. 8 will provide compensation for the following: Additional design and survey services for the relocation of severely deteriorated sanitary sewer currently located on inaccessible private property into the following public streets: Street From To University Drive Wingate Street White Settlement Road Adrian Drive Wingate Street White Settlement Road Redesign of the 30 inch sanitary sewer main located at the Carroll Street/7th Street intersection due to conflict with a previously unknown AT&T duct bank; Additional easement preparation on the project; and Additional project coordination. Lockwood, Andrews& Newnam, Inc., proposes to perform these additional services for a lump sum fee of $50,937.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the amount requested, $5,000.00 is required for project management, real property services and utility coordination. Lockwood, Andrews & Newnam, Inc., is in compliance with the City's M/ BE Ordinance by committing to an additional 15 percent M/ BE participation on this Amendment No. 8. The City's goal on this Amendment No. 8 is 15 percent. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATIONICERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and the adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund. The amendment corresponds to engineering services that Lockwood, Andrews & Newnam, Inc. (LAN) has performed beyond the original contract scope with respect to the Part 1 and Part 3 plans for sanitary sewer main replacement in the proximity of White Settlement Road, Wimberly St., Tillar Street and Carroll Street. All of the work described in this Amendment relates to sanitary sewer rehabilitation. I. Redesign In Carroll Street at 7'e Street A new 12" and 30" sewer main was constructed on the Montgomery Wards Site at the corner of 7th Street and Carroll Street in conjunction with the new development as Part 1 of this contract. Approximately 70 If of 30" sanitary sewer remained unfinished in the intersection of these streets. This portion of the Part I plans was not constructed with the original contract for Part l due to an electrical duct bank found to be in conflict with a 30" sewer main connecting in 7'h Street. The duct bank nuns north from 7'h in Carroll Street and proved difficult to relocate or cross with the 30" sewer. LAN modified the original plan sheets for Line A and Laterals A-I, A-2 and A-3 to create a single plan sheet showing the extension of these lines that would be constructed as Addendum No.I to the original contract for Part 1 in June of 2006. The duct bank was to be adjusted to allow the construction of these lines, extending them to the west side of Carroll Street. Addendum No. I was not constructed. The original design called for a 30" sewer line to connect to a manhole in 7'h Street, as mentioned above. An 18" line would be extended west in 7'"by another consultant and an 8"line would connect to the south side of West 7'h Street. Due to the conflict with the electrical duct bank, the 30" had to be terminated on the north side of Carroll Street. The design was modified in the April of 2008 to facilitate the connection to the manhole in 7'h. LAN designed an 8" sewer that crossed over the electrical duct bank to connect the manhole in 7'h street to the 30" Sewer. This plan required an additional manhole on the east side of the duct bank, where the pipe size changes from 30" to 8". The design was subsequently changed back to the 30" pipe. LAN was also required to coordinate the design with other consultants plans to extend the 18"west in 7'h Street. Fee for Item I $3,776 iL include 7'h& Carroll Street Sewers In Part 3 Plans The 30" portion of sewer line in 7'h Street has been built as an addendum to the Part I plans, but laterals A-1, A-2, A-3 and a portion of Line A at 5'h Street were not. it is necessary to include these laterals from Part I with the Part 3 plans that will be let this year to complete the utility work in Carroll Street so that the redevelopment of this thoroughfare can continue. Carroll Street is a 4 lane collector that connects 7'h Street and White Settlement Road. In order to appropriate the ftlnding from the State, it was necessary to modify the Part 3 plans to include the additional lines and laterals. The location map and cover sheet were modified and all the sheets had to be re-numbered. Plotting the Part 3 plan sheets proved to be difficult because files had become outdated when our systems and software were upgraded. The border sheet file also had to be recreated. The plots were delivered to the City in time to get them to Austin for review as required. Fee for Item II $4,036 iii. Update the Right of Entry Forms Right-of-entry exhibits were revised because they are required to be in the City's current format and current ownership must be verified. The ownership for the property in this area changes periodically due to it's proximity with the Trinity River Vision(TRV)project. The ownership has been verified for all lots or parcels. There are currently 29 right-of-entry exhibits. The right of entry exhibits that will be required for Adrian Street and University Drive are not included in these 29 exhibits. They are included, however, in the design task for the new sewer mains in these streets. Fee for Item III $3,675 IV- Bailey Industrial Plaza Design Updates The sewer mains and new service lines located in the Bailey Industrial Park, and specifically between Tillar Street and Cullen Street, immediately east of Foch Street, are required to be in easements because the existing sewer is in an 8' alley that is not accessible. LAN needed to research the project to determine if the easement instruments had been prepared in the past. The design for the mains and services that previously connected in the alley now connects the services to a sewer main in Tillar Street. LAN investigated the basis of the design to determine the justification for the additional construction. A site visit was required to verify and insure physical conditions had not changed. The owner of the Mosites property was contacted to verify that they are still amenable to the proposed plan. The area is heavy industrial, with manufacturing buildings and warehouses covering most the lot making it difficult for the surveyors to locate the property monuments in the field. The alleys are not accessible requiring the field work to be conducted from the streets surrounding of the site. The fee to provide boundary survey for two easements and written legal instruments is$3,520 Fee for Item IV $4,395 V. University Drive and Adrian Street Sewers New sewer mains will be designed in Adrian Street and University Drive between White Settlement Road and Wingate Street. These streets are between the TRV and the Cultural District, a rapidly developing area. These new sewers replace existing sewer mains L-2706, L-2706A and L-2709, located in the middle of the blocks, where alleys may have been. Removing the sewers from the alleys make them more accessible to the city. LAN will also design the sewer services to connect to the rear of the residences and commercial business on these streets so that they will now connect to the new mains in the street right of way. Construction documents will be prepared and added to the plans for Contract 67, Part 3. The additional work will include meetings between the city and LAN, as well as coordination with the property owners to locate the existing service connections and to provide a suitable location for the new sewer services is also included. The additional work also includes right-of-entry exhibits and topographic surveying. A topographic survey has been provided for Adrian Street by the City and it will be utilized for the design. A topographic survey will be required to complete the design for the sewer in University Drive. The fee is$8,800 for the University Drive topographic survey. Fee for Item V $29,471 VI. Revise Construction Documents& Estimates The constriction estimate is required to be updated to utilize current information and to include the additional sewer lines in Carroll Street,Bailey Industrial Park,University Drive and Adrian Street. The Specifications Manual is no longer current and will need to be updated to reflect current standard specifications and notices. The quantities in the contract proposal need to be updated to match the revised plans. LAN has conducted several review meetings with the City to discuss changes and plan for the eventual letting. Meetings have also been conducted with designers and consultants working on the project or adjacent to it, as a matter research and coordination. This increase will adjust the engineering fee from $458,740 to $509,677. A summary of the contract values affected by the amendments including this Amendment No. 7 as proposed herein follows at the bottom of this letter.
