ORDINANCE NO. 21769-06-2015 AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY SITUATED IN THE PLEASANT MOORE SURVEY, ABSTRACT NO. 389 AND THE ANDREW T. CARD SURVEY, ABSTRACT NO. 1008, TARRANT COUNTY, TEXAS, LOCATED IN BLOCK 48, ROSEN HEIGHTS, 1sT FILING, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN INSTRUMENT NO. VOLUME 106, PAGE 56 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY 12,000 SQUARE FEET ACRE OR 0.275 ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That an alley, twenty feet in width, situated the Pleasant Moore Survey, Abstract No. 389 I' i and the Andrew T. Card Survey, Abstract No. 1008, located in Block 48 of the Rosen Heights, 1St Filing, Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 106, Page 56 of the Plat Records of Tarrant County, containing approximately 12,000 square feet or 0.275acre of land more or less, and as more specifically described in Exhibit "A" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated alley right of way is hereby released and shall revert to the adjacent owner as provided by law. Card Survey, Abstract No. 389 and the Pleasant Moore Survey, Abstract No. 1008 City of Fort Worth, Tarrant County, Texas DESCRIPTION, of a 12,000 square foot(0.275 acre)tract of land situated in the Pleasant Moore Survey, Abstract No. 389 and the Andrew T. Adopt the attached ordinance vacating an alley between NW 26th Street and NW 27th Street to replat it with the adjoining property for a future building expansion of an elementary school for the Fort Worth Independent School District; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Pacheco Koch., on behalf of the Fort Worth Independent School District, has requested the vacation of this alley to be replatted with the adjoining property for a future expansion of the existing elementary school. The City Plan Commission recommended approval of this request at its meeting on June 25, 2014. An acceptable final Plat (FS-14-096) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance with the City's Policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley. This project is located in COUNCIL DISTRICT 2, Mapsco 62E.
