HomeMy WebLinkAboutOrdinance 17268-11-2006ORDINANCE NO. 17268-11 2006 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF WEST WEATHERFORD STREET BETWEEN THROCKMORTON STREET AND TAYLOR STREET LOCATED ADJACENT TO BLOCK 18R, FORT WORTH ORIGINAL TOWN ADDITION AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY TEXAS AS RECORDED IN VOLUME 388-110 PAGE 97 OF THE PLAT RECORDS OF TARRANT COUNTY TEXAS CONTAINING APPROXIMATELY 16,000 SQUARE FEET OR 0.3673 ACRES OF LAND• PROVIDING FOR THE REVERSION OF FEE IN SAID LAND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That a portion of West Weatherford Street, between Throckmorton Street and Taylor Street, located adjacent to Block 18R, Fort Worth Ongmal Town Addition, an addition to the City of Fort Worth, Tarrant County Texas as recorded in Volume 388-110 Page 97 of the Plat Records of Tarrant County Texas, containing 16 000 square feet, or 0.3673 acres of land more. or less, and as more specifically described m Exhibit 1 `2" and `3 attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Waive the purchase fee of $1 196 000 00 DISCUSSION Piburn and Partners LLC on behalf of PNL Fort Worth LP Fort Worth Texas, has requested the above referenced vacation in order to reuse it as a street easement. Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on June 28 2006 Any existing utilities will be relocated at the applicant's expense An acceptable replat (FS-06-135) has been received The Engineering Department, Real Property Services Division states that the purchase fee of $1 196 000 00 has not been received and the Development staff Administrator's office has requested waiver of this fee as the right-of-way was originally acquired by plat dedication City staff recommends waiver of the purchase price The right-of-way was dedicated and there is no evidence that public funds were expended for the acquisition This request is in COUNCIL DISTRICT 9 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
