AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE TRANSPORTATION IMPACT FUND IN THE AMOUNT OF $448,000.00, FROM
AVAILABLE FUNDS, FOR THE PURPOSE OF THE PURCHASE OF RIGHT-OF-WAY
FOR THE PROPOSED CONSTRUCTION OF PARK VISTA BOULEVARD FROM
KELLER HICKS ROAD TO RAY WHITE ROAD; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Transportation Impact Fund in the amount of $448,000.00, from available funds, for the purpose of the
purchase of right-of-way for the proposed construction of Park Vista Boulevard from Keller Hicks Road to
Ray White Road,
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Acquisition of a Fee Simple Interest and Two Temporary Construction Easements on a Total of
0.2279 Acres of Land Located at 4140 Keller Hicks Road from Michael and Sarah Farris and Claudia
Hosfelt in the Amount of$434,900.00, Pay Estimated Closing Costs Up to $13,100.00 for a Total Cost of
$448,000.00 for the Park Vista Road Improvement Project and Adopt Appropriation Ordinance (COUNCIL
DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
amount of$448,000.00 in the Transportation Impact Fund from available funds;
2. Authorize the acquisition of a fee simple interest and two temporary construction easements on a total
of 0.2279 acres of land located at 4140 Keller Hicks Road, Fort Worth,Texas, from Michael and Sarah
Farris and Claudia Hosfelt;
3. Find that the total purchase price in the amount of$434,900.00 is just compensation; and
4. Authorize the City Manager or his designee to accept the conveyance, pay just compensation, record
the appropriate instruments and pay estimated closing costs up to $13,100.00.
DISCUSSION:
Right-of-way must be acquired for the proposed construction of Park Vista Boulevard from Keller Hicks
Road to Ray White Road as described in the Economic Development Program Agreement approved by
the City Council on March 4, 2014 (M&C-26697). This is a developer funded project, however, the City is
providing funding for right-of-way only from Transportation Impact Fee funding. Right-of-way costs are
estimated to be approximately $3,000,000.00 and funds will be appropriated as parcels are acquired.
This Mayor and Council Communication (M&C) action authorizes acquisition of two temporary
construction easements and a total of approximately .1739 acres of land in fee simple for the Park Vista
Road Improvement project. The fee simple property to be acquired, pursuant to this M&C, is improved
and improvements include a vacant house formerly used as a residence, which landowner had planned to
convert for commercial use, a current residence and a storage building.
The owners will not have access to Keller Hicks Road or the proposed Park Vista Boulevard from the T
remainder of their property, thus reducing the value of their remaining property from $377,300.00 to
$37,000.00, producing damages in the amount of $340,300.00. The property owners have agreed to
accept the appraised amount as just compensation. The real estate taxes will be pro-rated with the seller
being responsible for taxes up to the closing date.

The City will pay closing costs up to $13,100.00. Upon City Council approval, Staff will proceed with
acquiring the fee simple and easement interest in the property except for the mineral estate. The deed to
the City will contain a surface waiver for the exploration of the mineral estate.
