AN ORDINANCE DECLARING CERTAIN FINDINGS PROVIDING FOR THE
EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT
WORTH PROVIDING FOR THE ANNEXATION OF AN APPROXIMATELY
0 833 ACRE TRACT OF LAND SITUATED IN THE JOSE CHIRINO
SURVEY ABSTRACT NUMBER 265 TARRANT COUNTY TEXAS (CASE
NO AX-06-005) WHICH SAID TERRITORY LIES ADJACENT TO AND
ADJOINS THE PRESENT CORPORATE BOUNDARY LIMITS OF FORT WORTH
TEXAS PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS
PRO RATA PART OF TAXES PROVIDING THAT THE INHABITANTS
THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF
FORT WORTH TEXAS PROVIDING THAT THIS ORDINANCE SHALL AMEND
EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES
NOT IN DIRECT CONFLICT PROVIDING FOR SEVERABILITY AND
NAMING AN EFFECTIVE DATE
WHEREAS the territory hereinafter described and proposed for
annexation is less than one-half mile in width and
WHEREAS the territory hereinafter described is vacant and
without residents or on which fewer than three registered voters
reside and
WHEREAS the City of Fort Worth has received a petition in
writing requesting the annexation of the area and
WHEREAS the population of the City of Fort Worth Texas is in
excess of 100 000 inhabitants and
WHEREAS the hereinafter described territory lies within the
exclusive extraterritorial jurisdiction of the City of Fort Worth
Texas and
WHEREAS the hereinafter described territory lies adjacent to and
adjoins the City of Fort Worth Texas and
WHEREAS the hereinafter described territory contains
Approximately 0 833 acres of land (0 001 square miles) of land
more or less
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH TEXAS
SECTION 1
That the following described land and territory lying adjacent
to and adjoining the City of Fort Worth Texas is hereby added to
and annexed to the City of Fort Worth Texas and said territory
hereinafter described shall hereafter be included within the
boundary limits of the City of Fort Worth Texas and the present
corporate boundary limits of said City at the various points

contiguous to the area hereinafter described are altered and
amended so as to include said area within the corporate limits of
the City of Fort Worth Texas to-wit
COMMENCING at a 5/8 inch iron rod found in the easterly line of
said Christ s Haven for Children tract and at the southwest
corner of that tract of land described by deed to Centex
Homes and recorded in County Clerk s Filing Number
D204097072 said County Records

Centex Homes tract and the easterly line of said Christ s

That the above described territory hereby annexed shall be

part of the City of Fort Worth Texas and the property so added
hereby shall bear its pro rata part of the taxes levied by the City
of Fort Worth Texas and the inhabitants thereof shall be entitled
to all of the rights and privileges of all the citizens in
accordance with the Service Plan and shall be bound by the acts
ordinances resolutions and regulations of the City of Fort Worth
Texas
SECTION 4
That the Service Plan attached hereto as Exhibit X was made
available for inspection by and explanation to the inhabitants of
the area to be annexed and is approved and incorporated into this
ordinance for all purposes
SECTION 5
That this ordinance shall and does amend every prior ordinance
in conflict herewith but as to all other ordinances or sections of
ordinances not in direct conflict this ordinance shall be and the
same is hereby made cumulative
SECTION 6
That it is hereby declared to be the intent of the City
Council that the sections paragraphs sentences clauses and
phrases of this ordinance are severable and if any phrase clause
sentence paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction such unconstitutionality shall not affect
any of the remaining phrases clauses sentences paragraphs and
sections of this ordinance since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any unconstitutional phrase clause sentence paragraph or
section
SECTION 7
That should this ordinance for any reason be ineffective as to
any part or parts of the area hereby annexed to the City of Fort
Worth the ineffectiveness of this ordinance as to any such part or
parts shall not affect the effectiveness of this ordinance as to
the remainder of such area The City Council hereby declares it to
be its purpose to annex to the City of Fort Worth every part of the
area described in Section 1 of this ordinance regardless of
whether any part of such described area is hereby not effectively
annexed to the City Provided further that if there is included
within the description of territory set out in Section 1 of this
ordinance to be annexed to the City of Fort Worth any area which is
presently part of and included within the limits of the City of
Fort Worth or which is presently part of and included within the
limits of any other city town or village or which is not within
the City of Fort Worth s jurisdiction to annex the same is hereby

excluded and excepted from the territory to be annexed hereby as
fully as if such excluded and excepted area were expressly
described herein

That this ordinance shall take effect upon adoption

Property Subject to Plan. Approximately 0.833 acre tract of land situated in the Jose Chirino
Survey Abstract Number 265 Tarrant County Texas, and being a
portion of that tract of land described by deed to Christ's Haven for
Children and recorded in Volume 7856, Page 1027 of County Records,
Tarrant County Texas.
Location and Acreage: Approximately 0 833 acres of land in Tarrant County located South of
Keller Haslet Rd. and east of Caylor Rd. (AX-06-005 Park Vista Blvd.)

