AN ORDINANCE VACATING AND EXTINGUISHING AN EXCESS
PORTION OF THE RIGHT OF WAY ALONG TULSA WAY
ADJACENT TO LOTS 1 THROUGH 3, BLOCK 7 OF HI-MOUNT
ADDITION AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY TEXAS, AND CONTAINING 10,418 SQUARE
FEET MORE OR LESS, PROVIDING FOR THE REVERSION OF
FEE IN SAID LAND• THE RETAINMENT OF EXISTING UTILITY
EASEMENTS REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That the excess portion of nght-of way of Tulsa Way adjacent to the Lots 1 through 3 of Hi
Mount, an Addition to the City of Fort Worth, Tarrant County Texas, and containing
approximately 10 418 square feet or 0.239 acres, more or less, and as more specifically
described in Exhibits 1 `2" and `3 attached hereto and incorporated herein by reference, be
and the same is vacated and extinguished.
SECTION 2.
That all existing utility easements shall be retained by the Crty until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 3.
That the fee to the land in the above-described street and alley nghts-of way is released and
shall revert to the adjacent owner as provided bylaw
SECTION 4.
That all ordinances or parts of ordinances m conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Way to be Vacated, being more particularly described
by metes and bounds as follows
Beginning at a "Y" found in concrete (Control
Monument) in the southeast Iine of Tulsa Way for the
southwest corner of Lot 3, Block 7 Sparks Subdivision
of Hi-Mount, an addition to the City of Fort Worth,
Tarrant County Texas, according to the plat recorded
in Volume 881 Page 227 Deed Records, Tarrant County
Texas and the northeast corner of Lot 3-A of said
Sparks Subdivision,
Thence N 73°22 54"W (Base Bearing) 24 99 feet to an X"
cut in concrete,
Thence 443 82 feet along a curve concave to the
northwest whose radius is 1033 44 feet and chord is
N 35°02'28 'E. 440 41 feet to a 1/2 capped 4277 Reber
Rod set,
Thence 64 89 feet along a curve to the right whose
radius is 103 69 feet and chord is 63 83 feet to a I/'2
Reber Rod found (Control Monument) for the narthwest
corner of Lot 1 Block 7 Hi-Mount Addition, an addition
to the City of Fort Worth, Tarrant County Texas,
according to the plat recorded in VoIuzne 309 Page 52,
Deed Records, Tarrant County Texas,
Thence 501 02 feet along the southeast line of Tulsa

RECOMMENDATION
1 It is recommended that the City Council adopt an ordinance vacating a portion of excess right-of-way
along Tulsa Way adjacent to Lots 1 thru 3 Block 7 Hi-Mount Addition containing approximately 10 418
square feet or 0 239 acres
2. Waive any and all fee value of the vacated area in accordance with City Ordinance No 13767 (M8~C
G-12532, April 6 1999)
DISCUSSION
Innovative Developers Inc. on behalf of the Trinity Lutheran Church has requested the above referenced
vacation in order to replat it with their adjacent property to install a Texas Accessibility Standard compliant
entry Reviewing City departments and public utility companies have raised no objections to this request.
The City Plan Commission recommended approval of this request at its meeting on June 28 2006 Any
existing utilities will be relocated at the applicant's expense An acceptable replat (FS-06-131) has been
received
The Engineering Department, Real Property Services Division states that the fee value of the subject
property is $31 389 43 The original dedication was through the platting process and the City's interest in
the property is limited to easement rights. Since no City funds have been expended to purchase the
property or easement rights, collection of the fee value or any portion of the fee value is recommended to
be waived Additionally on April 16 1999 (M&C G-12532) Council approved Ordinance No 13767 which
allows reversion of the City's interest to an abutting property owner without payment of cash consideration
in central City redevelopment neighborhoods. The applicable criteria for this vacation is a central city area
needing revitalization
