AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
FORT WORTH, BEING ORDINANCE NO 13896, AS AMENDED CODIFIED
AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH, BY
AMENDING SECTION 4.803 `NONRESIDENTIAL DISTRICT USE TABLE OF
CHAPTER 4, `DISTRICT REGULATIONS" TO RECLASSIFY WHERE
CERTAIN USES ARE ALLOWED• AMEND ARTICLE 1 `STANDARDS FOR
SELECTED USES" OF CHAPTER 5, `SUPPLEMENTAL USE STANDARDS"
TO ADD STANDARD FOR NON ACCESSORY OUTSIDE STORAGE AND
MINI WAREHOUSES, AMEND CHAPTER 9 `DEFINITIONS TO ADD
DEFINITIONS FOR `MASSAGE PARLOR/BATH" `MASSAGE
THERAPY/SPA `OUTDOOR STORAGE" AND `TRANSMISSION
TOWERS PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A
PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR
PUBLICATION AND PROVIDING AN EFFECTIVE DATE
WHEREAS, m 1988 the City Council approved various amendments to the non-
residential uses of the Zoning Ordinance that were codified into the Non-Residential Use
Table of the Zoning Ordinance redraft in 1998 and,
WHEREAS, many non residential uses found m the commercial and industrial
distracts of the Zoning Ordinance have continued to constitute conflicts with residential
uses, or uses have become obsolete and new uses have not been defined or accounted
for• and
WHEREAS, the Zoning Commission created a special study group consisting of
interested citizens and commercial property interests to evaluate the impacts of the non-
residential uses on residential developments, and,
WHEREAS, these recommendations have been forwarded to and endorsed by the
City Council Central City and Economic Development Committee for consideration as a
text amendment.
NOW THEREFORE, SE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS
SECTION 1.
Section 4 803 `Nonresidential Use Table of Article 8 `Nonresidential District
Use Table of Chapter 4 `District Regulations" of Ordinance No 13896, the zoning
ordinance of the City of Fort Worth, is hereby amended as set out in Exhibit A attached
and hereby incorporated into the Zoning Ordinance to include the following revisions for
the listed Uses
1 Public and Civic Uses
Government:
Museum -Delete reference to government operated
Health Care Facilities
Assisted Living -Add to E, F R, F G and H Districts
Massage Therapy/Spa -Add to E thru K Districts as a permitted
use, provide definition as medical treatment
Health or Recreation Club -Add to E District
Nursing Home -Add to E District
Recreation.
Community Center -Delete government operated
Golf Driving Range -Delete from E R, E and MU 1
Distracts
Playground -Add to E, F R thru I Districts
Religious
Place of Worship Auxiliary Use Require Special Exception m
Commercial up to the G District and AG District, allow by right m
H thru industrial Districts.

Furniture Sales (new and used) -combine into one use and add m FR District

SECTION 2.
Article 1 `Standards for Selected Uses" of Chapter 5 `Supplemental Use
Standards" of Ordinance No 13896 the Zoning Ordinance of the Crty of Fort Worth, is
hereby amended to add a new section for development standards for non-accessory
outside storage, Section 5 133 `Storage, Non-accessory Outside to read as follows
Section 5.133. Storage, Non Accessory Outside
Storage of articles, material or merchandise not customarily incidental to
the primary or main use or activity of the property may be kept or stored
outside the primary building m accordance with use tables m Chapter 4
Article 8 subject to the following:
The Board of Adjustment my grant a special exception for no more than 5
years for non-accessory outside storage m accordance with the
requirements set forth for special exceptions m Chapter 3 Article 3
provided, however that m granting any such special exception the Board
of Adjustment shall require the following•
1 The storage must be secured from vandalism, theft or other
mischievous acts.
2. The storage must be surrounded by a screen fence a
minimum of six feet m order to screen the storage from
public view No material may be visible above the required
screen fence
3 The storage may not be placed m any area which will
interfere with the natural flow of storm water drainage
4 No storage of unregistered motor vehicles wrecked or
dismantled vehicles or vehicles being retained for the
purpose of removing or using parts thereof shall be
permitted.

