AN ORDINANCE ORDERING A SPECIAL ELECTION BY THE
QUALIFIED VOTERS OF THE CITY OF FORT WORTH, TEXAS, ON
TUESDAY THE 7TH DAY OF NOVEMBER, 2006, ON THE QUESTION
OF WHETHER THE CITY OF FORT WORTH SHOULD BE
AUTHORIZED TO RECOGNIZE AN EMPLOYEE ASSOCIATION AS A
SOLE AND EXCLUSIVE BARGAINING AGENT FOR THE MUNICIPAL
POLICE OFFICERS AND AUTIiORIZING THE CITY OF FORT
WORTH TO MAKE AGREEMENTS WITH THE EMPLOYEE
ASSOCIATION AS PROVIDED BY LAW
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT 'WORTH,
TEXAS
SECTION 1.
In compliance with the Charter of the City of Fort Worth and in accordance with the
Constitution and Iaws of the State of Texas, the City Council hereby orders that an election be
held on Tuesday November 7 2006, as authorized by Section 41 001 of the Texas Election
Code, at which all qualified voters of the City of Fort Worth may vote on the question of whether
the City of Fort Worth should be authorized to recognize an employee association as a sole and
exclusive bargaining agent for the municipal police officers and authorizing the City of Fort
Worth to make agreements with the employee associations as provided by law
SECTION 2.
That the City Secretary shall ensuxe that the ballots are prepared for said election. The
ballots shall be printed in English and in Spanish for use in said election. The ballots shall
contain the proposition to be voted upon in accordance with Section 143.3015 of the Texas Local
Government Code:
PROPOSITION
Authorizing the. Crty of Fort Worth to recognize an employee association as a sole
and exclusive bargaining agent for the municipal police officers and authorizing the
Crty of Fort Worth to make agreements with the employee association as provided
by state law
SECTION 3.
That the official ballots to be used in such election shall be prepared m accordance with
Sections 52 072 and 52 073 of the Texas Election Code, as amended. The ballots shall permit
the electors to vote `For" or Against" the aforesaid proposition and shall be set forth in
substantially the following form.

(h) The Office of the Tarrant County Elections Administrator Tarrant County
Courthouse, 100 Weatherford, Fort Worth, Texas, is hereby established as the Central Counting
Station for the ballots cast in said election.
(i) Steven Vickers, having knowledge and experience m the conduct of elections
with the electronic voting system for which the Central Counting Station is established, and
being a registered voter of the City of Fort Worth, is hereby appointed as the Manager of the
Central Counting Station. The Manager shall be in charge of overall administration of the
Central Counting Station and the general supervision of the personnel working at the Station.

(j) Christopher Walker and Gayle Hamilton, being trained in the operation of the
automatic tabulating equipment installed at the Central Counting Station, are hereby appointed
Tabulation Supervisors. The Tabulation Supervisors shall be m charge of the operation of the
automatic tabulating equipment.
(k) The appointment of Leo Angell as Assistant to the Tabulation Supervisor is
hereby approved. He shall assist the Tabulation Supervisor in the operation of the automatic
tabulating equipment as directed by the Tabulation Supervisor
(1) Jeanne Lyons is hereby appointed as Presiding Judge of the Central Counting
Station. She shall maintain order at the Central Counting Station and shall have such authority
as may be prescribed by the Texas Election Code
(m) The polling places, on election day shall be kept open on November 7 2006
from 7 00 a.m. to 7 00 p.m. and that due return shall be made to the City Council showing the
number of votes cast on the proposition.
(n) The locations of the polling places for the election on the proposition, except
insofar as they may be changed by the Crty Council, are set forth on Exhibit A attached hereto
and made a part hereof.
SECTION 5.
(a) This Section shall only apply to the conduct of voting in Denton County

SECTION 7
That the Crty Secretary of the City of Fort Worth shall be responsible for conducting the
election, and shall furnish the election officials said ballots and voting equipment, together with
any other forms, blanks or instruction m accordance with the laws of the State of Texas, insofar
as same are applicable, and with the provisions of this resolution.
SECTION 8.
This ordinance shall constitute the proclamation, call, notice and ordinance calling and
ordering said elections.
SECTION 9
That notice of said elections shall be given by• (1) publishing a copy of this ordinance, m
English and m Spanish, at least once, not earlier than the 30th day or later than the 10th day before
election day m a newspaper published m said Crty• and (2) not later than the 21St day before
election day posting a copy of this ordinance, m English and in Spanish, on the City's board
used for posting notices of the meeting of the Fort Worth Crty Council.
SECTION 10.
That the way and manner of holding said elections, the notice to be given therefore, the
polling places, the personnel and the officers who are to hold same, and all details connected
with the holding of the elections shall be provided for and arranged by the City Secretary that
the proper notice and publication of this notice, proclamation and ordinance shall be only
cumulative of and m addition to the statutory notice of said elections as herein provided, and that
any omission or irregularity m this notice or in the publication or posting of this notice,
proclamation and ordinance, or in the signing of same, shall not m any way affect or invalidate
such election.

SECTION 11.
That in all respects, said elections shall be conducted in accordance with the Texas
Election Code and the City Charter of the City of Fort Worth.
SECTION 12.
That it is hereby officially found and determined that the meeting at which this ordinance
was adopted and said elections were called was open to the public and public notice of the time,
place and purpose of said meeting was given, all as required by Chapter 551 of the Texas
Government Code.

That this ordinance, election order, proclamation and notice shall take effect upon
adoption.
