BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That a portion of Odessa Avenue, being a 50 foot wide by 292 foot long public nght-of way from Bellaire Drive North to West Berry Street, located adjacent to Lot 1 Block 18 T C U Addition, an addition to the City of Fort Worth, Tarrant County Texas as recorded m Cabinet A, Slide 9927 of the Plat Records of Tarrant County Texas and Lots 1 through 6, Block 8 Forest Park Addition, as recorded Volume 310 Page 49 of the Deed Records of Tarrant County Texas, contam~ng 15 125 square feet, or 0.347 acres of land more or less, and as more specifically described in Exhibit 1 `2" and `3 attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby epealed. SECTION 4 That this ordinance shall take effect upon adoption. The Engineering Department, Real Property Services Division states that the property has an appraised value of $141 411 19 Staff recommends waiver of this purchase price since the right-of-way was originally dedicated by plat and there is no evidence that public funds were expended for the acquisition In addition the vacation will support the TCU campus master plan that includes $110 million in construction that is underway with an additional $110 million planned for the future Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on May 24 2006 Any existing utilities will be relocated at the applicant's expense This vacation is located in COUNCIL DISTRICT 9 FISCAL INFORMATION/CERTIFICATION Logname 06VA-06-018 Page 1 of 2 The Finance Director certifies that this action will have no material effect on City funds.
