HomeMy WebLinkAboutOrdinance 17251-10-2006ORDINANCE NO 17251 10-2006 AN ORDINANCE REVISING AND AMENDING CHAPTER 2, ADMINISTRATION ARTICLE VIII RECORDS MANAGEMENT" OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986), AS AMENDED, TO UPDATE ORGANIZATIONAL PLACEMENT OF THE CITY'S RECORDS MANAGEMENT PROGRAM AND REPORTING CHAIN PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. Be rt ordained by the City Council of the City of Fort Worth, Texas that: SECTION 1. Chapter 2 Admuustration, Article VIII `Records Management, of the Code of the Crty of Fort Worth, Texas (1986), as amended, is hereby further revised and amended, and after said revision and amendment shall read as follows. ARTICLE VIII. RECORDS MANAGEMENT Sec. 2 279 Records management program. (a) There is hereby created a records management program in the Crty Manager's Office for the purpose of administering an active and continuing city wide records management program. (b) The records management program will be headed by the records manager who shall be appointed by and work under the direction of the assistant city manager/chief financial officer Sec. 2 285 Records management officer (c)(1) Administer the city's record management program under the direction of the assistant city manager/chief financial officer and provide advice and assistance to department directors m its implementation, Sec 2 286 Records management policy committee. (a) The committee shall consist of the city attorney city auditor assistant city manager/chief financial officer director of information technology solutions, and nsk manager or their designees. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the vahd~udgment or decree of any court of competent~unsdiction, such voidness, ineffectiveness or unconstitutionality shall not effect any of the remanung phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council vv~thout the incorporation m this ordinance of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall take effect and be m full force and effect from and after its passage and adoption, and it is so ordained. Adopt the attached supplemental appropriation ordinance to transfer the Records and Information Management Division from the Finance Department to the City Manager's Office increasing appropriations for FY2006-07 by $275 844 00 in the City Manager's Office General Fund budget and decreasing the Finance Department General Fund budget by the same amount. DISCUSSION On August 22 2006 representatives from Maximus, Inc. presented the final report to the City Council on Finance Department Operational Review One of the recommendations was to transfer the Records and Information Management Office from the Finance Department to another more suitable department such as the City Manager's Office (CMO) This recommendation is in line with local government code In other cities similar to Fort Worth the City Manager is the arch-custodian of the majority of the City's records (Local Government Code 201 003) just as he or she is the officer for public information (Government Code 552.201) Each department director of the City maintains legal custody of their department records on behalf of the City Manager Thus the vast majority of information custody and management compliance accountability rests with and under the City Manager As a result, it was decided that the Records and Information Management Office will report to the new Assistant City Manager/Chief Financial Officer in the CMO effective October 2 2006 This supplemental appropriation will simply transfer four existing full-time employees and the related operational budget of $275 844 00 from the Finance Department to the CMO The attached change to City Code is necessary because the current Code calls for the Records and Information Management Office to be located in the Finance Department, reporting to the Finance Director The Records and Information Management Office includes four full-time employees. This program is responsible for City-wide records management compliance including retention scheduling and disposition as well as coordinating responses to public information requests Proposed changes will clarify and enhance the effectiveness of the City's records management program These actions will have a zero net Logname 03RECORDSMGMT Page 1 of 2 effect to the General Fund Upon approval of this M&C the General Fund budget and staffing in the affected departments will be as follows.