Municipal ervices to the Annexation Area will be furnished by behalf of the City of Fort Worth, T xas, at the
following levels nd rdance with the following ervice plan programs.
1. PROGRAM FOR SERVICES TO BE PROVIDED ON THE EFFECTIVE DATE OF THE
ANNEXATION
The City will provide the following ervices the Annexation Area the effective date of the ation, nless
otherwise oted.
A. Police Protection
The Fort Worth Police Department will provide protection nd law nforcement ervices the Annexation
Area ommencing the effective date of ation. The ervices will clude:
Normal patrols nd sponses to alls for ervice
Handling of offense nd ident eports
Special its, ch traffic nforcement, iminal stigations, otics law nforcement,
gang uppression, nd ime sponse team deployment when equired.
These ervices provided itywide basis. The will itially be ombined with sting Police
Reporting Area (PRA), 0300 The will be Neighborhood Policing District 3 Beat C17
B Fire Protection
Fire protection ervices will be provided by sting personnel and equipment of the Fort Worth Fire
Department. These ervices will be provided based upon ilable water ad nd street nditions, nd
distances from sting fire stations. Services will be provided to the annexation commencing the
effective date of the ation. These ervices clude:
Basic Life Support (BLS) 1st sponder emergency medical ervices
Fire uppression nd
Hazardous materials mitigation and egulation;
Dive

Fire Safety Education,
Aircraft/rescue/firefighting;
Fire protection system plan ew•
Inspections;

These ervices _ provided itywide basis. All Fort Worth firefighters ertified by the T xas
Commission Fire Protection.
On the date of ation, the first sponding fire ervices will ome from Fire Station 37 located at 4721
Ray White Road. The nd sponding fire ompany will be from Fire Station 35 located at 2201 Flight
Line Road. The Fire Department stimates the spouse time to be 9.5 nd 10 7 minutes, spectively
C. Emergency Medical Services -Basic Life Support
Basic Life Support (BLS) emergency medical ervices by sting personnel nd equipment of the Fort
Worth Fire Department will be provided to the ation commencing the effective date of the
annexation. The Fort Worth Fire Department erves as the first sponder life threatening medical
emergencies as part of the MedStar system. All Fort Worth Fire Department personnel ertified
Emergency Medical T chnician basic level higher All ngines, trucks, nd its carry
Automated External Defibrillators for with ctims who rdiac arrest.
D Emergency Medical Services -Advanced Life Support
Advanced Life Support spouse provided by MedStar greater than 9 minutes to the proposed ation
with potential of at least 30-minute transport time to the st trauma nter
E. Solid Waste Collection
Solid waste ollection shall be provided to ngle family nd duplex idential its the Annexation
Area rdance with sting City rdinances nd policies ommencing the effective date of the
ation. Private olid waste ervice providers nder ntract with the City will provide waste ollection
ervices to these idences. Persons living the idential its ng the ervices of privately owned
olid waste management ervice provider other than the City' ntracted ervice provider may ntinue to
ch ervices ntil the nd anniversary of the ation.
Private ervice providers at the discretion of the stomer may provide olid waste ollection ervices for
businesses nd multi-family dwelling omplexes having three more its. Private olid waste ollection
providers must have ctive Grant of Privilege to provide ervice within the ity limits.
F Operation and Maintenance of Water and Wastewater Facilities
The ation Area located the CCN of the City of Fort Worth. The City will provide water nd
ewer ervice to the Annexation Area, at the developer' st, rdance with the `Installation Policy of
Community Facilities"
G Operation and Maintenance of Roads and Streets Including Street Liehtin_g
The following ervices will be provided the Annexation Area ommencing the effective date of the
annexation, mess otherwise oted.
The T sportation nd Public Works Department will ume maintenance of public streets which
the City has jurisdiction. These ervices elude emergency pavement epair nd epair maintenance of
public streets as-needed basis. Public streets will be eluded in the City' preventive maintenance
program. Preventive maintenance projects prioritized City-wide basis nd cheduled based
ariety of factors, eluding rface ndition, ide ability age, traffic olume, functional class, and
ilable funding. Any ary ehabilitation struction will be idered nd prioritized
itywide basis.
Streetlights stalled improved public streets shall be maintained by the City of Fort Worth
rdance with urrent City policies. Other street lighting shall of be maintained by the City of Fort
Worth.
The T sportation and Public Works Department will also provide egulatory ignage ervices the
Annexation Area. T affic ignal, stop, nd all other egulatory studies are nducted in njunction with
growth of traffic olumes. All egulatory igns nd ignals stalled when warranted following an

