Home My WebLink AboutContract 43893-A2 AMENDMENT No.2 TO CITY SECRETARY CONTRACT ' WHEREAS, the City of Fort Worth (CITY) and Teague Nall and Perkins, Inc . , (ENGINEER) made and entered into City Secretary Contract No. 43893 , (the CONTRACT) which was authorized by the City Council by M&C C-25936 on the 23rd day of October, 2012 in the amount of $563 , 730 . 92 ; and Amendment No. 1 which was authorized by the City Council by M&C C-26486 on the 7th day of October, 2013 ; and WHEREAS, the CONTRACT involves engineering services for the following project : Chapel Creek Bridge over Interstate Highway 30 WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee . NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated April 27, 2015, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $45, 946 . 00 . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $835, 881 . 92 . 3 . All other provisions of the Contract, which are not expressly n amended herein, shall remain in full force and effect. The following is a brief description and cost for the additional services to be provided on this project: I. Project Management: Teague, Nall and Perkins will be required to perform additional project management services because the construction letting schedule milestone has been extended from the original contract date. The current contact schedule concluded September 2015. The projected contract award is November 2015 with construction to conclude in November 2016. This is 14 additional months of administration, invoicing, status reports, monthly meetings, and MWBE reporting. Additional project management fee is sought to recoup efforts expended to meet Texas Administrative Code (TAC) compliance for environmental service delivery (see details explained below in II, Additional Environmental Services). Fee: $20,167 II. Convert project to the 2014 TxDOT Standard Specifications: Teague, Nall and Perkins will be required to revise bid items and standards to conform to the 2014 TxDOT Standard Specifications for Construction and Maintenance of Highways, Streets, and Bridges adopted on November 1, 2014. Additional Environmental Services (DBE): During the course of project development, additional categorical exclusion (CE) documentation/tasks were identified to meet the current CE determination process required by the Texas Department of Transportation's (TxDOT) Fort Worth District and current standards required by TOOT policy to comply with Federal Highway Administration National Environmental Policy Act compliance procedures and Chapter 42 of the Texas Administrative Code (TAC). The original scope of services and fee was based on the April 16, 2012, provisions of the TAC for transportation projects. These provisions were subsequently amended to be effective April 16, 2014, and therefore required additional environmental documentation/tasks. In addition, some of the Fort Worth District's technical reports/forms were revised. All of the technical reports/forms for this project, which were prepared in March 2014, required updates/revisions. DBE Fee: $8,681 IV. Additional Geotechnical Investigation (DBE): The project scope has been modified to incorporate the ultimate typical section for IH 30. As a result, the bridge spans have been increased and additional retaining wall is required. An additional four (4) soil borings are required to meet TOOT maximum spacing requirement of 200 feet between borings. DBE Fee: $12,546 Summary of Contract Amendment Fee: I. Additional Geotechnical Investigation: DBE Fee: $12,546 Total Contract Amendment Amount: $45,946 Mr.Michael Weiss,PE April 27,2015 Page 3 of 3 Schedule: TxDOT's additional services related to environmental sponsorship has delayed the project a measurable 14 months. The City's desired letting is Fall 2015. TOOT and the MPO has the project scheduled for letting November 2016. The City is seeking an accelerated letting with MPO officials.
