AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS I
IN THE GRANTS FUND IN THE AMOUNT OF$15,000.00, SUBJECT TO RECEIPT OF A
GRANT FROM MONARCH UTILITIES I, L.P., FOR THE PURPOSE OF FUNDING A
WATER UTILITY ASSISTANCE PROGRAM; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; I
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN I
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:

SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the '
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Grants Fund in the amount of$15,000.00, subject to receipt of a grant from Monarch Utilities 1, L.P., for the
purpose of funding a water utility assistance program.
SECTION 2.

That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said priorordinances and appropriations are hereby expressly repealed.

Authorize Execution of an Agreement and Acceptance of Funds from Monarch Utilities I, L.P., in an

Water Utility Assistance Program and Adopt Appropriation Ordinance (NO COUNCIL DISTRICT)

RECOMMENDATION:
It is recommended that the City Council: i
i
1. Authorize execution of an Agreement with Monarch Utilities I, L.P., for administration of a Water Utility
Assistance Program by the Community Action Partners in the Parks and Community Services i
Department;
I
2. Authorize the acceptance of Water Utility Assistance Program funds from Monarch Utilities I, L.P., in an
amount up to $15,000.00 for the remainder of Fiscal Year 2015 and up to $50,000.00 in future fiscal
years; and f

3. Adopt the attached appropriation ordinance, increasing estimated receipts and appropriations in the
Grants Fund by up to $15,000.00 for Fiscal Year 2015, subject to receipt of the grant.
DISCUSSION:
Monarch Utilities I, L.P. (Monarch), provides water services to citizens of Tarrant County and has
developed a water utilities assistance program to assist its low-income customers who are experiencing p
financial distress to meet their water utility costs. In September of 2011, the City executed an Agreement
with Monarch to help administer Monarch's water utility assistance program (M&C C-25065, revised; City i
Secretary Contract No. 42301). Monarch and Staff desire to continue this relationship through the I
execution of a new Agreement (Agreement). i

The Community Action Partners (CAP) in the Parks and Community Services Department serves as the
designated community action agency for all of Tarrant County, in accordance with federal law. CAP ;
administers programs funded by Community Services Block Grants and the Comprehensive Energy
Assistance Program as well as utility assistance programs funded by utility companies.
CAP will process applications, determine income eligibility and administer the funds. Payment assistance
.under the Agreement will be available to Monarch customers only. Monarch has informed CAP that funds
of up to $15,000.00 are available for the remainder of Fiscal Year 2015 and that up to $50,000.00 will be
available in future fiscal years. This Agreement will begin on execution by the parties and continue . 1
through December 31, 2015 and will include two, one-year renewal options. Within 60 days prior to the
expiration of the then current term, either party shall provide written notice of its intent to renew the
Agreement. Either party may terminate the Agreement following 30 days written notice.

FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations,
receipt of the grant and adoption of the appropriation ordinance, funds will be available in the current
operating budget, as appropriated, of the Grants Fund. The Parks and Community Services Department
is responsible for the collection and deposit of funds donated to the City and the validation of the
availability of funds without exceeding existing appropriations.