H. Operation and Maintenance of Parks, Playgrounds, and Swimmine Pools
Residents of this property may utilize all sting parks red ommunity ervice facilities throughout the
City beginning with the effective date of the ation. Existing parks, playgrounds, swimming pools
red other ational red community facilities within the Annexation Area that private facilities will
be affected by the annexation.
Existing parks, playgrounds, swimming pools red other ational red ommunity facilities within this
property shall, upon deeding to red eptance by the City red appropriations for maintenance red
operations, be operated by the City of Fort Worth, but of otherwise.
Operation and Maintenance of Anv Other Publicly Owned Facility Building or Service.
In the nt the City cquires ny other facilities, buildings ervices ary for municipal ervices
located the Annexation Area, the appropriate City department will provide maintenance ervices.
2. PROGRAM FOR PROVIDING ADDITIONAL SERVICES
In addition to the ervices identified above, the following ervices will be provided the Annexation Area the
effective date of the ation, nless otherwise oted.
A. The idents of the Annexation Area will library ervices from the Fort Worth Public Library
ommencing the effective date of the ation.
B. The City will provide general municipal administration red administrative ervices.
C. The T sportation red Public W rks Department will provide drainage maintenance ervices the
Annexation Area at urrent itywide ervice levels. The City will assume maintenance for all public
drainage channels within dedicated public drainage ements.
The T sportation red Public Works Department will provide the following ervices:
Storm ewer maintenance;
Watershed development ew red spection.
The Environmental Management Department will provide the following ervices.
Emergency spills and pollution omplaint sponse;
Storm ewer discharge pollution prevention Water quality sments for eks.
The Department of Engineering will provide reformation elating to flood plains.
D Enforcement of the City's ode red onmental health rdinances red egulations, that dude but of
limited to: high grass and weeds, trash red debris, olid waste, trash art red illegal dumping, junk red
abandoned ehicles, zoning, food handlers rdinance, red imal ntrol will be provided
within the Annexation Area the effective date of the ation. Complaints of rdinance egulation
olations within the will be swered red stigated by sting personnel within the appropriate
department beginning the effective date of the annexation.
E. The City's building, plumbing, mechanical, electrical, and all other construction odes will be nforced
within the Annexation Area beginning with the effective date of the ation.
F The City's ng, ubdivision, ign, manufactured housing, junk yard red other rdinances shall be
nforced the Annexation Area beginning the effective date of the annexation.

G All spection ervices furnished by the City of Fort Worth, but of mentioned above, will be provided to
the Annexation Area beginning the effective date of the ation.
3. PROGRAM FOR PROVIDING FULL MUNICIPAL SERVICES WITHIN 2-'/z YEARS
In addition to the ervices listed above, the City will provide full .municipal ervices to the Annexation Area
ommensurate with the levels of ervices provided other parts of the City ept if differences topography land
nd population density stitute ufficient basis for providing different levels of ervice, later than two
nd -half (2 ''/z) years after the effective date of the annexation. If full municipal ervices of be ably
provided within the aforementioned time period, the City will propose chedule for providing id ervices within
period of four nd -half (4-%z) years after the effective date of the ation, nd/or upon ommencement of
development of ubdivision within this property whichever later

full municipal ervices for the Annexation Area of be ably strutted within the aforementioned time
period, the City will propose chedule for providing id ervices within period of four nd -half (4-''/z) years,
nd/or upon ommencement of development of ubdivision within this property whichever later

be given to strutting ew stations nd staffing ew facilities prior to final decision to complete
ation. Fire Station 38, when opened mid-2006, at the ntersection of Park Vista nd State Highway

C. Solid Waste Collection. No apital improvements ary at this time to provide olid waste
ollection ervices to the Annexation Area.

owner rdance with provisions of the City' Subdivision Ordinance, Policy for Installation of
Community F ilities nd other applicable policies, rdinances, nd egulations will xtend water nd

Recreation nd Open Space Master Plan nd appropriation of Should additional idential
development parkland dedication, ighborhood park development nd ighborhood park

Subdivision Ordinance.
Other Publicly Owned Facilities, Building or Services: Additional Services. In general, other City
functions nd ervices, nd the additional ervices described above be provided for the Annexation
Area by ng sting apital improvements. Additional apital improvements of ary to

5. IMPACT FEES
Notwithstanding ny other provision of this ervice plan, landowner within the Annexation Area will of be
equired to fund apital improvements ary to provide municipal ervices manner stent with
Chapter 395 of the Local Government Code governing impact fees, nless otherwise agreed to by the landowner

RECOMMENDATION
It is recommended that the City Council institute and adopt attached ordinance for the voluntary annexation
of approximately 0 833 acres of land located south of Keller Haslet Road and east of Caylor Road in Tarrant
County
DISCUSSION
Carter and Burgess on behalf of Centex Homes, has requested the voluntary full purpose annexation of
0 833 acres of land in Tarrant County The property currently vacant, is a portion of the future Park Vista
Boulevard This portion of Park Vista Boulevard will be adjacent to the Timberland Addition a residential
subdivision platted within the Fort Worth City Limits This acreage is less than one-half mile in width is
contiguous to the City of Fort Worth and is vacant and without residents, or on which fewer than three
registered voters reside Therefore it qualifies for annexation under the procedures set out in the Local
Government Code Section 43 028
The subject property is situated within the exclusive Extraterritorial Jurisdiction of the City of Fort Worth
The eastern boundary of this property is contiguous with the City of Fort Worth
OPERATIONAL IMPACT -The Police Department has estimated an impact of $153 due to anticipated calls
for service to the proposed annexation area
LOCATION -The subject property is located located south of Keller Haslet Road and east of Caylor Road
in Tarrant County
If annexed this property will become a part of COUNCIL DISTRICT 2
