AN ORDINANCE VACATING, ABANDONING AND
EXTINGUISHING A PUBLIC ACCESS EASEMENT REFERRED
TO AS LOWRIEMORE LANE LOCATED IN THE J. JUSTICE
SURVEY, ABSTRACT NO. 859, IN THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS RECORDED IN COUNTY
CLERK'SINSTRUMENT NO. D212201535 OF THE PLAT
RECORDS, TARRANT COUNTY, TEXAS, AND CONTAINING
APPROXIMATELY 0.577 ACRES OF LAND; AND IN LOT 14R,
BLOCK 1, THE SHOPPES AT RENAISSANCE SQUARE
ADDITION, AS RECORDED IN COUNTY CLERK INSTRUMENT
NO. D212178813 OF THE PLAT RECORDS OF TARRANT
COUNTY, TEXAS AND CONTAINING 0.447 ACRE OF LAND;
PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That a portion of a public access easement referred to as Lowriemore Lane
situated in the J. Justice Survey, Abstract No. 859, in the City of Fort Worth, Tarrant
County, Texas, according to the plat thereof recorded in County Clerk's Instrument No.
D212201535, Plat Records, Tarrant County, Texas, containing approximately 25,144
square feet or 0.577 acres of land, and a portion of a public access easement referred to as
Lowriemore Lane situated in the J. Justice Survey, Abstract No. 859, in the City of Fort
Worth, Tarrant County, Texas, and being a portion of Lot 14R, Block 1, The Shoppes at
Renaissance Square addition, City of Fort Worth, Tarrant County, Texas, according to the
plat thereof recorded in County Clerk's Instrument No. D21278813, Plat Records,
Tarrant County, Texas, and containing 19,475 square feet or 0.447 acres more or less,
and as more specifically described in Exhibits "A" and "B", attached hereto and
Ordinance No.21770-06-2015

incorporated herein by reference, be and the same is vacated, abandoned and
extinguished.
SECTION 2.
That the fee to the land in the above described vacated public access easement is
hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4.
That this ordinance shall take effect upon adoption.

Adopt Ordinance Vacating a Public Access Easement, Lowriemore Lane, to Remove the Public Access
Easement in Renaissance Square (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a public access easement, Lowriemore Lane, to remove the
public access easement in Renaissance Square; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Winklemann and Associates, Inc., on behalf of Renaissance Square LP, has requested the vacation of
this public access easement to be removed from the subject property since it is not being used for
access. The City Plan Commission recommended approval of this request at its meeting on March 25,
2015. The City Plan Commission also approved a waiver of the platting requirement for the northern
portion of the public access easement (see attachment A). An acceptable replat for the southern portion
of the public access easement, (FS-15-023) has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned public access easement during the
platting process. The City does not own any fee interest in the public access easement or own any
property adjacent to the public access easement and did not expend any City funds to purchase the public
access easement. In accordance with the City's Policy regarding street and alley vacation transactions
approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair
market value or any portion thereof of purchase price of the public access easements.
This project is located in COUNCIL DISTRICT 8, Mapsco 78W and 81 B.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that approval of these recommendations will have
no material effect on City funds.
