WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1 . Article I, of the Contract is amended to include the addition- al engineering services specified in M&C C-19849, adopted by the City Council on the 11th day of November, 2003 and further amplified in a proposal letter dated August 6, 2003, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $18,100. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $39,600. Total Amount Due $4,290.00 ATTACHMENT "B" General Scope of Services "Scope of Services set forth herein can only be modified by additions, clarifications, and/or deletions set forth in the supplemental Scope of Services. In cases of conflict between the Supplemental Scope of Services and the General Scope of Services, the Supplemental Scope of Services shall have precedence over the General Scope of Services." The OWNER (City of Fort Worth) shall pay to the ENGINEER (Cheatham and Associates) an amount based on an hourly rate in a total not-to-exceed amount of$18,100.00 for the General Scope of Services. Preliminary Engineering Study for the Proposed Dick Price Road Project (not-to-exceed amount of$7,600.00) The Scope of Services include a preliminary engineering study of the proposed Dick Price Road project. The study will include an analysis of the following items: • Roadway Alignment • Roadway and Off-Site Drainage Study • Utility Investigation • Preliminary HEC-2 Analysis • Complete Cost Estimates of Each Alternative • Coordination Meetings The purpose of this study is to identify the most cost effective roadway alignment and drainage facilities for the Dick Price Road project that also meets the criteria of the City of Fort Worth and the City of Kennedale. Deceleration Lane at the Proposed Dick Price Intersection (not-to-exceed amount of$10,500.00) The Scope of Services consist of the redesign of the TxDOT plans for Business Highway 287 to include a deceleration lane at the proposed Dick Price Road intersection. The items to be redesigned are as follows: • Paving Plan and Profile • Storm Drain Plan and Profile • Storm Drain. Calculations • Inlet Calculations • Project Quantities • Pavement Striping Plan • Signage Plan We will also provide a completed change order form to TxDOT. DISCUSSION: On August 5, 2003, the City Manager administratively executed an engineering agreement with Cheatham and Associates, Inc. (CAI) in the amount of$21,500 for an alignment and feasibility study for the reconstruction of Dick Price Road. The purpose of the original agreement was to identify alternate routes along with the necessary drainage improvements for the reconstruction of Dick Price Road. The proposed roadway improvements will provide better ingress and egress for garbage trucks to the City's southeast landfill site located in Kennedale. This amendment will allow CAI to conduct additional analysis in order to determine the most cost effective alignment and drainage facilities for the roadway. The additional services to be provided also include the redesign of the Texas Department of Transportation's plans for 8U-287 to include a deceleration lane at the proposed Dick Price Road intersection. Staff considers the proposed fee of$18,010 to be fair and reasonable for the additional services to be provided. The project is located in the City of Kennedale, Mapsco 93Y; and 107 C and H.
