COUNTY OF TARRANT
INTERLOCAL AGREEMENT
This Agreement is made and entered into this J—b—�ay of�_� 2004, by .
and'oetween the County of Tarrant, acting herein by and through its governing body; the
Cormnissioners Court, hereinafter referred to as COUPvTY, and the City of Fort Worth,
hereinafter referred to as CITY, both of Tarrant County, State of Texas, witnesseth:
WHEREAS, this Agreement is made under the; authority of Sections 791.001 --
791-029, Texas Government Code; and
WHEREAS, each governing; body, in perforrni.ng governmental functions or izL
paying for the perforinancc of govcriumental functions hercunder, shall make that
performance or those payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is
in the common interest of both parties, that the undertaking will benefit the public and
that the division of costs fairly compensates the performing party for the services or
functions under this agreement; and
WHEREAS, each governing body agrees to share in the cost ofthe services
described below.
NOW THEREFORE, the COUNTY, being Precinct 1. and Precinct 3 respec(:ivc.*-,.
and CITY agree as follows;

COUNTY agrees to furnish all labor, equipment, and material necessary to
provide for construction of Garrett Street and George Court with five inches (5") of hot
mix asphaltic concrete and six inches (6") of base stabilization by Precinct 1 . Precinct 3
will cut and remove trees ar-,d brush in the proposed right of way.

CITY agrees to furnish all necessary rights ofway and plan: specifications
and engineering drawings. Relocate and/or lower all utilities and perform or contract all
concrete work pertaining to the roads and/or sewer projects.

CITY agrees to furnish all necessary traffic controls, i.e. Type A barricades to
redirect traffic flow to alternate traffic lanes during the construction phase.
4.
COUNTY agrees to furnish all necessary flag persons for task that require a flag
person.
5.
Nothing in the performance of this Agreement shall impose any liability
for claims against COUNTY other than claims for which liability may be imposed by the
Texas Tort claims Act.
6.
Nothing in the performance of this Agreement shall impose any liability for the
claims against CITY other than claims for which liability may be imposed by the Texas
Tort claims Act.
7.
If engineering services and/or storm water run-off plans are required for the
''roject, CITY shall provide and pay for such services. CITY shall notify COUNTY
within thirty(30) days of completion of the Project of any complaint which the CITY
nay ,have regarduig same. Upon completion of the Project, CITY shall be responsible for
maintenance of same.
8.
The parties to this Agreement do not intend for any third party to obtain a right by
virtue of this Agreement. CITY agrees that COUNTY is relying upon CITY for notice to
proceed with this Project, but COUN'T'Y shall not be required to perform this Agreement
within any time limit.
9.
By entering into this Agreement, the parties do not intend to create any
obligations expressed or implied other than those set out herein; further, this Agreement
shall not create any rights in any party not a signatory hereto.
10.
This agreement becomes effective when signed by the last party whose signing
makes the agreement fully executed and remains in force and effect until the completion
and acceptance of the Project unless otherwise terminated.

Authorize Execution of Interlocal Agreement with Tarrant County for the Reconstruction of Garrett
Street and Construction of George Court
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute an Interlocal Agreement with
Tarrant County to provide reconstruction of Garrett Street and construction of George Court at no cost to
the City, contingent upon Fort Worth Area Habitat for Humanity, Inc. providing funding for the City's
obligations under the interlocal agreement.
DISCUSSION:
On October 29, 2004, Fort Worth Area Habitat for Humanity, Inc. (FWAHFH) entered into a Community
Facility Agreement (CFA) No. 30807 for reconstruction of Garrett Street and construction of George
Court. Subsequently, FWAHFH has negotiated with Tarrant County to provide labor, equipment and
material for the pavement portion of infrastructure. Tarrant County has agreed to enter into an Interlocal
Agreement with the City of Fort Worth for reconstruction of Garrett Street and construction of George
Court. Pursuant to an amendment to CFA No. 30807, FWAHFH will be responsible for all the City's
obligation within this Interlocal Agreement with Tarrant County.
Under the Interlocal Agreement, Tarrant County will provide and pay for the cost of all the necessary labor,
equipment and material to perform reconstruction/construction of the pavement on these streets. The City's
obligation, assumed by the FWAHFH, under this Interlocal Agreement is to furnish all necessary rights of
way, plan specifications and engineering drawings, to relocate and/or lower all utilities, perform or contract
all concrete work including curb and gutter pertaining to the roads and/or sewer projects, and furnish all
necessary traffic control.
This property is located in COUNCIL DISTRICT 5.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