SECTION 3.
Article 1 `Standards for Selected Uses" of Chapter 5 `Supplemental Use
Standards" of Ordinance No 13896 the zoning ordinance of the Crty of Fort Worth, is
hereby amended to renumber Sections 5 133 through 5 142 to read as follows
5 133 Storage, Non-accessory Outside
5 134 Store, Large Retail
5 135 Swimming Pool, Commercial
5 136 Telecommunications Antenna
5 i 37 Telecommunications Tower and Stealth Telecommunications Tower
5 138 Theater Movie Theater or Auditorium
5 139 Terminal Truck, Freight, Rail or Water
5 140 Utility Transmission Tower or Distribution Line
5 141 Vehicle Junkyard
5 142 Veterinary Chmc

SECTION 4

attached and hereby incorporated into the Zoning Ordinance to reflect the renumbered
Sections 5 133 through 5 143 of Article 1 `Standards for Selected Uses" of Chapter 5
`Supplemental Use Standards"
SECTION 5.
Section 5 104 Auto Repair Paint and Body Shop" of Article 1 `Standards for
Selected Uses" of Chapter 5 `Supplemental Use Standards" of Ordinance No 13896,
the Zoning Ordinance of the City of Fort Worth, is hereby amended to amend subsection
6 to read as follows

Section 5.104, Auto Repair Paint and Body Shop
6 Any property used as an automotive repair paint or body shop located
m a `MU 2 `MU 2G `I" J" or `K District must comply with
subsections 2 and 5 above Further such facilities located m an `MU 2"
or MU 2G District must also comply with Section 9 1001.D 7 (Fences
and Gates) of the respective districts.
SECTION 6.
Section 4.305 C `Specific Commercial Uses Permitted m `PD" District Only" of
Chapter 4 District Regulations, Article 3 Planned Development ("PD") District of
Ordinance No 13896 the Zoning Ordinance of the Crty of Fort Worth, is hereby
amended to add a new subsection, subsection 5 `Mini Warehouse as an allowed use
SECTION 7
Chapter 9 `Definitions" of Ordinance No 13896 the zoning ordinance of the
City of Fort Worth, is hereby amended to add definitions for massage parlors and
message therapy outdoor storage and transmission towers to read as follows
Massage Parlor/Bath -Any commercial business, unrelated to a sexually oriented
business operation, which provides massage treatment of anon-sexual nature by a
licensed masseuse as a primary service
Massage Therapy/Spa -Any medical or therapeutic practice unrelated to a sexually
oriented business operation operated by or employing licensed psychologist,
physicians, physical therapists, registered nurses, chiropractors, licensed practitioners
or athletic trainers engaged m the practice of healing arts and the treatment of disease,
ailments and disorders of the body
Outdoor Storage -outdoor storage of any inert material or goods that would not be a
nuisance or offensive due to odor fire, health or other restriction of Crty Code, and
excluding trash, dunk, garbage, salvaged waste or materials.
Transmission Tower - a tower and ancillary support equipment providing
transmissions via radio TV infrared or other similar means of signal transmission
between towers and receivers.

SECTION 8.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of
the City of Fort Worth, Texas (1986), as amended, except where the provisions of this
ordinance are m direct conflict with the provisions of such ordinances and such Code, m
which event conflicting provisions of such ordinances and such Code are hereby
repealed.
SECTION 9
It is hereby declared to be the intention of the Crty Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
Crty Council without the incorporation m this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 10.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses
to comply with or who resists the enforcement of any of the provisions of this ordinance
shall be fined not more than Two Thousand Dollars ($2,000 0.0) for each offense. Each
day that a violation exists shall constitute a separate offense

SECTION 11.
All rights and remedies of the Crty of Fort Worth, Texas, are expressly saved as to
any and all violations of the provisions of Ordinance No 3011 Ordinance No 13896 or
any other ordinances affecting zoning which have accrued at the time of the effective date
of this ordinance, and, as to such accrued violations and all pending litigation, both civil
and criminal, whether pending m court or not, under such ordinances, same shall not be
affected by this ordinance but may be prosecuted until final disposition by the courts.
SECTION 12.
The Crty Secretary of the Crty of Fort Worth, Texas, is hereby directed to publish
the caption, penalty clause and effective date of this ordinance for two (2) days m the
official newspaper of the Crty of Fort Worth, Texas, as authorized by Section 52.013
Texas Local Government Code
SECTION 13.
This ordinance shall take effect upon passage and publication as required by law
