AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
AN ALLEY FROM A POINT AT THE EAST LINE OF LOT 22 TO THE
EAST LINE OF LOT D-1 BLOCK 22 BELLAIRE ADDITION AN
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY
TEXAS AS RECORDED IN VOLUMES 1037 AND 902, PAGE 557 OF THE
DEED RECORDS OF TARRANT COUNTY TEXAS, BEING AN ALLEY
APPROXIMATELY 280 FEET LONG AND 25 FEET WIDE, AND
CONTAINING 7,000 SQUARE FEET OR 0.16 ACRES OF LAND;
PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING
THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES,
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That a portion of an alley from a point at the east line of Lot 22 to the east line of Lot D-1
Block 22, Bellaire Add2tion, an addition to the City of Fort Worth, Tarrant County Texas as
recorded in Volumes 1037 and 902, Page 557 of the Deed Records of Tarrant County Texas and
being an alley two hundred eighty (2$0) feet long and twenty-five (25} feet wide and contatmng
7 000 squaze feet, or 0 16 acres of land, and as more specifically described in Exhibits 1 `2
and `3 attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley is hereby released and
shall revert to the adjacent owner as provided by law
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith aze hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Being a portion of a 25 0 foot wide alley right-of-way as it appears on the plat of Bellaire
Addition an addition to the City of Fort Worth as recorded in Volume 1037 Page 557 of
the Deed Records of Tarrant County Texas (D R.T C T) and on the plat of Bellaire
Addition an addition to the City of Fort Worth as Recorded in Volume 902, Page 557 of
the D R.T C T and being more particularly described as follows
Beginning at a 518" iron pin found in place at the northeast corner of Lot D1 of Block 22
of Bellaire Addition an addition to the City of Fort Worth as Recorded in Volume 388-27
Page 41 of the D R.T C T said iron pin being in the north line of Lot C of said Block 22
of Bellaire Addition as Recorded in Volume 1037 Page 557 of the D R.T C T and the
south right-o-way line of said alley
Thence, North 0°02'12" West, a distance of 25.0 feet to a point in the south line of Lot G

RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating a portion of an alley from a point at the east line of Lot 22 to the east line of
Lot D-1 Block 22 Bellaire Addition as recorded in Volumes 1037 and 902, Page 557 D R.T C T being
approximately 280-feet long and 25-feet wide and containing 7 000 square feet or 0 16 acres, and
2. Waive the purchase fee of $48 219 50
DISCUSSION
J B Davies Inc. on the behalf of Texas Christian University (TCU) has requested the above referenced
alley vacation in order to replat it with its adjoining property and use it as a parking lot. The Engineering
Department, Real Property Services Division states that the property has an appraised value of
$48 219 50 Staff recommends waiver of this purchase price since the right-of-way was originally dedicated
by plat and there is no evidence that public funds were expended for the acquisition In addition the
vacation will further the TCU campus master plan that includes $110 million in construction that is underway
with an additional $110 million planned for the future
Reviewing City departments and public utility companies have raised no objections to this request. The City
Plan Commission recommended approval of this request at its meeting on February 22 2006 The alley is
to be retained as a utility easement for all existing utilities An acceptable replat (FS-06-015) has been
submitted
