HomeMy WebLinkAboutOrdinance 17275-11-2006ORDINANCE NO 17275-11 2006 AN ORDINANCE AMENDING THE SUBDIVISION ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO 17154 AS AMENDED CODIFIED AS APPENDIX `C" OF THE CODE OF THE CITY OF FORT WORTH, TO AMEND CHAPTER 6, ARTICLE 6.D.l.c `SPECIAL REGULATIONS FOR DENSE DEVELOPMENT AREA TO ADD A PARAGRAPH TO INCORPORATE THE TRINITY UPTOWN DEVELOPMENT STANDARDS AND GUIDELINES BY REFERENCE INTO THE SUBDIVISION ORDINANCE, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES, PROVIDING A SAVINGS CLAUSE PROVIDING A SEVERABILITY CLAUSE, PROVIDING FOR PUBLICATION AND NAMING AN EFFECTIVE DATE. WHEREAS, on September 12, 2006 the City Council of Fort Worth adopted Ordinance Number 17154 establishing the `Subdivision Ordinance" of the City of Fort Worth, Texas, and WHEREAS, on November 7 2006 the City Council of Fort Worth adopted Ordinance No 17273 11 2006 establishing the Trimty Uptown District and adopting development standards and guidelines applicable to certain development projects m the Tnmty Uptown area, and WHEREAS, the Trimty Uptown Development Standards and Guidelines include an urban design plan to facilitate the proper subdivision of land m the newly created Trinity Uptown District which includes maps and diagrams which depicts locations, cross-sections and standards/guidelines for streets and waterways, and sets forth locations/guidelines for schools, parks, and other pubic spaces which are consistent with the vision for Trinity Uptown, and WHEREAS, on September 27 2006 the City's Plan Commission recommended for approval the incorporation by reference of the Tnmty Uptown Development Standards and Guidelines into the Subdivision Ordinance m order to facilitate the proper subdivision of land and implementation of the urban design plan m the Trmrty Uptown Distnct; WHEREAS, the Crty Council has determined that rt is advisable to amend the Subdivision Ordinance to incorporate the Trimty Uptown Development Standards and Guidelines, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS AS FOLLOWS. SECTION 1. Appendix `C" of the Code of the City of Fort Worth, Texas (1986), is amended by amending Chapter 6 Article 6.D 1 c `Special Regulations for Dense Development Area as set forth below so that hereafter Chapter 6 Article 6.D l.c shall read as follows c. Special Regulations for Dense Development Area 1 Areas zoned for 'MU 1 'MU 2 'MU 1 G and 'MU 2G Mixed-Use Districts, or 'H" Central Business District shall conform to the following block restrictions Street Length (feet) Max. No Mimmum Maximum Lots or D.U. Downtown CBD Lots (Zoned `H") 250 500 n/a Inner City Lots (Zoned `MU") 200 500 n/a Note: Private Streets with adjacent idewalks that are cessible through a public easement, or a private walkway which is essible thru such public asement, may serve as block boundary To ensure efficient circulation, the maximum distance between publicly accessible streets shall be one thousand (1000) feet. No block may have a perimeter greater than one thousand hundred (1600) feet. 2. The Trmrt~ptown Development Standards and Guidelines are hereby incorporated by reference as if fully set forth m these regulations and shall apply to areas zoned `TU". SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the Crty of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstrtutionahty shall not affect any of the remaimng phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the Crty Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4 Any person, firm, or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Five Hundred Dollars ($500 00) for each offense Each day that a violation exists shall constitute a separate offense. SECTION 5. All nghts and remedies of the Crty of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of provisions of the Code of the City of Fort Worth which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending m court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6. That the Crty Secretary of the City of Fort Worth, Texas is hereby directed to publish this ordinance for two (2) days m the official newspaper of the Crty of Fort Worth, Texas, as authorized by V T C.A. The urban design plan includes maps and diagrams depicting the locations cross-sections and standards/guidelines for streets, locations cross-sections and standards/guidelines for water bodies and locations and standards/guidelines for schools parks, and other public spaces within Trinity Uptown Similar in function to the City's Master Thoroughfare Plan and Street Development Standards, the Trinity Uptown Urban Design Plan guides the location and design of these public spaces so as to encourage development that is consistent with the vision for Trinity Uptown and principles outlined in the Trinity Uptown Development Standards and Guidelines The Subdivision Ordinance does not currently allow the implementation of the urban design plan To facilitate the implementation of the urban design plan the City Plan Commission voted unanimously to recommend approval of the attached amendment at their September 27 2006 meeting Adoption of the attached amendment will incorporate the Trinity Uptown Development Standards and Guidelines into the Subdivision Ordinance by reference FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City Funds TO Fund/Account/Centers FROM Fund/AccountlCenters Submitted for City Manager's Office b~ Dale Fisseler (6140) Originating Department Head Bob Riley (8901) Additional Information Contact: John Garfield (8043) Logname. 06AMEND SO Page 1 of 1
