AMENDMENT No.3 TO CITY SECRETARY CONTRACT No. 38180 WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 38180, (the CONTRACT) which was authorized by M&C C-23262 on the 16th day of December, 2008 in the amount of $1, 519, 279. 00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $878, 058 which was authorized by M&C # C-25473 on March 6, 2012; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 2 in the amount of $218, 500 which was authorized by M&C # C-27170 on February 3, 2015; and WHEREAS, the CONTRACT involves engineering services for the following project: Lake Worth Dredging Project; and WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, � m which amends the CONTRACT: C7 n' 1 . C3 Article I of the CONTRACT is amended to include the additional engineering services specified in the attached Scope of Services, a copy of which is attached hereto and incorporated herein. The cost to City C= for the additional design services to be performed by Engineer totals $12, 000. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $2, 627, 837 . 00 . 3. FEASIBILITY STUDY PHASE, PHASE III DREDGING 1. Study of in-lake disposal. a. Research the proposed in-lake disposal of the Phase III Dredging materials. The location of the proposed in-lake disposal is shown on the attached exhibit. The research shall include: i. Estimation of dredge volume, required disposal volume, and available disposal volume at the proposed disposal location. ii. Determination of the anticipated method of delivery of dredged materials to the proposed disposal location. iii. Attending one meeting, including a site visit, with the City to discuss the proposed disposal area and its limitations. 2. Meeting with USACE—Request a meeting to discuss the proposed Phase III dredging project and proposed in-lake disposal. Coordinate, prepare for, attend the meeting with the USACE, and prepare meeting minutes. The objective of the meeting will be to give the USACE an overview of the project and proposed in-lake disposal, receive the USACE's feedback, identify the preferred permitting approach and potential issues, discuss compensatory mitigation requirements(if any),and discuss an estimated timeline for permit authorization. Meeting preparation will include working with design engineers to develop a conceptual disposal layout to present to the USACE. 3.
