HomeMy WebLinkAboutOrdinance 21764-06-2015 Ordinance No. 21764-06-2015 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL DONATONS CAPITAL PROJECTS FUND IN THE AMOUNT OF $68,027.35, SUBJECT TO RECEIPT OF FUNDS FROM THE PLAYGROUND UNLIMITED MAINTENANCE ENDOWMENT FUNDS, FOR THE PURPOSE OF FUNDING RENOVATIONS TO THE PLAYGROUND AT PATRICIA LEBLANC PARK; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Donations Capital Projects Fund in the amount of$68,027.35, subject to receipt of funds from the Playground Unlimited Maintenance Endowment Fund, for the purpose of funding renovations to the playground at Patricia LeBlanc park. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. r SECTION 4. Accept the Playground Unlimited Maintenance Endowment funds in the amount of$68,027.35 for the renovation of the playground at Patricia LeBlanc Park; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Donations Capital Projects Fund in the amount of$68,027.35, subject to receipt of the funds. DISCUSSION: On February 18, 1992, (M&C G-9515) the City Council accepted a gift of an accessible playground for Patricia LeBlanc Park from Playground Unlimited, Inc. (Playground Unlimited). Playground Unlimited is a Fort Worth based non-profit corporation that was formed to raise funds to build this project. This playground was considered unique at the time because it permitted access for the mobility-impaired and was designed to encourage side-by-side play for persons with and without disabilities. This playground received national attention for being the first to implement, what is today called 'Universal' design methodology, which considers play opportunities for all types of disabilities - mental, physical and sensory. As part of the original construction, $20,000.00 from the 1986 Park Bond Fund was used to install security lighting and construct additional parking spaces. Upon construction completion and subsequent dedication of the facility to the City, a maintenance endowment in the amount of$50,000.00 was started and administered by a private entity. Over the past 23 years, the timber playground has been maintained by the Parks and Community Services Department (PACSD), enduring many touch-ups and part replacements. The typical life span for this type structure (wood/timber) is 20 years, after which time the wood begins to splinter, warp and fastening hardware becomes loose. As the amount of repairs increased and the need to remove unsafe elements of the structure increased, it was determined that the replacement of this original structure needed to be a priority in the 2014 Bond Program. This project is included in the 2014 Bond Program. Available resources within the General Fund were used to provide interim financing until debt is issued. Once debt associated with this project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing Official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 21241-05-2014). The 2014 Bond Program included $2,600,000.00 for playground improvements at 16 sites, of which $460,000.00 was identified for replacement of the playground at Patricia LeBlanc Logname: 80PATRICIA LEBLANC PARK ENDOWMENT Page I of 3 Park. The project also includes a $48,329.22 disbursement from the Park System Endowment Gas Lease Fund (M&C G-18401). In May 2014, Staff began design conversations with several individuals associated with the original playground design and construction for the design of the new playground. These individuals are also the executors over the endowment fund that was set up with the original development. It was determined that the endowment fund, originally setup for maintenance of the wood/timber play pieces, would be liquidated and dedicated for the replacement playground. The value of the endowment fund at time of liquidation was $68,027.35. PACSD received the balance of funds in late March 2015 from the Community Foundation of North Texas and intend to apply it to the construction of the new playground at Patricia LeBlanc Park.
